The Commission of the City of Bozeman met in regular session in the
Commission Room, City Hall Building, Wednesday, May 18, 1960 at 1:00 o'clock
I p.m. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy,
Acting City Manager Fryslie, City Attorney Lovelace and the Clerk. The follow-
ing proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Sedivy, seconded by Commissioner Staudaher, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissloner Sedivy and Commissioner Staudah8r;
those voting No, none.
Request to Defer Repair of Sidewalk Granted -- Methodist Church
Mr. Ray B. Haight, a member of the board of trustees of the First Methodist
Church, appeared before the Commission and requested a year's extension of the
City's order directing the church to repair the sidewalk south of the church on
Olive Street. Acting City Manager Fryslie informed the Commission that he and
the City Engineer did not consider the present condi tion of the walk to be of a
hazardous nature. and building plans of the Church for the future indicatedthe
extension should be granted. The Commission in turn assured Mr. Haight the re-
I quest would be granted.
Claim -- F. L. Dye Co. -- Swimming Pool Contract
A claim in the amount of $7,150.50 of F. L. Dye Co. for work completed on
the swimming pool boiler and boiler room as of April 30th, 1960 was presented.
This claim was supported by a "certifioate of payment/statement of account"
prepared by Oswald Berg, Jr., representing R. L. Prussing Engineers retained by
the City as architeot and engineer on the project. Upon the recommendation of
the Acting City Manager, it was moved by Commissioner Staudaher, seconded by
Commissioner Sedivy, that the olaim be approved and a warrant issued for payment,
and the motion was oarried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting
No, none.
Resolution No. 974 -- Intention to Create SID No. 417
The City Attorney, as instructed, has prepared a resolution of intention to
create a special improvement district for drainage and paving a portion of the
streets in Royal Vista, Special Improvement District No. 417. Resolution No. 974
I was presented, entitled:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZE-
MAN DECLARING 'If TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREATE A SPECIAL DIPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 417 OF THE
CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND
INSTALLING A PAVEMENT PROJECT ON WEST BIRCH STREET FROM
NORTH SEVENTH AVENUE TO NORTH EIGHTH AVENUE AND ON
NORTH EIGHTY A VENUE FROM THE SOUTH LINE OF ROYAL VISTA
ADDITION TO THE WEST LINES OF LOT SIXTEEN, BLOCK ONE,

AND LOT SIX, BLOCK THREE, OF ROYAL VISTA ADDITION, TO
BOZEMAN, MONTANA, AND ROYAL COURT IN SAID ROYAL VISTA
ADDITION, SAID PAVEMENT PROJECT TO INCLUDE CONSTRUC-
TION AND INSTALLATION OF A STORM SEWER LINE, COMBINA-
TION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE,
CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE
COURSE AND OTHER WORK INCIDENTAL THERETO
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, I
that the resolution be passed and adopted and June 8th, 1960 be set as the date
for public hearing and the motion was carried by the fOllOWing Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
Resolution No. 975 -- Intention to Vacate Portions of E. Cleveland St. and
Highland Ave. in Prospect Hill Add.
As directed, the City Attorney has prepared a resolution of intention
to vacate a portion of east Cleveland Street and a portion of Highland Avenue
in Prospect Hill Addition. Resolution No. 975 was presented, entitled:

A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE
PORTIONS OF STREETS IN PROSPECT HILL ADDITION TO THE CITY OF
BOZEMAN, MONTANA
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,
that the resolution be adopted and June 8th, 1960 set as the date for public
hearing, subject to payment of costs by Bozeman Deaconess Hospital, Inc., and I
the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those ..
voting No, none.
Reports
The following reports were placed before the Oommission:
Director of Finance Cemetery
Director of Public Works Police Judge
The Commission and the Acting City Manager reviewed the reports, and, upon
recommendation of the Acting City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Staudaher, that the reports be approved and filed and
the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor SWanson, Oommissioner Sedivy and Comm1ssioner Staudaher; those voting
No, none.
Request -- Mobile Nuclear Display
It was reported that the Bozeman Jaycees have requested permission to park
a Mobile Nuclear Display on Main Street. It was moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the City grant permission for the date of I
May 24th, between the hours of 9:00 A.M. and 5:00 P.M., and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Ordinance No. 822
Glen Harrington presented the Clerk with a petition relating to Ordinance
No. 822 passed and adopted by the Commission on April 27, 1960. Following brief
discussion and comment by the Oity Attorney, Mr. Harrington withdrew his petition.

Adjournment
There being no further business to come before the Commis~ion at this
time, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
