(.- Bozeman, Montana October 13, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Thursday, Cctober 13th, 1960 at 1:00 o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, Ass't. City Mana~er Fryslie, Deputy City Attorney I - Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner StaudaherJ those voting No, none. Minutes of the Special Session held October llth, 196C were reed and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No votea those voting Awe being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Resolution No. 995 -- Creating Special Improvement Sprinkling Distriot No. 2 This was the time and plaoe set as published in the Notice of Intention to Create Special Improvement Sprinkling District No.2, Commission Resolution No. 987. to pass upon all protests, if . any, against the proposed work or against the creation or extent of said District. Arfidavi t of publication of Notice was presented together with the Clerk's Mailing Certificate stating that all property owners were notified. Cne written protest to the creation of the district was on file with I the Clerk of the Conunission, and no one was present to further protest the proceedings. The City Manager stated that he deemed the protest insufficient and recommended that the City Commission pro- ceed to create the District. Resolution No. 995 creating Special Improvement Sprinkling District No. 2 was presented, entitled: COMMISSION RBSOLUTION NO. 995 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SFRCIAL IMPROVEMENT DISTRICT TO BE KNCWN AS SPECIAL IMPROVEM~NT SPRINKLING DISTRICT NO. 2 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF' SPRINKLING WATER. Resolution No. 996 -.. Creating Speoial Improvement Sprinkling Distriot No. 3 This was the time and place set as published in the Notice of Intention to Create Special Improvement Sprinkling District No.3. Commission Resolution No. 988, to pass upon all protests, if any, against the proposed work or aEainst the oreation or extent of the District. Affidavit of public- ation of Notice was presented together with the Clerk's Mailing Certificate stating that all property owners had been notified. There were no written protests on file with the Clerk of the Commission to register a protest to the creation of the District, and no one appeared before the Commission to verbally protest the proceedings. The City Manager recommended that the City Commission proceed to create the District. Arkwright, Inc., and recommending that the City accept and approve the project as completed was placed before the Commis- s ion. The City Manager concurred in the recommendation of the engineer and stated claims for final payment would be presented after a determination had been made that all claims against the contractor resulting from the construction have been paid and other records of the project completed. S.I.D. No. 414 -- Acceptanoe of Contraot A letter received from the engineer on Special nmprovement District No. .1., John S. Bereman & Co., addressed to the City Manager stating that the Con$trl~ction on the project had been completed in aocordanoe with the terms and specifications of the contract by the contractor, Stanley H. Arkwright, Inc., was placed before the Commission. The letter further stated that, al though, a portion of the contract had not been completed within the time limitation specified in the contract, the engineer did not favor an assessment for damages for overrun of the contract. Wheeled Front End Loader -- Purohase The City Manager reported that after e_ thorough study of the bids that were submitted for a traotor mounted wheelec front end loader, that he conourred with the joint recommendation of the Street Superin- I tendent, City Engineer and the Ass't. City Manager for the aoceptance of the bid of the Industrial Equipment Co., Billings, Montana, for a Model H-70, Hough Tractor Loader. The City Manager further recommended that the alternate bid of the firm for a Model A-76L, Bros Snow Loading attachment be accepted and th~t authorization be granted for the purchase of the combined units. Re-Advertise for Bids for one i tonl 4 x 4 Truok During the regular meeting of the Commission on October 5th, bids were opened as advertised, for the purohase of a i ton~ 4 x 4 truck. One bill was submitted and action on the matter was tabled until the next regular Commission me.ting. The City Manager stated that in his opinion the bid sub- mitted was insufficient in content and must necessarily be rejected and recommended to the Commission that the City re-advertise for a oall for bids on the proposed unit. Request -- "Toroh Lite" Street Parade, Republican Central Co~~ittee A request received from the Gallatin County Republican Central oommittee to state a "Torch Lite" street parade at 7:15 p.m., October 25thl was placed before the Commission. It was moved by Com- missioner Sedivy, seconded by Commissioner Staudaher, that the request be granted and the motion was carried by the following Aye and No votea those voting Aye being Mayor S"ansonl Commissioner Sedivy, I and Commissioner Staudaher; those voting No, none. Request -- Construct Addi tion to Parkway Grooery "Lots 11-14, Blk 51, West Park" During the previous meeting of the Commission, Ootober 5th, action regarding a request to con- struct a 15 foot addition to the present store building of the Parkway Grooery situated on Lots ll-l4~ Block 51, West Park was tabled to permit a proper presentation of the request. The City Engineer presented the proposed plans of the addition and staed the request was not violation of the present City Ordinanoes; therefore, he recommended that the request be approved. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher, and Commissioner Sedivy} those voting No, none. Reinvestment of Water FulJds It was reported by the Direotor of Finanoe that $70,000.00 of Water Funds now invested in U. S. Treasury Bills would mature in the near future, and would be available for reinvestment in like securities. Upon the reoommendation by the City Manager, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the reinvestment of these funds in the approximate amount of $70,000.00 be authorized and the motion was carried by the following Aye and No vote: those voting I Aye being Mayor Swanson, Commissioner Staudaher, and Commissioner S@diVYJ those voting No, none. Maple Terrace Subdivision AHro'Jal of Plat -- The proposed plat of Maple Terraoe Subdivision, a rearrangement of the Homesite Subdivision, was plaoed before the Commissi?D for approval. The City Manager presented a letter received from the City-County Planning Board stating that the Board had approved the plat, subjeot to the condition th~ the two unnamed county roads be designated as North Seventeenth and North Nineteenth, during its regular meeting held October 3rd, 1960. Acting City Me.nager -- Harold Fryslie, Ootober 15th -- 23rd The City Manger requested that in his absenoe to attend the International City Manger Associa- tion's annual oonference, October 15th to 23rd, Harold F'ryslie, his assistant, be designated Acting City Manager.
