November 23, 1960
The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, November 23, 1960 at 1:0u o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager
Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk.
The following proceedings were had: I
Minutes of the last reg1clar session were read and it was moved by C01'J11'nissioner
Sedi vy, seconded by Commissioner Staudaher, that the minutes be approved as read
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissloner Staudaherj those voting
No, none.
Purchase -- Garbage Disposal Unit (Truck)
This was the time and place set for opening bids for the purchase of a garbage
disposal uni t (truck). The affidavit of publication of the Call for Bids was pre-
sen ted. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
that the bids be opened and read and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and
Commissioner Sedivy; those voting No, none.
The following bids were opened and read:

At the request of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Staudaher, that to allow time for study of the specifications
of the various units, al terna tes, e tc. , final oonsideration of the bids be delayed
until the next regular meetinr, of the Commission to be held on November 30, 1960,
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those voting
No, none.
Indemnity Bond -- Stanley H. Arkwright, Inc.
The indemnity bond in the Amount of $10,000.00 presented to the City for
acceptance durlng the meeting of the Commission on November 2, 1960 as a guarantee
against non-payment of vendor claims on S.I.D. No. 411 was again placed before the
Commission. It was moved by Comwissioner Staudaher, seconded by Commissioner Sedivy,
that retained funds in the amount of ~~lO,OOO.OO be reduced to $3,000.00, that
$7,000.00 be released to the contractor, Stanley H. Arkwright, Inc., as of this
datej and, in the event no settlement is made between the contractor and the I
claimant on or before the 7th day of December, 1960, the CIty accept, subject to
the approval of the City Attorney, an indemnity bond in the amount of $3,000.00
and the remainder of retained funds be paid to the con trAc tor. The motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.

Investment of Permanent Care Funds of the Cemetery in Walk & Curb Warrants Issued
for the Year 1960
The City Manager requested that the Director of Finance be permitted to
invest $2,000.00 of Cemetery Permanent Care Funds in the City's issue of Walk &
Curb Warrants for the year 1960. The City Manager recommended the above investment
and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
I the investment be approved and the motion was carried by the following Aye and No
vo te : thos~ voting Aye being Mayor Swanson, Cownissioner Sedivy and Commissioner
Staudaher; those voting No, none.
Emergency Planning -- City Hall
The City Manager reported to the CorrJll1ission that a.LI departments of the City
have been coordinated in emergency planning to cope with any dis~ster that may
develop in the City as a result of severe earthquakes or other causes, and parti-
cularly in regard to extensive damage to the City Hall that might occur.

The City Manager reviewed the reports with the Commission and recommended
the reports be approved and filed. It was moved by Commissioner Staudaher, seconded
by Commissioner Sedivy, that the reports be approved and filed and the motion was

Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Report -- Legisla ti ve and Execu ti ve Commi ttee Meet:tng, Helena, Nov. 17th

The City Manager rendered an oral report on various phases of business
conducted at the Legislative and Executive Committee's meeting at Helena, November
17th, attended by the Manager and the Ass't. City Manager.
Report' -- Meeting of Middle Creek Water Users Association, Nov. 21st.
The City Manager gave a brief report on his attendance at the Middle Creek
Water Users Association meeting, November 21st.
Request -- Solicitation for 1fuscu1ar Dystrophy, Nov. 28th
A request received from the Order of the J:\.ainbow for Girls of the City
reouesting permission for the Rainbow Girls and the DeMolays to conduct a house to
house campaign for Muscular Dystrophy on Monday, November 28th, 1960 from 6 to 8
o'clock p.m. was placed before the CommiSSion. It was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the request be granted and the
motion was carried by the following Aye and No vote: those voting Aye being

Adjournment
There being no further mlsiness to come before the Commission at this time, it
was moved by Commissioner Sedivy, seconded by Comrnissioner Staudaher, that the meet-
ing adjourn. The motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those
