RECOMMENDATION: Authorize the Acting City Manager to sign a Professional Services
Agreement - Task Order 3 with DOWL for the design of four in-line stormwater treatment units located near the intersections of W. Main St. and N. 3rd Ave., W. Main St. and N. Grand Ave.,
W. Main St. and N. Willson Ave., and W. Main St. and N. Tracy Ave.
BACKGROUND: The Stormwater Division advertised a Request for Qualifications (RFQ) for
Stormwater System Improvement and Low Impact Development Design Services in 2015. Staff
selected HDR Engineering, INC. and DOWL as the most qualified and executed a two-year task order based Professional Services Agreement with both consultants. The City Commission
approved the Professional Services Agreements, and the City Manager proceeded to sign both
contracts on November 16, 2015.
Staff utilizes the selected consultants to complete stormwater related engineering services on an
“on call” basis. Requested services include, but are not limited to, design work, soil testing, surveying, and construction administration. Once Staff selects a consultant for a particular
project, an individual task order, scope, and budget is prepared and presented to the City
Commission for approval and ratification from the City Manager.
Attached is a copy of the partially executed Professional Services Agreement - Task Order 3 with DOWL for the design of four in-line stormwater treatment units located near the intersections of W. Main St. and N. 3rd Ave., W. Main St. and N. Grand Ave., W. Main St. and
N. Willson Ave., and W. Main St. and N. Tracy Ave. The City requires infrastructure
improvements at these locations to treat stormwater originating from a 219-acre urban drainage
area, allowing for the removal of pollutants that would otherwise dump directly into Bozeman Creek and a measurable step towards MS4 Discharge Permit compliance. Staff is proceeding with the design of four individual units located within sub-watersheds rather than one large unit
serving the entire drainage area due to long-term maintenance concerns, unit sizing limitations,
and infrastructure depth.
Staff reviewed the Professional Services Agreement - Task Order 3 and found it to be commensurate with the work proposed.

ALTERNATIVES: As suggested by the Commission.

FISCAL EFFECTS: DOWL has proposed a budget of $41,075 to perform the scope of services
negotiated in the attached Professional Services Agreement - Task Order 3. Adequate funding
exists within the FY17 Stormwater Fund’s approved budget. Specifically, FY17 CIP Item
STRM29, which allocates $50,000 for this project’s design.
