Resolution No. 1006 -- Extending the Bojndarie. of City of Bozemaa During the regular session of the City Commission held on October 5, l~60, the Commission regularly passed and adopted Commission Resolution No. 994, deolaring its intentionto extend the boundaries of the oity limits to inolude contiguous traots west of the City within its oorporate limits. The affi- davit of publication of the Notioe was presented. There were no protests filed and no one was present to protest. Resolution No. ICOS extending the oity limits was presented, entitled~ COMMISSICN RESOLUTION NO. 1006 .A: RESOLUTION OF THE COMMISSION CF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES CF THE SAID CITY CF BOZEMAN SO AS TO EMBRACE AND INCLUDE CERTAIN TRACTS OF LAND CCNTIGUCUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED WITHIN THE CORPORATE LD4ITS THERlOOF It was moved 8Y Commissioner Sedivy, seoonded by Commissioner Staudaher, that the resolution b. Garbage Disposal Unit (Truok) -- Bids Rejected.. During the meeting held Ootober 19th, bids were opened, as advertised, for the Furohase of a Garbag. Disposal Unit (Truok). Bidders were informed at that time, that to allow time for study of the speoi- fioations of the various units, alternates, eto., final awarding of the contraot would be announced at the regular meeting to be held on November 2, 1960. After presenting a oomplete tabulation and analysis of all bids submitted, the City Manager advised the Commission and bidders representatives present that speoifications oontained in the oall for lkd.ds were the lame as used two years ago when the last unit of this kind was purohased, wherein it was required that the body of the unit be mounted on a truok as speoified by the body manufaoturer. It was then stated that all but one of the lower bids just received offered a unit of less than 25,0.00 ~b.~ GVWwhioh is not oonsidered aooeptable being inadequate to withstand the..rvioe to whioh the unit will be subjeoted in Bozeman. The Manager therefore reco~nded tha t, even though alternate bids offering larger truok units were received, in view of an evident mis- understanding of the requirements of the specifioations, all bids be rejeoted and a new oall for bids, based on revised speoifioations, be issued. Net prioe '3,683.14 Less a Trade-in 383.14 Total '3,300.00 Action on the matter was tabled until the next regular Conunission meeting, November 9, 1960. Federal Grwt -- Sewage Treatment WOrk. During the Comndssion meeting of June, 22, 1960, authority was granted by the Commission to the Ci ty Manager to apply for a grant of Federal funds in the approximate amount of $10,500.00 to auist in repairing and improving the City Sewage Disposal Plant, and, in turn, the Mayor was designated as the representative to sign the applioation and other doouments pertaining thereto. Proposed Commission Resolution No. 1007 prepared to aocept the offer of a Federal grant in the amount of tlO,2IS.80 was presented, entitled. Action on the matter was tabled until November 9~ 1960, the next regular meeting of the Commission. Indemnity Bond. -- Stanley B. Arkwright, Ino. S.I.D. No. '11 An indemnity bond in the amount of tIO,OOO.OO setting forth Stanley H. Arkwright, Ino. as prinoipal, end Central Surety and Insuranoe Corporation as Surety agreeing to save harmless the City of Bozeman from. all loss and damages it may sustain, and from all liability it may incur or suffer to other per... sons by reason of the Prinoipals default in paying its just and legal obligations incurred in the per- formanoe of the oompletion of its oontraot for the oonstruction of street improvements in Speoial ~ Provement District 1411 was plaoed before the Commission for approval. Aotion on the matter was tabled I until the next regular meeting, November 9, 1960. Sub-Contraot -- S.I.D. No. 4:18 An agreement between Kiely Conl~ruotion Co. of Butte, Montana and F. J. Allen, Butte, Montana was presented. This agreement provides that F. J. Allen will do speoified work as a sub-contraotor on the oontract awarded Kiely Construotion Co. for oonstruotion in Speoial ]mprovement Distriot No. 418 at a cost of $8,139.00. Following the reoommendation of the City )lanager, it was moved by Commissioner Sedivy, seoonded by Commissioner S+audaher, that the City approve the agreement and the City Manager be direoted to notify the contracting parties of its action. After examination of the olaims in detEdl and ohecking against the olaim register, it was moved by Commissioner Staudaher, seoonded by Commissioner Sedivy, that all claims be approved. The motion was carried by the following Aye and No votea those voting Aye being Mayor Swanson, Commissioner Staudaher and Commdssioner Sedivy; those voting no, none. S.I.D. No. 418 -.. Change Order Change Order No. 1 to Plans and Specifications for construction of S. 1. D. No. 4lg as prepared by a cost of $689.88 less $235.00 for concrete pipe replaced or Harold Hoskins & Associates, supervising engineers, was presented. It authorized additional work at~ net increased cost of $454.68 for the Contractor to construct a rectangular flow structure to pennit the flow of stom drainage across Rouse Avenue under gas mains and over water mains. The City Manager recommended that the Commission approve the order and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the order be approved and the motion was carried by the following Aye and I No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the meeting adjourn.
