The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, June 22, 1960 at 1:00 o'clock p.m. Present
were Mayor Swanson, Commissioner Staudaher, City Manager Cutting, City Attorney
I Lovelace and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Staudaher, seconded by Mayor Swanson, that the minutes be approved as read and the
motion was carried by the following Aye and No vote: those voting Aye being Commis-
sioner Staudaher and Mayor Swanson; those voting No, none.
Resolution No. 977 -- Occupancy to a Portion of West Lincoln Street
Commission Resolution No. 977, a resolution granting the right to occupancy
and use of all the dedicated area of Lincoln Street between the west line of South
Grand Avenue and the east line of South Third Avenue and provisionally passed
by the Commission during its regular session of June 15, 1960, was again placed
before the Commission. The City Manager advised the Commission that a petition,
signed by 10 residents and owners of property in the fourteen-hundred blocks of
South Third and South Grand Avenues, objecting to the provisions of the Resolution
is now on file. In view of the foregoing, final action on the matter was deferred
I for further study.
Plans and Specifications for S.I.D. No. 416
Bid for S.I.D. No. 416
Plans and specifications covering the proposed improvements in Special
Improvement District No. 416 have been prepared by Harold Hoskins and Associates,
and it was moved by Mayor Swanson, seconded by Commissioner Staudaher, tha t, sub-
ject to the approval of the plans and specifications by the City Engineer, the
Clerk of the City Commission be, and is hereby, instructed to publ.ish a "Call for
Bids" on _the proposed improvements for the district and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson and

Commissioner Swanson; those voting No, none.
Bonds for S.I.D. No. 416
Bonds of Special Improvement District No. 416 must be sold to provide funds
for construction in the district. It was moved by Commissioner Staudaher, seconded
by Mayor Swanson, that the Clerk of the Commission be directed to advertise for
bids for the sale of bonds in this district in the approximate amount of $45,000.00
and the motion was carried by the following Aye and No vote: those voting Aye be-
I ing Commissioner Staudaher and Mayor Swanson; those voting No, none.
Sewer Facilities
Report on Sewerage System Improvements for the City of Bozeman, HHFA Project
No. Mont. 24-P-30Bl, prepared by Harold Hoskins and Associates, recommends that
the City construct a grit chamber at the city sewerage disposal plant. 'l'hls rec-
ommendation was concurred in by the Montana State Board of Health. Also, the
Commission was advised that the clarifier, damaged by the earthquake which occurred

during 1959, is in need of repair. The estimate of the total cost of the two
projects is approximately $34,000.00.
To accomplish the construction work contemplated, the City Manager requested
that authority be granted for submitting an application to the state Board of
Health, ac ting as the State Water Pollution Control Agency, for a grant of funds
in the amount of 30% of the estimated cost of the work, or approximately I
$10,500.UO under the provisions of 33 USC 466 et seq. "Federal Grants for Sewage
Trea tmen t" , and that the Mayor be designated as the representative of the City
authorized to sign this application and other documents pertaining thereto.
It was moved by Mayor Swanson, seconded by Commissioner Staudaher, tha t the
Manager's request be granted and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson and Oommissioner Staudaher; tho s e
voting No, none.
Changes in Restrictive Covenants of Marwyn Addition and New Hyalite View Subdivision
The City Commission restated its position, in concurrence with recommendations
c!
of the Bozeman City-County Planning Board and Board of Adjustment, tha t an ex-
ception to the requirements of Zoning Ordinance No. 818 for lot area and frontage
in the "AA" Zone be made in both currently platted rearrangements of the Marwyn
Addition and the New Hyalite View Subdivision. The City Manager was directed to
instruct the City Building Inspector to issue building permits in these areas
accordingly upon receipt of proper applications.
Adjournment I
There being no further business to come before the Commission at this time,
it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none.
