Final Plat for The Lakes at Valley West Report compiled on: March 23, 2017 Attachments: Final Plat, Staff Memorandum Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Addi Jadin, Associate Planner SUBJECT: Final Plat for The Lakes at Valley West – Phase 3 Subdivision MEETING DATE: April 3, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for The Lakes at Valley West Phase 3 Subdivision and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, and authorize the Director of Community Development to execute the improvements agreement on behalf of the City of Bozeman. RECOMMENDED MOTION LANGUAGE (if moved to Action Agenda): Having reviewed and considered the staff memorandum, application materials, public comment, and all the information presented, I hereby move to approve the Final Plat for The Lakes at Valley West Phase 3 Subdivision and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, and authorize the Director of Community Development to execute the improvements agreement on behalf of the City of Bozeman. BACKGROUND: On October 10, 2016, the Bozeman City Commission conducted their review of the Preliminary Plat application for The Lakes at Valley West Phase 3 Subdivision and voted 5-0 to conditionally approve the preliminary plat application. §76-3-611(1), MCA, provides that the City Commission shall approve the plat only if: (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. The County Treasurer has certified that all real property taxes and special assessments assessed and levied on the land to subdivide have been paid. Attached is a memorandum from Addi Jadin, Associate Planner, stating the staff has concluded that all terms and conditions of the preliminary plat approval have been met. 20 Report compiled on: March 23, 2017 Attachments: Final Plat, Staff Memorandum One Improvements Agreement is required for final plat approval of this subdivision. The improvements agreement guarantees the installation of public sidewalk, water and sewer mains, street paving, public landscaping, public street lighting, and common open space improvements. The improvements agreement guarantees the installation of public sidewalk improvements within thirty-six (36) months of the filing of the final plat and guarantees the installation of all other improvements within six (6) months of the filing of the final plat. Two irrevocable standby letters of credit each in the amount of $1,250,000 for a total amount not to exceed $2,500,000.00 have been provided for financial security. All other necessary infrastructure improvements are constructed. UNRESOLVED ISSUES: None identified. ALTERNATIVES: None suggested or proposed. THEREFORE, BE ADVISED, that Building Permits will not be issued for Lot R2A, of the Lakes at Valley West Subdivision Phase 3, City of Bozeman, Gallatin County, Montana until all required on and off site improvements are completed and accepted by the City of Bozeman. No building structure requiring water or sewer facilities shall be utilized on this lot until this restriction is lifted. This restriction runs with the land and is revocable only by further subdivision or the written consent of the City of Bozeman. 2.Ownership of all common open space areas and trails, and responsibility of maintenance thereof and for city assessments levied on the common open space lands shall be that of the property owners' association. Maintenance responsibility shall include, in addition to the common open space and trails, all vegetative ground cover, boulevard trees and irrigation systems in the public right-of-way boulevard strips along all external perimeter development streets and as adjacent to public parks or other common open space areas. All areas within the subdivision that are designated herein as common open space including trails are for the use and enjoyment by residents of the development and the general public. The property owners' association shall be responsible for levying annual assessments to provide for the maintenance, repair, and upkeep of all common open space areas and trails. No crawl spaces or basements may be constructed such that sump pumps are required to pump water from these spaces. Sump pumps are not allowed to be connected to the sanitary sewer system. Sump pumps are also not allowed to be connected to the drainage system unless capacity is designed into the drainage system to accept the pumped water. Attached is a copy of the Findings of Fact and Order. The Commission approved the Findings of Fact on October 24, 2016. An Improvements Agreement is required for this subdivision for the following improvements: public landscaping, public street lighting, water and sewer mains, street paving, all sidewalks, and certain improvements to common open space including adjacent sidewalks. Based on the summary review provided below, the City Engineering Department and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the Final Plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, property owner association documents, improvements agreement, and a copy of the Findings of Fact and Order are attached for your review. The Community Development staff respectfully requests that you prepare City Attorney's Certificates using the attached original Platting Certificates as updated; approve the Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plats. A completed application was submitted to the Community Development Department on March 10, 2017. Based on the applicant having submitted a complete application on March 10, 2017 the application was deemed complete on March 15, 2017, the 45-day (working days) review period for this final plat would expire on May 17, 2017.
