The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, June 29, 1960 at 1:00 o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City
I Manager Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the
Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
Resolution No. 977 -- Occupancy to a Portion of West Lincoln Street
Commission Resolution No. 977, a resolution granting the right to occupancy
and use of the dedicated area of Lincoln Street between the west line of South
Grand Avenue and the east line of South Third Avenue, was again discussed.
Action on the matter was tabled and referred back to the petitioners in effort
to secure a reconciliation of the divergent requests.
Petition -- Close Lincoln Street -- Third to Fifth Avenue
A petition signed by abutting property owners and residents In the immediate
area of Lincoln Street between Third and Fifth Avenues requesting permission to
I occu_py and use the dedicated area of the street was placed before the Commission.
.Joseph J. May, a petitioner, discussed the matter with the Commission; and, as
suggested by the Commission, Mr. May withdrew the petition to endeavor to gain
additional signatures of residents in the neighborhood not opposed to the action.
Resolution No. 978 -- Final Adoption
Resolution No. 978, provisionally adopted by the Commission, June 15, 1960,
was again presented. The City Ma nager stated the the Notice of Hearing and res-
olution have been published as required by Section 11-1409, R.C.M. 1947. No pro-
tests were on file and no one appeared to oppose the action set forth in the reso-
lution. As recommended by the City Attorney, it was moved by Corunissioner Sedivy,
seconded by Commissioner Staudaher, that the resolution be finally passed and
adopted and an order to make the appropriation specifying the funds upon which
warrants are to be drawn in payment for the expenditure be approved and set forth
in the minutes of the meeting. The motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and CommiS-
sioner Staudaher; those voting No, none.

THE AMOUNT OF EXPENDITURE REQUIRED TO MEET
SHCH :';~./IF,RGENCY AND TEE FUND AGAINST WHICH
EMGERGENCY WARRANTS SHALL BE DRAWN
On Tuesda y, July 14, 1959, at apprOXimately 5:22 a.m., the City of Bozeman
Park Department personnel discovered a fire in the building which houses the
heating equipment at the City of Bozeman nmnicipal swimming pool. The y imme-
diately placed a call to the Fire Department, the members of which extinguished
the fire. Subsequent examination indicated that the controls on the gas or water

feed to the boiler had failed to function, the boiler had gone dry and the gas
continued to burn until the boiler became so excessively hot that the building
was set on fire. Upon the basis of the foregoing facts, the City Commission of
the City of Bozeman hereby declares an emergency requiring an emergency appropri-
a tion.
It is hereby ordered that the sum of $13,794.74 is the sum necessary to I
meet such emergency and to repair and replace the damaged property and the City
Commission hereby orders the making of an emergency appropriation for this pur-

pose in that amount.
It is further ordered that the City of Bozeman Park Fund shall be the fund
against which warrants shall be drawn. ~~--?4~

Engineering Contract -- City Sewerage Disposal Plant
An engineering contract to perform the design, prepare contract plans,
specifications and contract documents, attend the contract letting and make
recommendations as to the lowest and most responible bidder, etc. regarding the I
City Sewerage Disposal Plant, to be entered into between the City and Harold
Hoskins and Associates, Engineers, of Great Falls, Montana, was placed before
the Commission. Upon the recommendation of the City Manager, it was moved by
Commissioner Staudaher, seconded by Commissioner Sedivy, that the Commission
approve the contract and authorize the Mayor and the Clerk of the Commission to
sign the contract for the City, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and .

Request -- Fourth of July Fire Works Display at Bozeman Country Club
A letter of request received from the Bozeman Exchange Club to close off
two streets in the Marwyn Addition (Aylsworth Street and East Babcock) ( Sou th
McAdow) during the Club's Fourth of July Fire Works Display was presented to the
Commission. It was moved by Commissioner Sedivy, seconded by Commissioner
Staudaher, that the request be granted and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy I.
and Commissioner staudaher; those voting No, none.
Examination of Depository Bonds
The Commission proceeded to examine the Custodian's Receipts for Depos-
itory Bonds held by the Director of Finance as security for City funds deposited
in Bozeman banks. It was moved by Commissioner Staudaher, seconded by Commis-
sioner Sedivy, that the securities be approved and a list thereof be set forth
in full in the minutes of this meeting and the motion was carried by the

Staudaher and Commissioner Sedivy; those voting No, none.

Investment of Cemetery Permanent Care Funds
Director of Finance Shadoan recommended that $20,000.00 of Cemetery Perm-
anen t Care funds be inves ted in U. S. fl'reasury Bonds, due 5/15/1968, bearing
3-7 /8~G. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,

.1 Travel to Missoula -- Association of Montana Planning Boards
Notice has been received that the Second Montana Plan~ing Institute meet-
ing is scheduled in Missoula, September 16-17, 1960. The City Manager requested
that two members of the City-County Planning Eoard be au.thorized to attend the
mee tlng, and, that it being in the public interest, the necessary expenses of the
delegates be paid out of the Planning fund. It was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, tha t the reques t be gran ted and the
motion was carried by the following Aye and No vote: those voting Aye being

Special Meeting -- Consideration of Annual Budget
Mayor Swanson announced that a Special Meeting of the City Commission will
be held at the regular meeting place Friday, July 1st, at 7:00 o'clock p.m. for
the purpose of considering the annual budget. I
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the
meeting adjourn and the motion was carried by the following Aye and No vote:
