The Commission of the City of Bozeman met in regular session in the Commis-
I slon Room, City Hall Building, Wednesday, May 4, 1960 at 1:00 p.m. Present were
Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
.. Assft. Manager Frysiie, City Attorney Lovelace and the Clerk. The following
proceedings were had:
Minutes of the last regular session were read and it was moved by Comm.is-
sionerStaudaher, seconded by Commissioner Sedivy, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
Minutes of the Speoial Bession held May 3rd, 1960 were read and it was
moved by Commissioner Sedivy, seoonded by Commissioner Staudaher, that the min-
utes be approved as read and the motion was carried by the following Aye and No
vo te : those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No, none.
Ordinance No. 818 -- Zoning
Ordinanoe No. 818 was presented, entitled:
I ORDINANCi: NO. 818
AN ORDINANCE CLASSIFYING, REGULATING AND RESTRICTING THE USE OF LAND AND
THE USE AND LOCATION OF BUILDINGS AND STRUCTURES; REGULATING AND LIMITING
THE HEIGHT AND FLOOR AREA OF BUILDINGS AND STRUCTURES AND REGULATING AND
DETERMINING THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND
SURROUNDING ALL SUCH BUILDINGS AND STRUCTURES; REGULATING THE SIZE AND
LIMITING THE INTENSITY OF USE OF LOT AREAS; DIVIDING THE CITY OF BOZEMAN
INTO ZONES AND ESTABLISHING THE BOUNDARIES AND CLASSIFICATION THEREOF BY
THE ADOPTION OF A ZONING MAP; CREATING AND ESTABLISHING TRANSITION ZONING
AREAS AND FRINGE ZONING AREAS AND THE USE AND CONSTRUCTION RESTRICTIONS
THEREIN; REQUIRING OFF STREET PARKING; REGULATING THE PARKING AND STORAGE
OF MOBILE HOMES AND TRAILERS; PRESCRIBING PENALTIES FOR THE VIOLATION OF
ITS PROVISIONS; CREATING AND ESTABLISHING THE BOARD OF ADJUSTMENT AND PRO-
VIDING FOR ITS MEMBERSHIP, MEETINGS AND PROCEDURES AND FOR APPEALS THERETO;
AND REPEALING ORDINANCE NUMBER 776 AND ORDINANCES NUMBERS 787, 792 AND
813 AMENDATORY THEREOF.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,
that the ordinanoe be passed and adopted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy
and Commissioner Staudaher; those voting No, none.
Investment of Cemetery Permanent Care Funds
The City Manager reported that the Director of Finance has requested to
I invest $10,000.00 of Cemetery Permanent Care funds in Speoial Improvement Dist-
rict Bonds or the City or Bozeman. Upon the recommendation of the Manager, it
was moved by Commissioner Staudaher, seconded by commissioner SediVY, tha t the
request be granted and the motion was carried by the following Aye and No vote:

Bids for Truck -- Street Department
Need exits for a new, 2 ton, dump truck at an approximate cost of $3,500.UO
for the Street Department. It was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, that when the specifications for this unit are prepared
the Clerk advertise for bids and the motion was oarried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and I
Commissioner Staudaher; those voting No, none.
Purchase of Polioe Car for Engineer's Office
Proposed lease or purchase of a 1959 Chevrolet station wagon now being
turned back to the dealer after approximately one year of use by the Police
Department was discussed. It was recommended by the City Manager that the city
lease from the Northern Automobile Company the Chevrolet used station wagon
described above at a rental of $175.00 per moneth under an agreement whereby the
City may purchase this vehicle for a total price of $2,200.00 with any and all
rental which the City may have paid between this date and the date of purchase
to be applied on such purchase price. It was moved by Commissioner Sedivy,
seconded by Commissioner Staudaher, that the City enter into this agreement as
recommended and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudah8r;
those voting No, none.

Upon the recommendation of the City Manager, it was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the reports be approved and filed
and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none.
Claims for the Month of April, 1960
Claim No's. 7960 to 8228 inclusive were presented on the various funds
as follows:

The Manager stated that he has audited these claims and finds them to be
true and lawful claims against the City of Bozeman and recommends that warrants
be issued for their payment. After examination of the claims in detail and
checking against the claim register, it was moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the claims be approved and warrants issued
for the payment and the motion was carried by the following Aye and No, vote:

Resignation of Roy Smart as City Building Inspector
A letter reoeived from G. L. (Roy) Smart announcing his resignation from
I the position of Building Inspector for the City of Bozeman to accept employment in
a similar capacity at Porterville, California and requesting his release on or
before June 15, 1960 was read. The City Manager informed the Commission that in
view of the outstanding manner in which Mr. Smart carried out the duties of his
office, his resignation had been aocepted with extreme regret, and only because
circumstances presented no alternative.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the acceptance of Mr. Smart's resignation be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis-
sioner Sedivy and Commissioner Staudaher; those voting No, none.
Military Leave -- City Manager
The City Manager informed the Commission that as a member of the Ready
Reserve of the Armed Forces he has been ordered to 15 days of active duty for
training from May 7-21, 1960, at Portland, Uregon, and requested that military
leave permitting his oompliance with these orders be approved.
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that

sioner Sedivy; those voting No, none.
Acting City Manager -- Harold Fryslle, May 7th to 21st.
The City Manager requested that in his absence from May 7 to 2i, 1960,
Harold A. Fryslie, his Assistant, be designated Acting City Manager, It was
moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the request
be granted and the motion was carried by the follOWing Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
Gallatin Airport -- Publicity for Bond Issue
Mr. Paul Busch appeared before the Commission to present an informational
tract prepared by the Gallatin Airport Committee to be placed before the voting
public relative to various aspects of the contemplated bond issue for the re-
- construction of runways and facilities at the Gallatin Airport. Mr. Busch stated
that the Gallatin Airport Board requests the approvaL of the City of Bozeman to
I present the information as outlined. It was moved by Commissioner Sedivy, sec-
onded by Commissioner Staudaher, that the City approve the request and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Adj ournment
There being no~urther business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commissioner Staudahe~ that the
meeting adjourn and the motion was oarried by the following Aye and No vote:
