The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, Jamary 4th, 1961 at l:Ou o'clock p.m. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager
,I',,' Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk.
~ The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved aa read
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.
Examination of Depository Bonds
The Commission proceeded to examine the Custodian's Receipts for Depository Bonds
held by the Director of Finance as security for City funds deposited in Bozeman banks.
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the
securities be approved and a list thereof be set forth in full in the minutes of
this meeting and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.

ance with the provisions of Section 16-261H R. C. M., 1947 have this day examined
.. the receipts of the Federal Reserve Bank of MinneapoliS, the National Bank of
Commerce, Seattle, Washington, and the Northwestern National Bank of Minneapolis,

Reports
The following reports for the month of December, 1960 were presented:
Cashier Police Judge
Police Chief Fluoridation
Fire Chief L1brarian
Building Inspector Disposal Plant Uperator
The City Manager s ta ted tha t the reports appeared to be normal and in order
and recommended that they be approved. It was then moved by commissioner Staudaher, I
seconded by Commissioner sedivy, that the reports be accepted and ordered filed and
the motion was carried by the followlog Aye and No vote: those voting Aye belng
Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Training School -- Reserve Practices -- Livingston
The City Manager stated that a rescue practices training school is scheduled
to be conducted in Livingston during the week of January 16th, and recommended that
a member of the fire department be authorized to attend the school. It was moved
by Commissioner Sedivy, seconded by Commissioner Staudaher, that the recommendation
be approved and that, it being in the public interest, the necessary expenses of the
delegate to attend the school be paid from the General fund. The mot1on was carried
by the follOWing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner Staudaher; those voting No, none.
Directors' Meetlng -- State Fire Chiefs' Ass'n., Great Falls
The City Manager reported tnat the annual directors meeting of the State Fire
Chiefs Association is to be held in Great Falls, January 16th, and recommended that
Chief Pentll1a be authorized to attend the meeting. It was moved by 0ommissioner I
Sedi vy, seconded by Commissioner Staudaher, that the authorization be granted and
tha t, it being in the public interest, the necessary expenses to attend the meeting
be pa id ou t of the Gene ra 1 fund. ~he motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No, none.
Loading, Zone -- 41 W. Mendenhall
John Lux of Lux Transfer and Storage appeared before the Commission to request
that a loading zone be prOVided at the entrance to his place of business at 41 West
Mendenhall. The matter was referred to the City Manager and the Chief of Pollee
for study.
Application for Dog Kennel License -- Smyr1
The pity Manager again placed before the Commission the application submitted
by Mr. and Mrs. Samual H. Smyr1 requesting a license be issued for a Dog Kennel at
509 South Eleventh Avenue. The Commission discussed the matter a t length with
Mrs. Smyrl, City Attorney Lovelace and the City Manager. On recommendation of the I
City Attorney concurred in by the City Manager, it was moved by Commissioner
S taudahe r, seconded by Commissioner sedivy, that in accordance with the prOVisions
of Ordinance No. 822, this application be scheduled for a public hearing to be held
on January 25, 1961 and the Clerk of the Commission be directed to publich notice
of su,ch hearlng accordingly, and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Staudaner and Commis-
sioner Sedivy; those voting No, none.

Quit Claim Deed -- Bozeman Country Club
A Quit Claim deed executed by the last surviving dlrectors of the Bozeman
Country Club to transfer the fOllowing property to the City was plaoed before
the Commisslon:
I The East Half (El) of Lot One (1) in Block (13) of Drum
Lummon Addition to the City of Bozeman.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,
that
the deed be accepted and placed on record and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner sedivy and
Commissioner Staudaher; those voting No, none.
State Gasoline Tax Refund Claim
A claim for refund of State Gasoline Tax for gasoline used by the City in
the amount of $1,416.24 was presented. The Oi ty Manager reques ted the t he be
authorlzed to slgn the claim in behalf of the City and it was moved by Commissioner
Sedl vy, seconded by Commissioner Staudaher, that the authorization be granted and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and CODDl1issioner Staudaher; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time,
I it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the
meeting adjourn and the motion was carrled by the following Aye and No vote:
