HomeMy WebLinkAbout1960-06-15 2tiO Bozeman, Montana June 15, 1960 The Commission of the City of Bozeman met in regular session in the Commis- sion Room, City Hall Building, Wednesday, June 15, 1960 at 1:00 o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, City Manager Cutting, City Attorney Lovelace and the Clerk. I Minutes of the last regular session were read and it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Agreement -- Occupancy to Portion of Lincoln Road, Thomas Donald Norman, etel and the City of Bozeman Pursuant to the provisions of Section 11-3312, R.C.M. 1947, an agreement, prepared by the City Attorney, whereby for certain covenants given ~y Thomas Donald Norman, etal, the parties of the First Part, t-~? Ci ty agrees to close West Lincoln Road from South Grand Avenue to South Fifth Avenue to publiC use, was placed before the Commission. The City Manager recommended that the City approve this agreement, and it was moved by Commissioner ~taudaher, seconded by Mayor Swanson, that the City enter into the agreement and the Mayor and the Clerk of the Commission be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Resolution No. 977 -- Provisional Passage -- Occupancy to a Portion of West I Lincoln Street Resolution No. 977, placed on file as of this date, granting occupancy to certain property owners to a portion of the dedicated lands of Lincoln Street was placed before the Commission, en ti tIed: COW~ISSION RESOLUTION NO. 977 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, GRANTING CERTAIN PROPERTY OWNERS THE RIGHT TO occrrPY AND USE ALL OF THE DEDICATED AREA OF LINCOLN ROAD BETWEEN THE WEST LINE OF SOUTH GRAND A VENUE AND THE EAST LINE OF SOUTH THIRD A VENUE TN THE CITY OF BOZEMAN, MONTANA The City Attorney stated that the resolution was complete as to form in which it is to be pres9nted for final passage. It was moved by Mayor Swanson, seconded by Commissioner ~taudaher, that the Commission provisionally pass the Resolution, that the said Resolution is to remain on file with the Commission for inspection by the public for at least a period of one week before again being placed before the Commission for final adoption or passage as provided by Section 11-3312, R.C.M., and the motion was carried by the following Aye and I No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Resolution No. 976 -- Intention to Create SIn No. 418, "Area e" ( Par t ) Petitions having been filed requesting the Commission to create a Spec- ial Improvement District for drainage and street improvements in a portion of "Area C" in Bozeman, the City Attorney, as instructed, has prepared a resolution of intention to create Special Improvement District No. 418. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the resolution be passed and adopted and July 6, 196u be set as I the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Ordinance No. 824 -- Sign As instructed, the City Attorney has prepared Ordinance No. 824 to be known as the "Sign Code." Ordinance No. 824 was presented, entitled: ORDINANCE NO. 824 - AN ORDINANCE PROVIDING FOR Tfill ERECTION OF OUTDOOR ADVERTISING SIGNS AND BILL BOARDS FOR THE PROTECTION OF LIFE Al'ID PROPERTY AND THE GENERAL WELFARE OF THE PEOPLE; FOR THE PUBLI- CATION OF SAME AND PROVIDING FOR PEm~ITS AND r~ES FOR PERMITS, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE NUMBERED 786 OF THE CITY OF BOZEMAN It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. ..' .. Resolution No. 978 -- Emergency Appropriation, Park Dept. $13,794.74 As instructed, the City Attorney has prepared Resolution No. 978 to authorize the expenditure of $13,794.74 that has been paid into the Park Fund and unappro- priated by Ordinance No. 815. Resolution No. 978 was presented, entitled: COMMISSION RESOLUTION NO. 978 A RESOLUTION OF THE CITY COM~'ISSION OF THE CITY OF BOZEMAN DECLARING A PUBLIC EMERGENCY CAUSED BY A FIRE AT THE CITY OF BOZEMAN MUNICIPAL SWIMMING POOL WHICH PARTIALLY DESTROYED THE HEATING PLANT BUILDING, BOILER .. 252 AND CONTROLS, THE ESTIMATED AMOUNT OF MONEY REQUIRED TO MEET SUCH EMERGENCY AND THE FUND AGAINST WHICH EMERGENCY WARRANTS SHOULD BE DRAWN FOR THE PAYMENT OF SUCH EXPENSES It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the resolution be provisionally adopted, June 29, 1960 set as the date for hear- ing and final passage, that the resolution and Notice of Hearing be published I as required by Section 11-1409, R.C.M. 1947, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Reports The following reports were presented: Director of Public Works Director of Finance Sani tarian The City Manager reviewed the report of the Director of Fanance and stated that financial operations of the City appear to be normal for the eleven-month period of the budget year, and recommended the reports be approved. It was moved by Mayor Swanson, seconded by Commissioner staudaher, that the reports be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Hustad (Buttrey's) Center Following a brief discussion of plans for the construction of the Hustad (Buttrey's) Center west of Fifteenth Avenue on West Main Street (extended), I the proposed general layout for their water system was tentatively approved. However, no authority was granted for connection to City water mains pending a continued study of bringing this and possibly other areas into the City. Report -- State Fire Chief's Convention Fire Chief Penttila was present and presented a brief review of the pro- ceedings of the state Fire Chief's Conference held in Helena.
