HomeMy WebLinkAbout1960-11-16 :l11 Bozeman, Montana November 16, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, November 16 th, 1960 at 1:00 o'clock p.m. Present were Commissioner Staudaher presiding in the absence of Mayor Swanson as Acting Mayor, -I Commissioner Sedivy, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedi vy, seconded by Acting Mayor Staudaher, that the minutes be approved as read and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Commis- sioner Sedivy and Acting Mayor Staudaher; those voting No, none. S.I.D. No. 406 -- Overrun of Time Limitation, Liquidation ~amages and Excess Engineering Costs Harold Hoskins & Associates, the engineering firm retained by the City to perform the engineering work on S.I.D. No. 406, reported that the contractor, Stanley H. Arkwrigh t, Inc., not having completed the construction work within the time limitation as set forth in the contract, recommended that the contractor be assessed for excess engineering costs occasioned by the construction delay; but, that the remainder of the l~quidated damage provisions relating to overrun of the contract time be waived. The City Manager concurred in the recommendation of the engineer, and it was moved by I Commissioner Sedivy, seconded by Acting Mayor Staudaher, that the liquidated damage clause of the contract be waived except as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Acting Mayor Staudaher; those voting No, none. S.I.D. No. 410 -- Overrun of Time Limitation, Liquidation Damages and Excess Engineering Coata Harold Hoskins & Associates, the engineering frim retained by the City to perform the engineering work on S.I.D. No. 410, reported that the contractor, Stanle y H. Arkwright, Inc., not having completed the construction work within the time limitation as set forth in the contract, recommended that the contractor be assessed for excess engineering costs occasioned by the construction delay; but, that the remainder of the iiquidated damage provisions relating to overrun of the contract time be waived. The City Manager concurred in the recommendation of the engineer, and it was moved by Acting Mayor Staudaher, seconded by Commissioner Sedivy, that the liquidated damage , clause of the contract be waived except as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Staudaher and I Commissioner Sedivy; those voting No, none. S.r.D. No. 411 -- Overrun of Time Limitation, Liquidation Damages and Excess Engineering Costs Harold Hoskins & Associates, the engineering firm retained by the City to perform the engineering work on S.r.D. No. 411, reported that the contractor, Stanley H. Arkwright, Inc., not having completed the construction work within the time limitation as set forth in the contract, recommended that the contractor be assessed for excess engineering costs occasioned by the construction delay; but, that the remainder of the :~,12 liqUid'ated damage provisions relating to overrun of the contract time be waived. No. 416 -- Overrun of Time Limitation, Liquidation Damages and Excess Engineering Costs Harold Hoskins & Associates, the engineering firm retained by the City to perform the engineering work on S.I.D. No. 416, reported that the Contractor, Stanley H. I Arkwright, Inc., not having completed the construction work within the time lind ta tion as set forth in the contract, recommended that the contractor be assessed for excess engineering costs occasioned by the construction delay; but, that the remainder of the liquidated damage provisions relating to overrun of the contract time be waived. Indemni ty Bond -- Stanley H. Arkwright, Inc., S.I.D. No. 411 The indemnity bond of Stanley H. Arkwright, Inc. in the amount of $10,000.00 as placed before the Commission during its regular meeting, November 2, 1960, was again galled to" the a. tteil tiofl . of the 06mxniss ion. Acceptance of the bond was again deferred pending further negotiations between the contractor and claimant in the matter of settlement for gravel used in the construction. Electrical Contractor's License Bond -- Curley-Naylor Electric Co., BillilJis, Mon t . I The electrical contractor's license bond of Curley-Naylor Electric Co., Billings, Man tana, was presented. The bond was approved as to form by the City Attorney. It was moved by Acting Mayor Staudaher, seconded by Commissioner SediVY, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Acting Mayor Staudaher and Commissioner Sedivy; those voting No, none. ------------- : It:J Request -- Tag Day, Nov. 26th, Gallatin County Ass'n. for Retarded Children A reques t presented by the Galla tin County Associa tion for Retarded Children to stage its tag day sale on November 26th was placed before the Commission. It I was moved by Commissioner Sedivy, seconded by Acting Mayor Staudaher, tha t the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy and Acting Mayor Staudaherj those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Acting Mayor Staudaher, tha t the mee t- lng ad j ourn .
