The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, October 5th, 1960 at 1:00 o'clock p.m. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
I Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk.
The following proceedings were had:
I Minutes of the last regular session were read and it was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Bids for S.I.D. No. 418
This was the time and place set for opening bids for construction of drainage and
paving improvements in Special Improvement District No. 418. Affidavit of publication
of "Notice to Bidders" was presented. Seven sealed bids on this project were on file.
Upon the recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Staudaher, that the bids be opened and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner Staudaherj those voting No, none.

As recommended by the City Manager, it was moved by Commissioner Staudaher, sec-
onded by Commissioner Sedivy, that the bids be referred to T. H. Thomas and Wayne W.
Dean, the engineers representing Harold Hoskins & Associates, the engineering con-
sultant firm retained by the City for this district, to check ~he bids in detail, pre-
pare a final tabulation and ascertain the lowest and best bid for the construction of
the improvement. The motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting
No, none.
Purchase of Wheeled Front End Loader
This was tne time and place set for opening bids for the purchase of a Wheeled
Front End Loader for use by the Street Department. The affidavit of publication of
I the "Call for Bids" was presented. It was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, the the bids be opened and read and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner Staudaher; those voting No, none.

At the request of the City Manager, it was moved by Commissioner Staudaher, sec-
onded by Commissioner Sedivy, that to allow time for study of the specifications of the
various units, alternates, etc., final awarding of the contract be delayed until I
the next regular meeting of the Commission, October 13th, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher, and Commissioner Sedivy; those voting No, none.
Bidders were informed that each firm would be furnished with a full tabulation
of all bids submitted.
Request -- Construct Addi tion at Parkway Grocery "Lots 11-14, Blk 51, West Park"
A request was presented to the Commission for permission to construct an
addition to be used for storage facilities at the Parkway Grocer, situated on
Lots 11-14, Block 51, West Park Addition. Action on the matter was tabled until .....
the next regular meeting on October 13th to permit a proper presentation to the
CommiSSion.
Purchase of i ton, 4 x 4 Truck
This was the time and place set for opening bids for the purchase of a
fitton, 4 x 4 truck" for uae by the Street Department. The affidavit of publication
of the "Call for Bids" was presented. It was moved by Commissioner Sedivy, I
seconded by Commissioner Staudaher, that the bids be opened and read and the
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.

Resolution No. 994 -- Bringln Area West of Bozeman into the City
As directed by Commission action during its regular session, September 21,
196u, the City Attorney has prepared proposed Commission Resolution No. 994 to
bring an area west of Bozeman into the City. I
Resolution No. 994 was presented, entitled:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO
BE THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF
AND OF THE INHABITANTS OF TRACTS OF LAND CONTIGUOUS TO THE SAID CITY OF
BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES
OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS
WITHIN THE CORPORATE LIMITS THEREOF

The City Manager recommended that the Commission proceed to complete the action
incorporated 1n the resolution. It was moved by Commissioner Sedivy, seconded by
Commissioner Staudaner, that the resolution be regularly passed and adopted and
November 2, 1960 be set as the date for public hearing on the issue and the motion was
carried by the fo~lowing Aye and No vote: those voting Aye being Mayor Swanson,
I Commissioner Sedivy and Commissioner staudaher; those voting No, none.
Request -- Taxi Stand a t Baxter Hotel
Frs. Fred Skoog, operator of the City Taxi Service, appeared before the Commis-
slon to request permission to establish a one-stall taxi stand 1n front of the Baxter
Hotel, and permission was granted on a tentative basis.
Request -- MSC Homecoming Parade
A request from the students of Montana State College to stage its homecoming
parade on Main Street, October 14th at lU:UO A.M., was presented. It was moved by
Commissioner Staudaher, seconded by Commissioner Sedivy, tnat the request be granted
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner staudaner and commissioner Sedivy; those voting
No, none.
Examination of Depository Bonds
The Commission prooeeded to examine the Custodian's Receipts for Depository
Bonds held by the Director of Finance as security for City funds deposited 1n
Bozeman banks. It was moved by Commissioner Sedivy, seconded by Commissioner
I Staudaher, that the securities be approved and a list thereof be set forth in full
in the minutes of this meeting and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No, none.

Resignation of W. R. Border as Superintendent of Water Department
A letter from W. R. Border addressed to tne City Manager announcing his
resignation as Superintendent of tne Water Department and retirement effective
October 1st was read. 'l'he Manager stated the he regreted the necessity for Mr.
Border's action, but in view of his long period of devouted service it was desireable
to accept his resignation and permit his well earned retirement. It was moved by
Comm.issioner Staudaher, seconded by Commissioner Sedivy, that the acceptance of Mr.
Border's resignation be approved and the Manager be directed to write a letter
expressing the City's appreciation of Mr. Border's many years of outstanding servioe
to the City, and the motion was carried by the fOilowing Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.

The City Manager announced the appointment of Ralph Dunahoo as acting Water
Superintendent effective October 1st. It was moved by Commissioner Staudaher, sec-

Commissioner Staudaher and Commissioner Sedivy; those voting No, none.

The Manager stated he had aud1 tad the olaims and found them to be true and
lawful claims against the City of Bozeman and recommended warrants be issued for I
payment. After examination of the claims 1n detail and cheoking against the claim
regis ter, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
that the claims be approved and warrants issued for payment and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner staudaher and Commissioner sediVY; those voting No, none.

The Manager reviewed the reports With the Commission and reoommended the reports

Sedivy and Commissioner Staudaher; those voting No, none.

S. I. D. No. 418 -- Award of Contract
As direoted, Mr. Thomas and Mr. Dean cheoked the extension of all bids sub-
mitted, prepared the final tabulation and recommended that Kiely Construction Co.,
Bu.tte, Montana, be awarded the oontraot for the construction of the improvement in
Special Improvement District No. 418, the firm's bid in the amount of $206,584.25
being the lowest qualified bid received. The City Manager concurred in the reCom-
mendation and it was moved by Commissioner Staudaner, seconded by Commissioner Sedivy,
that subject to the sale of the bonds of the district, the bid of Kiely Construotion
Company in the amount of $206,584.25, it being the lowest bid submitted, be awarded
the contract and the motion was oarried by the following Aye and No vote: those
voting Aye being Mayor SWanson, Commissioner Staudaner and Commissioner Sedivy; those
voting No, none.

There being no further business to come before the Commission at this t~e,
