The Commission of the City of Bozeman met in regular sesslon in the Commis-
sion Room, City Hall Building, Wednesday, March l5, 1961 at 1:00 o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City
Manager Cutting, Ass't. City Manager Frys1ie, City Attorney Lovelace and the Clerk. I
The following proceedings were had:
Mlnutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as reed
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.
Radio Station (KXXL) -- Coverage of Commission Meetings via Radio
Mr. Rapkoch of Radio Station KXXL appeared to discuss the possibility of tape
recording or other means of providing news coverage of City Commission meetings
for radio audiences. The Manager stated that all official meetings of the Commis-
sion are open to the public by legal requirement, so that any lnterested party
may attend and take whatever notes he may desire, but that he would not recommend
tape recordings being permitted. The Manager said that one of the principal assets
of the manner in which Bozeman's City Commission meetings are conducted is the
informal atmosphere maintained permitting any citizen to express himself freely
in a discussion of his problem and be answered in kind. He further s ta ted tha t, I
in his opinion, the likelihood of serious misunderstandings that could result
from material taken out of context due to microphone limitations would not be in
the public interest and that he felt the probability of destroying the present
informal atmosphere of the meetings would not be desirable.
After the Commission reiterated its policy of full cooperation with all news
servlces, Mr. Rapkoch announced that he would give the matter further study be-
fore presenting any formal request.
Violation of Codes -- James McReynolds
During the Commission meeting held March 8th, 1961, the City Manager reported
it appeared that James McReynolds of Gallatin Gateway, Montana during the Constr-
uction and occupancy of the premises at 307 E. Beall had acted in total disregard
of various City Codes, and the matter was to be referred to the City Attorney for
advice in regard to what appropriate action should be taken by the Clty. The City
Manager presented his draft of a proposed letter to be sent to Mr. McReynolds
listing the numerous ways in which he had violated the Codes in complete dis-
regard of frequent advice given him by the Manager, the City building inspector I
and the City Engineer. Briefly, the letter informed Mr. McReynolds the t unless
the building was brought under full compliance with the City ordinances by May 1,
1961, the City would deem it necessary to discontinue water, sewer and other
utility services to the premises on May 2nd, 1961. The Manager expressed a desire
that the City Commission express its approval of the proposed action. It was moved
by Commissioner Staudaher, seconded by Commissioner SediVY, that the proposed

action be approved and the motion was carried by the following Aye and No vote:
those votlng Aye being Mayor Swanson, Commissloner Staudaher and Commissioner
Sedi vy; those voting No, none.
Candidates for Police Academy -- Montana State College
The City Manager presented a letter he received from C. V. ~aunders, Chief of'
I Police, which stated the Montana Police Academy has been scheduled to be held at
Montana State College, April 3 through April 14 inc1uslve, with an Administrative
school to follow April 17 through April 2l, 1961, and the Bozeman Police Depart-
ment is allowed two students in the two week course and one student in the Admin-
istrative course. Chlef Saunders requested that Sgt. Rex Duncan and Officer Cliff
Dorman be granted the opportunity to attend the two week course and Capt. B. G. Davis
to attend the Administrative course. It was moved by Commissioner Sedivy, seconded
by Com.'11issioner Staudaher, that the request be granted, and that, it being in the
public interest, the necessary expenses incurred be paid from the General fund.
The motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissloner Sedivy and Commissioner Staudaher; those voting No, none.
Reques ts -- MSC -- Fieldhouse
The City Manager presented a letter received from Bud ~urdy, Fieldhouse
Director at Montana State College, which requested the following:
(a) World Series of Basketball - 11 April, request for sound truck.
(b) Ringling Brothers and Barnum & Bailey Circus, 2-3, August:
I (1 ) Request for Street Parade
(2 ) Consideration of modification of City license
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
the followlng be approved:
(1) The request for the sound truck be granted, subject to:
its use be confined to the buslness district, its use
be limi ted to (3U) minute periods and appropriate dis-
cretion be used as to volume of sound.
(2) The request for the street parade be allowed.
and, the City Manager be instructed to notlfy Mr. Purdy of its approval of the
above portion of his request; but, that the City under the provisions of the
Bozeman Municipal Code 1s not authorized to modify llcense fees for commercial
enterprises. The motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner ~taudaher and Commissioner Sedivy;
those voting No, none.
