The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, July 6th, 1960 at 1:00 o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, Cit;l
Manager Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace' and the I
Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-

sioner Sedivy, seconded by Commissioner Staudaher, that the minutes be approved
as read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;
those voting No, none.
Minutes of the Special Session held July 1, 1960 were read and it was moved
by Commissioner Staudaher, seconded by Commissioner Sedivy, that the minutes be
approved as read and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedi vy; those voting No, none.
Extension of Water Main -- West on U.S. Hwy. No. 191 from 15th Avenue
The City Manager reported to the Commission that the City is furnishing from
city stores 10" cast iron water pipe to Frank J. Trunk & Son, Inc., contractor
on the extension of the water main from Fifteenth Avenue west on U.S. Highway
No. 191 to serve property in the Hustad (Buttrey) Center; and, as this main will I
in the future serve additional areas in the vicinity, in line with an established
policy of the City the contractor is to be charged for the 10" pipe on a basis
of the cost of 8" cast iron water pipe.
Travel to Helena -- City Manager and City-County Planning Consultant
It was requested by the City Manager that he and Laurence Gerckens, c i ty-
county planning consultant, be authorized to meet in Helena, July 8th, wi th the
State Planning Board for the purpose of working out details of a three-way con-
tract between the State Board, the City of Bozeman an4 Mr. Gerckens for work to
be performed under a revised schedule for his planning consultant services to the

Bozeman City-County Planning Board. It was moved by Commissioner SediVY, second-
ed by Commissioner Staudaher, that the authorization be grantad, and, that it
being in the public interest, the necessary expenses of the travel be paid out
of the Planning ~lnd. The motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
S taudaher ; those voting No, none.
Claims for the Month of June, 1960 I

The Manager stated that he has audited these claims and finds them to be true
and lawful claims against the City of Bozeman and recommends that warrants be issued
for their payment. After examination of the claims in detail and checking against
the claim register, it was moved by Commissioner Staudaher, seconded by Commissioner
Sedi vy, that the claims be approved and warrants issued for payment and the motion
I was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.

The following reports were presented:

The Manager reviewed the reports with the Commission and pointed out that
the report of the Chief of Police reveals that during the month of June, ten pre-
viously unsolved burglaries had been broken and arrests made. Upon the recommend-
ation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commis-
sloner Staudaher, that the reports be approved and filed and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis-
sioner Sedivy and Commissioner Staudaher; those voting No, none.
Public Hearing -- Special Improvement District No. 418
This was the time and place set in Commission Resolution No. 976 to hear pro-
I tests to creation of Special Improvement District No. 418. Affidavit of publication
of Notice, together with the Clerk's Mailing Certificate that all property owners
have been notified, were presented. Written protests representing 30.85% of the
property in the district were presented. The City Manager recommended that the
protests be considered as insufficient and that Special Improvement District No. 418
be created. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
that the protests be overruled as insufficient, and the City Attorney be instructed
to prepare a resolution creating the district, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Staudaher and Commissioner Sedivy; those voting No, none.

Resolution No. 977 -- Occupancy to a Portion of West Lincoln Street (Final Adoption)

It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that
Resolution No. 977 be finally passed and adopted and the protests previously
filed be declared inadequate as to cause. The motion was carried by majority
vote: those voting "Aye" being Mayor Swanson and Commissioner Staudaher;

Commissioner Sedivy voting "No".
Petition -- Close Lincoln Street Third to Fifth Avenue
Mr. Joseph J. May, a petitioner requesting permission from the City for
abutting property owners to occupy and use the dedicated area of Lincoln Street
between Third and Fifth Avenues, appeared before the Commission and again filed I
the petition which ho had previously filed and withdrew during the Commission
meeting of June 29th. The Commission discussed and reviewed the petition and _
ordered the City Attorney to prepare a resolution granting the request to be
placed before the Commission, July.13, 1960, for provisional adoption as provided
be Section 11-3312, R.C.M. 1947.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
the meeting adjourn and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
