HomeMy WebLinkAbout1960-07-13 273 Bozeman, Montana July 13, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, July 13th, 1960 at 1:00 o'clock p.m. Present I Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, Ass't. Manager Fryslie, Deputy City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Bids for S.I.D. No. 416 This was the time and place set for opening bids for construction of improve- ments in S.I.D. No. 416. Affidavit of publication of "Notice to Bidder~" was pre- sented. Three sealed bids on this project were on file. Upon the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner StalJdaher, tha t the bids be opened and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sed:i.vy and Commis- sioner Staudaher; those voting No, none. Co., Miles City, Montana 41,144.25 A t the reques t of the Ci ty Manager, the COITEission referred the bids to Wayne W. Dean, the engineer representing Harold Hoskins & Associates, the engineer- ing consultant retained by the City for this district, and the City Engineer to check the bids in detail, prepare a final tabulation and ascertain the lowest and bes t bid submi tted for the cons truc tion of the improvements. License Appliea tion -~. Holland Furnace Co'. The applicatlon of the branch offlce of the Holland Furnace Co., Billings, Montana, for a city business license was presented and read. The Commission di- rected the City Hanager to correspond with the home office of the Company regard- ing company policies, performance bonds and liability coverages, and deferred action on issuing a license until the next regular session of the Commission. I Request -- Extension of Sewer ~ystem H. A. Bolinger, Jr., Frank E. Hoe y, and T. G. Haggerty appeared before the Commission to discuss the possibility of extending the city sewer system west to serve an area outside of the present city limits in the general \:icinity north of Babcock Stree t ex tended and in the area of the .u,Jrs ton Road ne i[;hborhood. Other members of the Connnission and the City Manager concurred with Mayor Swanson's sug- gestion that the City and the County attorneys SVJdy the legal aspects of the matter 27L1 to ascertain how the laws of the State of Montana provide for the creation of special improvement districts of such a nablre and for the levy of special assessments the reon. S.I.D. No. 416 -~ Award of Contract As directed, Nr. Dean and the City Engineer checked the extension of all bids submitted, prepared the flnal tabulation and recommended that Stanley H. I Arkwright, Inc. , Billings, Montana be awarded the contract for the const~~ction of th e improvements in Special Improvement District No. 416, the firm's bid in the amount of $35,263.25 being the lowest qualified bid received. It was moved by Commissioner Staudaher tha t the bid of Stanley II. Arkwright, Inc. in the amount of $35,263.25, it being the lowest bid submitted, be awarded the contract, subject to the sale of the bonds for this district. Commissioner Sedivy ques- tioned whether or not the "Notice to Bidders" contained a clause to provide pre- ferences in the ~warding of the contract to local firms and local labor, and was advised that a clause of that nature was not incorporated in the Notice. Commissioner Sedivy then seconded the motion of Commissioner Staudaher, and the motion was carried by the following Aye and No vote: those voting Aye being M:ayor Swanson, Commissioner staudaher and Commissioner Sedivy; those voting No, none. Gas Franchise -- Montana Power Co. County Clerk and Recorder Earl Walton, and John W. Cromer, Division Man- e.ger of the ,Montana Power Co., met with the Commission to discuss the matter I of placing to a vote of the freeholders of the City of Bozeman the question of granting a 50-year gas franchise to the Montana Power Co. Mr. Walton stated that to incorporate the foregoing measure with the General Election, November 8th, did not appear feasible and recommended the City conduct a special elec- tion independently of the General Election and on a date other than November 8th. Mr. Cromer suggested that the City conduct a Special Election to place the meas- ure before the public and verbally agreed that the Montana Power Company would bear the entire expense of the election as pertains to his company's franchise. . The Commission concurred with Mr. Cromer's suggestion, but in order to further study the matter tabled the action of setting a date for the election until its next regular session, July 20, 1960. Resolution -- Lincoln Street As instructed, the City Attorney had prepared a resolution to grant per- mission to certain property owners to occupy and use the dediceted area of Lincoln Street between Third and Fifth Avenu.es for park purposes. The Commis- I sion reviewed the resolution and returned it to the Deputy City Attorney and directed that a clause be incorporated in the resolution to provide for a "turn-around" a t the end of any avenue or alley tha t may be dead-ended by this ac tlon. Agreement -- ~itch Change at Gallatin Field An agreement between Gallatin County, the City of Bozeman and property owners of lands adjacent to Gallatin Field regarding the operation and main- )7- , , ~...J ,) tenance of a relocated irrigation ditch located in the area of the Northwsst- S01Jtheas t Runway was placed before the Commission. The Deputy City Attorney stated that the atrsemsnt appeared to be regular as to form and contents, and the City Manager recommended that the Commission approve the agreement and authorize the Mayor and the Clerk of the City Commission to sign the agreement for the City. It I was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the rec- ommendation be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner S taudaher ; those voting No, none. Sidewalk Bazaar -- Requests of Bozeman Chamber of Commerce Requests of the Bozeman Chamber of Commerce in connection with its pro- gram of the Sidewalk Bazaar, July 15th, were discussed and acted on as follows: 1. A permit to drop leaflets over the City from an airplane Friday, July 15th-- Commission action of prior years has established a precedent denying requests of such a nature. 2. The playinz of the Firs t Na tional Bank carillon throughout the day, during business hmlrs -- permission was eranted to play the instru~ent for 15 minutes every hour on the hour. - - -. 3. To operate two sound trucks, one in the business district and one in the residential area -- permission granted on condition that the t~lcks keep moving and cause no nuisance. Request -- First Methodist Chur(~h The Commission granted the First Methodist Church permission to stage a rummage sale on the sidewalk in front of the Rowles-Mack store during the I Sidewalk Bazaar, July 15 th. Request -- Jaycee Rodeo Program, Aug. 11-13, 1960 The Corrnnission granted the Jaycees permission to stags its annual rodeo parade on Main Street at 10:00 A.M., Sa mrday, Augus t 13th; to hold the Dude Ranchers' barbecue at Bogert's Grove on August 11th from 3:00 to 7:00 p.rr., and a barbecue and watermelon feed at the Grove, Sa turda ~r morning, Augu s t 13 th. Request -- Police Protective Association to Sponsor Circus The Police Protectlve Association reouested permission to sponsor a circus staged by King Brothers Tent Circus, August 17th, 1960. The City Manager rec- omm.ended that the request be granted, but without any adjustment of the regular license fee. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy that the request be granted and the motion was carried by the follow- '.' , ing Aye and No vote: those voting Aye being Mayor Swanson, Com.11iss ioner Staudaher and Commissioner Sedivy; those voting No, none. Request -- F. L. Dye to Park Trailer Display on Main Street, July 15 th The request of F. L. Dye Co. to park a Display Trailer on Main Street in I front of its place of business during the Sidewalk Bazaar, J1J.ly 15 th, was denied. Purchase of Fire Hydrants It was reported tha t the Ci ty has need for the purchase of tb..ree fire hydrants and fittings at an approximate total cost of ~700.00, and the Ci ty r-:anager reques t- ed that he be authorized to make the purchase. It was moved by ComJ111ssioner Sedivy, seconded by Commissioner Staudaher, that the authorization be :,..ran ted and the mo tj.on was carried by the following Aye and No vote: those voting Aye being Mayor 276 Swanson, Commissioner SedIvy and Comrnissioner Staudaher; those voting No, none. Purchase of Gravel Authoriza tion for the purchase of 5UO cubic yards of 3/4" crushed gravel, for pavement patching, requested by the Manager, was deferred pending investigation of new sources of such material.
