The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall ~ilding, Wednesday, July 19th, 1961 at l:UO o'clock P.M. Presen t
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
I Ass't. City Manager Fryslie, Deputy City Attorney Berg and the Clerk.
The following proceedings were had:
Minutes of the last regular s8ss1on were read and it was moved by CommisSioner
Staudaher, seconded by Mayor Swanson, that the minutes be approved as read and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Sta~daher and Commissioner Sedivy; those voting No, none.
Death of Dan R. Lovelace - 17 July 1961 - Resolution No. 1021 in Memoriam
Mayor Swanson officially noted the death on July 17, 1961 of City Attorney
Dan R. Lovelace after fourteen years of exceptional servlce to the City of Bozeman
in that capacity. At the Mayor's request, former City Manager M. E. Henderson gave
a brief eulogy of Mr. Lovelace based on their many years of close association.
The City Commission then passed and adopted the following resolutlon:

BOZEMAN, MONTANA IN MEMORIAM TO DAN R. LOVELACE
Sale of Special Improvement District Bonds No's. 419 and 421
I Thls was the time and place set for sale of bonds of Speclal Improvement districts
numbered 419 and 421. Affidavits of publication of the separate notices of sale of
the bonds of each distrlct were presented. It was moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the Commission proceed wlth the sale of the
bonds of Special Improvement Distriot No. 419 in the total approximate amount of
$40,uoo.uo and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting
No, none.
No sealed bids on this issue of bonds were received and the following bidders
qualified by depositing with the Clerk of the Commission the necessary bid security
in the amount of $2,000.00.

Mayor Swanson announced the Commission was ready to hear oral bids for bonds
I of the district and it was agreed that final sale of the bonds would be contingent
on the legality of the prooeedings creating the district and sale of the bonds and
that the bonda would be dated September 1, 1961.
The lowes t oral bid of each bidder was as follows,,:

The City Manager reconunended that the low bid of the Security Bank & Trust Co.
be accepted and it was moved by Commissioner Sedivy, seconded by Commissioner
Staudaher, that the bid of the Security Bank & Trust Co. at the interest rate of I
4.87i% plus a $lU.OO premium on the entire issue be accepted and the bid security
of the unsuccessful bidders be returned. The motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and
Commissioner Staudaher; those votlng No, none.
No sealed bids were on file with the Clerk for the lssue of bonds for Special
ImproveMent District No. 421. It was moved by COmmissioner Staudaher, seconded by
Commissioner Sedivy, that the Commission proceed to sell the bonds ot District
No. 421 in the approximate total amount of $30,000.UO and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Swanson, Co~ssioner
Staudaher and Commissioner Sedivy; those voting No, none. It was likewise agreed
that final purchase of the bonds would be contingent on the legality ot the pro-
ceedings crea ting the die tric t and the sale of the bonds and that tbe bonds would
be dated September 1, 1961. The following bidders qualified by depositing the
necessary bid security in the amount of $1,5UO.00 with the Clerk of the Commission:

The City Manager recommended that the low bid ot Arnold Huppert be accepted
and it was moved by Commissioner SediVY, seconded by Commissioner staudaher, that
the bid of Arnold Huppert at the interest rate of 5.0% plus a $35.00 premium on the
entire issue be accepted and the bid security of the unsuccessful bidders be
re turned. The motion was carried by the to11owing Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Sedivy and Commissioner staudaher; those
voting No, none.
Resolution for Purchase of Road Oil
A resolution authorizing the City Manager to purchase not to exceed 25.000
gallons of road oild uring the year July 1, 1961 to June 30, 1962, tor use by the I
Street Department in repairing pavement and for sealing certain sections of exist-
ing pavement wi thin the City from the Montana State Hlghway Department was presented
as follows:

WHEREAS the City of Bozeman will have
need during the fiscal year July 1, 1961-June 30,
1962, for road oils for use in repairing streets and
for sealing certain section of existing pavement with-
in the City, and

WHEREAS the City of Bozeman does not have
proper facilities for handling and storing the needed
quantlties of oils, and
WHEREAS the Montana State Hlghway Depart-
ment does have storage facilities and normally does
have quantities of the required types of oils stored
In Bozeman from which it can supply the quantities
I needed by the City of Bozeman,
NOW, THEREFORE, BE IT RESOLVED:
That an emergency does exist relative to
the procurement of road oils by the City of BozemaI)
and the City Manager is hereby authorized to purchase
from the Montana State Highway Department, from its
stocks in storage in Bozeman, approximately twenty-
five thousand (25,UOO) gallons of road oil, this to
be purchased from time to time during the fiscal
fear July 1, 1961 - June 3U, 1962, as needed by the
City of Bozeman for repair and sealing of existing
pavements, and these quantlties of road oils to be
purchased a t cost plus normal handling charges.
Passed and adopted by the City Commission
of Bozeman, Montana, at a regular meeting of said
Commission held on the ~ day of July, 1961.

Petition to Establish a Special Improvement District -- N. 10th Ave.
The City Manager presented a letter which constituted a petition to request
that a Special Improvement District be established to prOVide funds for the oon-
struction of water mains on North lOth Avenue from Beall Street to Durston Road,
and all necessary sewer mains down the alley between North luth Avenue and North
lith Avenue from Beall Street to Durston Road.
The Commissl~n deferred action on the matter pending upon further study.
City Primary Election to be held Concurrently with Bond Election on Aug. 29, 1961
In vlew of the City's election called to place before the taxpayers the question
of issuing General Obligation Bonds to provide funds for proposed building facil-
I itites, the City Manager recommended that the Clty hold a Primary Election regard-
less of the number of candidates who file tor the office of City Commissioner. It
was moved by Commissloner Staudaher, seconded by Mayor Swanson, tha t the Ci ty
Primary electiong be held concurrentlY with the Bond Election on August 29th,
1961, and the motion was oarried by the following Aye and No vote: those voting
Aye being Mayor Swanson and Commissioner Staudaher; those voting No, Commissioner
Sedivy. ,

Deputy City Attorney -- Authorization of Absence from City
The City Manager reported that Deputy City Attorney Berg has been honored
by being selected the President of the Montana Bar Association, and reoommended
that Mr. Berg's request the he be authorized to attend the Natlonal Bar Association I

Meeting at St. Louis, Missouri, August 5th to the 11th, be approved. It was moved
by Commissioner Sedivy, seconded by Commissioner Staudaher, that the request be
approved and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;

Request to Hold Dance -- A. & W Drive In, 9-11:00 P.M. - 21 July
The City Manager reported that Mr. O. S. Ellison has requested that permission
be granted to hold a dance, Friday evening, 9 to 11 P.M., July 21st, at the
A & W Drive In. The City Manager requested that the request be granted and Mr.
Ellison be advised to notify the Poliee Department of any 8peoltl p>>oblems in
regar4 to the supervision of' the program. It was moved by Commissioner Staudaher,
seoonded by commissioner Sedivy, tha t the request be granted as recommended and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Staudaher and Commissioner sedivy; those voting
No, none.

There being no further business to come before the Commission at this time,
