The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, February 8, 1961 at 1:00 o'clock p.m. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
I Ass't. Ctty Manager Fryslie, City Attorney Lovelace and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Applications -- The Bowl - City Beer and Linuor Licenses
Applications accompanied by the required license fess submitted by The Bowl request-
ing City beer and liquor licenses were presented. The City Manager stated the applica-
tions were in order and recommended the Commission approve issuance of the licenses to
the applicant. It was moved by Cormnissloner Staudaher, seconded by Commissioner SediVY,
that the Director of Finance be directed to issue the licenses in accordance therewith
and the motion was carried by the following Aye and No vote: those voting Aye being
l/[ayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Purchase of Supplies -- Water and Sewer Departments
I The City Manager reported the Water Department has need for additional supplies of
the following: Approx. Cost
6" Cast lron Pipe $950.00
Fire Hydran ts 990.00
4"-6"-8" Cast iron valves 600.00
and sewer rod (39"x5/l6") in the approximate amount of $800.00 for the Se~er ~epartment.
It was moved by Commissioner Sedivy, seconded by Commissioner 3taudaher, tha t the C1 ty
Manager be authorized to place orders for the supplies. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy
and Commissioner Staudaher; those voting No, none.
Street Lights -- Request (Vicinity of Bozeman Senior High School)
The City Manager presented a letter written by Hiney P. Lund, principal of the
Bozeman Senior High School, requesting that, due to vandalism, and the clogging of an
open ditch on the High School premises as well as a need of students and faculty using
the High School building after hours, the City provide street lights at the intersections
o.f Mendenhall and Larrrrne Streets a t Eleventh Avenue. The City Manager added that the City
Engineer and personnel of the Montana Power Company had made a study of the matter and
I suggested that a 1u,000 lumen light be placed at the corner of Mendenhall and Eleventh
to remedy the situation. The City Manager stated such an arrangement could be provided
at a cost of $3.29 per month to the City and concurred with the suggestion. It wa s
moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the light be
placed as concurred in by the City Manager and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sioner Sedivy; those voting No, none.

Acceptance of Contract -- Swimming Pool, F. L. Dye Co., Con tractor
The City Manager prosented a letter written by R. L. Prusslng Engineers, the firm
retained by the City as architect and engineer for the repair of the City swimming pool,
which stated that the contract work on the project had been satisfactorily completed by
the contractor on the proj ec t, F. L. Dye Co~, and recommended that the City accept the
contract as completed. It was moved by Commissioner Sedivy, seconded by CommJssioner I
Staudaher, that the contract be accepted as recommended and the motion was carried by
the following Aye and No vote: those votIng Aye being Mayor Swanson, Connnissioner
Sedivy and Commissioner Staudaher; those voting No, none.

The following reports for the month of January, 1961 were presented:

The City Manager s ta ted tl'1a t the reports appeared to be normal and in order and
recommended that they be approved. It was moved by Commissioner Staudaher, seconded by
Commissioner Sedivy, that the reports be aocepted and ordered ftled and the motion was'
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis-
sioner Staudaher and Commissioner Sedlvy; those voting No, none.
Hearing (continued) -- Mr. & Mrs. Smyrl (Dog Kennel)
The hearlng on the applicatlon for the granting of a dog kennel license at 509 S.
Eleventh to Mr. and Mrs. Samuel H. Smyrl was re-opened. Mr. Fred Klindt appeared to I
object to the grantine of the license in behalf of Mr. and Mrs. W. C. Benson the own-
ers of the property. Following the objection, Mrs. Smyrl presented a l~tter signed
by 18 persons indicating they had no objection to allowing the Smyrl dogs to remain,
nor to the issuance of a kennel license to the Smyrls at 509 S. Eleventh Avenue.
!/Irs. Smyrl, also, presented considerable thinking to support her kennel license applica-
tion. Following the foregoing discussion and after comment of the City Attorney, it was
recommended by the City Manager that the application be denied based upon the ~ntent of
the Zoning Ordinance (#818) , ("A" residence zone), as well as upon objections previously
registered. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,
tha t the applica tion for the license be denied and ~l1rs. Smyrl' s check of $20.00 accomp-
anying tbe application be returned to her. The motion 1;JaS carried by the followirlg

The City Manager stated he had audited the claims and found them to be true and
lawful claims against the City of Bozeman and recommended that they be approved and
warrants be issued for their payment. After examination of the claims in detail and
checking against the claim register, ,it was moved by Commissioner Sedivy, seconded
I by Commissioner staudaher, that all claims be approved. The motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy
and Commissioner Staudaher; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, lt
was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, tha t the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting
No, none.
