HomeMy WebLinkAbout1960-12-14 :J52 Bozeman, Montana December 14, 1960 The Commission of the City of Bo~eman met in regular session in the Commis~ sion Room, City Hall Building, Wednesday, December 14th, 1960 at 1:00 o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cu tting, Ass' t. Ci ty Manager Frys11e, C1 ty Attorney Lovelace and the Clerk. I The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, the t the minu tes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye be~ ing Mayor Swanson, Commissioner staudaher and Commissioner Sedivy; those voting No, none. Fina 1 Pa ymen t ~~ S.I.D. No. 411 - Stanley H. Arkwright, Inc. In accordance with previous action by the Commission in regard to the dispute between contractor Stanly H. Arkwrlght, Inc. and H. A. Bolinger, Jr. over the amount of and payment for gravel taken from the property of Mr. Bolinger and used in the const~lction of Special Improvement District No. 411, there was presented by the contractor an Indemnity Bond in the amount of $3,000 with a renewed request that this bond, approved by the Ci ty Attorney as to form, be accepted to permit the release and final payment of $3,000 that has continued to be retained on this con trac t. There was also presented, as requested by the Commission, a Ie tter from Mr. Bolinger stating the quantities of gravel alleged to have been taken from his I property, the unpaid balance alleged to be due in settlement for that gravel, and requesting that the City continue to withhold final payment to the contractor pending settlement of his claim. Following consideration of both the contractor's bond and Mr. Bolinger's Ie tter, and upon the recommenda tion of the Ci ty Attorney concurred in by the Manager, it was moved by COmJ'l1issioner Sedlv:~, seconded by Commissioner Staudaher, that the Indemnity Bond of Stanley H. Ar1{wright, Inc. be accepted contingent on provision being made for extension of the one year term of the bond upon request of the C t ty , and final payment be made to the contractor and the motion was carried by majority vote as follows: those voting 11~'e bein?: Mayor Swanson and Commissioner Sedivy; those votinG No, Commissioner Staudaher. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Swanson, Connnissioner Staudaher and Commissioner SedivYj those voting No, none. I Montana Municipal League -- Execu ti ve & Legisla ti ve Comml ttee Meeting, Helena, Dec. 15, 1960 The City Manager reported that a meeting of' the Executive and Legislative Committee of the Montana Municipal League is scheduLed to be held in Helena, Dec. 15 th, 1960, and recommended that the Mayor, other members of the Commission, and the City Manager be authorized to attend the meeting. It was moved by Commissioner Sedi vy , seconded by Commissioner Staudaher, tha t, it being in the public interest, the aforementioned persons be authorized to attend the meeting and the necessary travel expenses be paid out of the General fund. The motion was carried by the fol1owlng Aye and No vo te : those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those voting No, none. Appoin tmen t -- C. E. Stevenson, Police Commissioner The City Manager reported to the Commission that tho term of C. E. Stevenson as a member of the Police Commission had expired. Mayor Swanson announced his re- appointment of ~r. Stevenson for a three year term retroact:Lve to rllay 1, 1960. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, tha t the re- I appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor, Commissloner Staudaher and Commissioner Sedivyj those votinr; No, none. ,,' Recess for Members of the Commission to Attend tbe Meeting of the Bozeman Cemetery Board Mayor Swanson called a recess of the meeting to allow members of the Commission the opportuni t~T to a ttend the meeting of the Bozeman Cemetery Board for a discnssion of the ~lture need for additional land for the Cemetery. Commission Meeting Re-Convened The me~ting was re-convened and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the meeting adjourn.
