Bozeman, Montana June 8, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, June 8, 1960 at 1:00 o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, City Manager Cutting, Ass't. Manager I Fryslie and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commis- sioner Staudaher, seconded by Mayor Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Staudaher and Mayor Swanson; those voting No, none. Public Hearing -- S.I.D. No. 417 -- Resolution No. 974 This was the time and place set in Commission Resolution No. 974 to hear pro- tests to the creation of Special Improvement District No. 417, for drainage and paving a portion of the streets in Royal Vista Addition to Bozeman, Montana, and Royal Court in said Royal Vista Addition. Affidavit of publication of Notice was presented together with the Clerk's Mailing Certificate stating that all property owners were notified. No one was present to protest the creation of the afore- mentioned district; however, the City Manager informed the City Commission that a written protest to the action was on file bearing the signatures of 44.15% of the land owners within the boundaries of the District. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the I protests be sustained as sufficient and that further proceedings to create the dist- rict cease and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Public Hearing -- Resolution No. 975 This was the time and place set for hearing protests to vacating portions of streets in Prospect Hill Addition to the City of Bozeman, Montana, as set forth in Resolution No. 975, passed and adopted by the City Commission on May 18, 1960. Affidavit of Publication of Notice was presented together with the Clerk's return of service of notice. No one appeared to protest, and no protests having been filed, it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the City Attorney be directed to prepare an ordinance vacating portions of the streets as set forth in the aforementioned Resolution No. 975, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commis- sioner Staudaher; those voting No, none. Ordinance No. 823 -- Vacating I The City Attorney, as instructed, has prepared an ordinance vacating portions of Prospect Hill Addition to the City of Bozeman. Ordinance No. 823 was presented, n entitled: ORDINANCE NO. 823 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, VACA TING PORTIONS OF STREETS IN PROSPECT HILL ADDITION TO THE CITY OF BOZEMAN, MONTANA 2r;6 'tJ It was moved by Mayor SwansOn, seconded by Commissioner Staudaher, tha t the ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Request -- Jaycees to Sponsor Carnival A letter from the Bozeman Junior Chamber of Commerce was read requesting I~ approval of its sponsorship of a carnival to be in Bozeman on June 2ist to 25th, and, also, requesting that the established license fee of $lOv.OO per day be reduced to $50.00 per day. It was moved by Commissioner staudaher, seconded by Mayor Swanson, that hold- ing of the carnival as requested be approved with no reduction of the license fee established at $100.00 per day, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Petitions -- Create Special Improvement District "Area crt ( Part) Petitions filed requesting the City to create a Special Improvement District to prOVide for drainage and paving streets in a part of "Area C" were presented to the Commission. The Commission, the City Manager and the City Engineer discussed the matter in detail and action was deferred until the next regular meeting of the Commission, June 15, 1960. ' S 10,304.29 Total $118,184.46 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination 0 f the claims in detail and checking against the claim register, it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the claims be approved and warrants issued for payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. I Reports The following reports were presented: Water Collector Cemetery Fluoridation Police Judge Building InSP. Contract on Swimming Pool Boiler & Alternates ~- Change Order No.3 Change Order No.3 to plans and specifications incorporated in the contract awarded F. L. Dye Co. for the restoration of the Swimming Pool Boiler Room and I Alternates was presented providing for the replacement of an addition 4' of roof and 4' of bracing at an increase in cost of $465.00. The City Manager stated he is neg- otiatin~ with the insurance company on the matter of the additional loss and reco- mmended tha t the change order be approved,. It was moved by Mayor Swanson, seconded Staudaher, that the Change Order be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. State Gasoline Tax Refund Claim A claim for refund of State Gasoline Tax for gasoline used by the City in the amount of $1,081.00 was presented. The City Manager requested that he be authorized to sign the claim in behalf of the City, and it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the authorization be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Bond & Contract - Monarch Lbr. Co. -- W & C 1960 Performance bond and contract documents for the contract of Monarch Lumber Co. -I awarded on May 25, 1960 for the construction of miscellaneous walks and curbs with- in the City of Bozeman were presented. The bond and contract were approved as to form by the City Attorney. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the performance bond and contract be accepted and approved, the Mayor and Clerk of the Commission authorized to sign the contract for the City and, following complete execution of the documents, the bid security submitted with the bid be returned to the contractor and the motion was carried by the fol10wing Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Special Improvement Funds -- Reinvestment Director of Finance L. G. Shadoan reported that $100,000.00 of Special Improve- ment Funds now invested in U. S.Treasury Bills mature June 16th, 1960 and re- quested authorization to reinvest the funds in like securities for an additional mon th . Following the recommendation of the City Manager, it was moved by Mayor Swanson, seconded by vommissioner Staudaher, tha t the reques t be granted and the I motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Payment for S. I. D. No. 408 Estimate claim of Haggerty-Messmer Company for work performed under the drain- age contract for Special Improvement District No. 408 was presented in the amount of $4,299.70. The City Manager explained that all work had been completed on this con- tract with the exception of adjusting manhole covers and other incidentalS, which items could not be completed until street paving under another contract was placed, 2~8 ,j...... and that his claim in the amount indicated provided for a partial release of re- tained percentage of f.unds due the contractor. Since it will be several months before this contract can be finally completed and upon recommenda tion a f the City Manager, it was moved by Ma yor Swanson, seconded by Commissioner Staudaher, that the claim be approved and a warrant issued for its payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson I and Commissioner Staudaher; those voting No, none. Payment for S. I. D. No. 409 Estimate claim of Haggerty-Messmer Company for work performed under the drainage contract for special Improvement District No. 409 was presented in the amount of $2,349.73. The City Manager explained that all work had been completed on this contract with the exception of adjusting manhole covers and other in- cidentals, which items could not be completed until street paving under another contract was placed, and that this claim in the amount indicated provided for a partial release of retained percentage of~unds due the contractor. S. I. D. No. 411 -- Payment of Estimate No.1 Progress Estimate No. 1 and claim for construction work performed by I Stanley H. Arkwright, Inc. under contract for special Improvement District No. 411 as prepared by Harold Hoskins and Associates, consultant engineers, was presented in the amount of $2,756.34. Upon recommendation of the City Manager, it was moved by Commissioner Staudaher, seconded by Mayor Swanson, tha t the claim be approved and a warrant issued for its payment and the motion was carried by the following Aye and No vote: those v oting Aye being Mayor Swanson and Commis- sioner Staudaher; those voting No, none. Sign Ordinance -- Preliminary Draft A preliminary draft of a proposed new Sign Ordinance prepared by the City Building Inspector was presented. Following a general discussion by the Commis- sion, the City Attorney was instructed to prepare this ordinance in final form for presentation and action by the Commission at its next regular meeting. Emergency Appropriation -- Park Fund The City Manager reported that due to the cost of rebuilding the fire damaged boiler room and replacement of equipment at the City Swimming Pool, it I is anticipated expenditures budgeted for the Park Fund wiLL be exceeded b,. June 30th. The City Attorney was, therefore, instructed to prepare for action at the next regular meeting of the Commission an Emergency Appropriation Ord- inance authorizing the expenditure of $13,794.74 that has been paid into the Park Fund and is unappropriated by Ordinance No. 815. . ')~~9.. ~""'-)' Building Inspector -- Appointment of Donald H. Barrick The City Manager announced the appointment of Donald H. Barrick of 502 w. Babcock Street as Building Inspector to fill the vacancy of C. L. (Roy) Smart, resigned. I Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the meet- ing adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none.
