The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, April 27, 1960 at 1:00 o'Clock
P.M. Present were Mayor Swanson, Commissioner Staudaher, Commissioner
SediVY, City Manager Cutting, City Attorney Lovelace and the Clerk. The I
following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
Minutes of the Special Session held April 26th, 1960 were read and it
was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the
minutes be approved as read and the motion was oarried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and
Commissioner Staudaher; those voting No, none.
Purchase of Power Lawn Mower
This was the time and plaoe set for opening bids on the purchase of a
power lawn mower for the Cemetery Department. The affidavit of publication
of the Notice to Bidders was presented. It was moved by Commissioner Sedivy, I
seconded by Commissioner Staudaher, that the bids be opened and read and the
motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.

City Manager Cutting suggested that the bids be tabulated and-"the puI'chase

of the mower be disoussed with Park and Cemetery Supt. Cloninger. Upon recom--
mendation of Mr. Cloninger, concurred in by the City Manager that the City
accept the bid of Brown's Hardware for the Toro Professional Model #O6l92 as
being the lowest and best bid, it was moved by Commissioner Sedivy, seconded
by Commissioner Staudaher, that the bid of Brown'. Hardware be accepted as
recommended and the motion was carried by the following Aye and No vote:

Miscellaneous Walks & Curbs 1960 -- Order to Repair or Construct New Walk
The City Engineer, under provisions and authority of Sections 11-967
and 11-2226 R.C.M. 1947, and Ordinance No. 561 of the City of Bozeman, re-
lating to construction of Walks and Curbs without formation of a SpeCial
Improvement District, submitted his report for 196U of inspection of walks

and curbs in the City and his reoommendations in detail with reference to needed
repairs and new installations. The City Manager s te. ted too t he has checked the
report and made personal inspection as to the repairs and installations thereby
recommended and recommends adoption of the report as made, and that the Clerk of
the Commission be authorized to advertise for bids for this work. The City Manager
. further stated that, from time to time during the period above specified, add-
itionaL walks and curbs which require repair or new installation may be discovered
which should be repaired or installed and should be added to the aforementioned
reports as so discovered.
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
that the report of the City Engineer as to the repair and installation of M1sc.
Walk & Curb for 1960 including those walks and curbs now or hereafter deter-
mined to require repair or new installation be and the same is hereby accepted,
approved, adopted, ordered filed and that the Clerk of the Commission be author-
ized to advertise for bids for this work. Said adopted report of the City
Engineer is hereby referred to and made a part of this minute entry by such
adoption and reference for the purpose of designating and identifying the
streets and aVenues on which suoh new installations or repairs are to be made
and such new installation or repairs are hereby ordered to be made under and
pursuant to the provisions of Section 1l-967 and 11-2226 R.C.M. 1947, and Ordln-
I ance No. 561 of the City of Bozeman and the City Manager is hereby instructed to
give, or cause to be given, to each owner or agent of such owner, or either, of
the property along which such new installation or repair 1s to be made, written
or printed notioe of suCh order, as required by the provisions of said Seotion
11-2226 R.C.M. 1947, and of Ordinance No. 561 of the City of Bozeman and suoh new
installations or repairs are hereby ordered to be made within thirty days from
the date of such notice, and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sioner Sedivy; those voting No, none.
Purchase of Water Meters
City Manager Cutting reported that there exists a need in the Water
Department for the purchase of twenty-five - 3/4" water meters at the approx-
imate total cost of $650.UU. It was moved by Commissioner Sedivy, seconded by
CommisSioner Staudaher, that the Manager be authorized to oomplete the purchase
and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those
,. voting No, none.
Authority to Travel -- Attorney General's Law Enforcement Conference
Notice has been received that the Attorney ueneral's Law Enforcement Con-
ference will be held at Helena, Montana, May 5-6, 196u. Chief of Police Saunders
has requested that he be authorized to attend this meeting, and the City Manager
concurred in this request. It was moved by Commissioner Staudaher, seconded by
Commissioner Sedivy, tha t, it being in the public interest, Mr. Saunders be
authorized to attend this Conferenoe and that his expense inourred by suoh

attendance be paid trom the General Fund and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaner
and Commissioner Sedivy; those voting No, none.
Petition -- Close Lincoln Street
The petition tiled by abutting property owners to close Linooln Street I
between Grand Avenue and Fifth Avenue was again brought to the attention of the
Commission. City Attorney Lovelace rendered an opinion recommending that be-
fore action is taken on the matter by the Commission, the Ci ty should first
review an Agreement entered into between Thompson Hereford Ranohes, Ino., and
the City of Bozeman whereby Thompson Hereford Ranohes, Inc. covenants and agrees
to move the poles supporting a power line oft the right-of-way ot the Montana
Power Company in the event the City desires to improve that portion of Lincoln
Street now in question. The Commission requested the City Manager and the City
Attorney to confer with the officers of Thompson Hereford Ranches, Ino. and other
owner's involved on the matter.
Marine Day -- Bozeman Boat Club Parade on Main Street, May 14, 1960
A request from the Bozeman Boat Club for permission to stage a parade on
Main Street at 2 :00 o'clock p.m., Saturday, May 14th was presented. It was
moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that, subject
to an adjustment of the time in the event another request is reoeived to stage
a parade on the same date, the permission be granted as requested and the motion I
was oarried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Ordinance No. 822 -- Control of Dogs and Other Animals
The City Attorney, as instructed, has prepared an ordinance, Ordinance
No. 822 for the Control of Dogs and other Animals. Ordinance No. 822 was
presented, entitled:

It was moved by Commissioner SediVY, seconded by Commissioner Staudaher,
that the ordinance be passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commis- I
sioner Sedivy and Commissioner Staudaherj those voting No, none.
Sohool Crossings -- "Sohool Boy Patrol"
Mr. Barnard, a member of the Safety Committee of the PTA Bozeman Central
Council, appeared before the Commission to request that the City make a study
of its entering into a proposed program with the Bozeman City Schools to form
a "Sohool Boy Patrol" for the protection of children at school crossings in the

vicinity of the Willson Junior High, Rosary, and Emerson schools. The Commis-
sion discussed the program at length with Mr. Barnard and requested that its
action on the matter be delayed to give the City Attorney ample time to study the
legal aspects of the matter.
I Special Meeting -- Proposed New Zoning Ordinance
Mayor Swanson announced that a Special Meeting of the City Commission w111
be held at the regular meeting place Tuesday, May 3rd, at 7:00 o'clock p.m. for
the purpose of further action on the new Zoning Ordinance.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the meeting adjourn and the motion was carried by the following Aye and No vote:
