PSA with MAKERS for UDC Update Commission Memorandum REPORT TO: Mayor and City Commission FROM: Tom Rogers, Senior Planner Martin Matsen, Director of Community Development SUBJECT: Unified Development Code (UDC) update, Chapter 38, First Amendment to Professional Service Agreement with MAKERS Architecture and Urban Design. MEETING DATE: March 27, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve and authorize the City Manager to sign the First Amendment to the Professional Services Agreement with MAKERS Architecture & Urban Design to perform the evaluation and revisions to Chapter 38, UDC. BACKGROUND: On January 25 and February 1, 2015 the City of Bozeman Published a Request for Qualifications (RFQ) for a comprehensive evaluation and update of Chapter 38 of the Unified Development Code (UDC). The City Commission approved a budget allocation of $300,000 as part of the FY16 budget to perform this task. These services were procured through the City’s consultant selection process. There is approximately $72,500 remaining in the budget. The purpose of this memorandum and associated consent item is to request the Commission’s authorization of the First Amendment to the PSA with MAKERS Architecture and Urban Design to update the Unified Development Code. The requested additional six (6) months is to complete the work. The current contract expires on March 31, 2017. A public review draft for the entire document is anticipated in late April. If the extension is approved the contract will be valid until September 30, 2017. UNRESOLVED ISSUES: None. ALTERNATIVES: As determined by the City Commission FISCAL EFFECTS: The contract amount is $267,400. No change to the approved contract amount is included with this action. The North 7th Urban Renewal Board allocated $75,000 to accomplish Phase 1. The Bozeman Chamber of Commerce has pledged financial support for the project. $300,000 was included in the FY16 Community Development budget for this project. Report compiled on: March 20, 2017 Attachments: First Amendment to PSA 21 First Amendment to Professional Services Agreement for the Unified Development Code Update FY 2015 – FY 2017 Page 1 of 2 FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT THIS FIRST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT FOR the Unified Development Code Update dated August 24, 2015, (the “Agreement”) is made and entered into this _____ day of ____________, 2017 by and between the CITY OF BOZEMAN, MONTANA, a self governing municipal corporation organized and existing under its Charter and the laws of the State of Montana, 121 North Rouse Street, Bozeman, Montana, with a mailing address of PO Box 1230, Bozeman, MT 59771, hereinafter referred to as “City,” Community Design Group, hereinafter referred to as “Contractor.” In consideration of the mutual covenants and agreements herein contained, the receipt and sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the Agreement as follows: 1. Extension of Term. Section 2 of the Agreement is extended for an additional six month period. The Agreement shall terminate on September 30, 2017. 2. Agreement still valid.
