The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, July 27th, 1960 at 1:00 o'clock p.m.
Present were Mayor Swanson, commissioner Staudaher, Commissioner Sedivy, City I
Manager Cutting, Ass't. City Manager Fryslie, Deputy City Attorney Berg and the
Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read
and the motion was carried by the following Aye and No vote: those voting Aye
being Hayor Swanson, Commissioner Sedivy and Commissioner St&udaher; those voting
No, none.
Public Hearing Annual Budget
This was the time and place set for public hearing on the Appropriation
Ordinance No. 826 for the fiscal year ending June 30, 1961.
Affidavit of publication of notice of hearing was presented. No one waa
present to be heard on the proposed ordinance and accompanying annual budget and
no one had made inquiry or protest regarding it. However, the Connnission baving
further reviewed the proposed budget and stating its opposition to an increase
in the over all tax levy, directed that the proposed increased levy of one-half
mill tor the Band Fund for use in the Park Fund be eliminated and Ordinanee I;
No. 826 be revised accordingly. It was then moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the Clerk of the Commission-be directed

to publish the Ordinance as revised and as required by law and the --moti0~was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Sale of Special Improvement District No. 416 Bonds
This was the time and place set for sale of bonds in the approximate amount
of $45,000 for Special Improvement District No. 416. Affidavit of publication ef
notice of sale of the bonds was presented. J. D. Street representing the Security
Bank & Trust Co., Bozeman, Montana, appeared before the Commission and deposited
with the Clerk of the Commission the necessary bid security to qualify as a bidder
on the issue. Two sealed bids .ere on file and the Manager reoommended that the
Commission first open the sealed bids and then open the bidding for the submission
of oral bids. It was moved by Commissioner Sedivy, seconded by Commissioner
Staudaher, that the sale of the bonds be conducted as recommended and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor I
Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
The Clerk was then instruoted to open the sealed bids on file. All sealed
bids were accompanied by the neoessary bid security, and the bids were plaoed
of record as tollows:

Mayor Swanson announced the Commission was ready to hear oral bids for the
bonds and Mr. Street, as agent for Security Bank and Trust Company, presented an
&ral bid offering to purchase the issue for District No. 416 at par with an int-
erest rate of 5.3~. No other person having appeared to qualify and submit further
bids, the bid of the Security Bank & Trust Company was declared the best bid sub-
I mitted and it was moved by Commissioner Staudaher, seconded by Commissioner
Sedi vy, the t "1t; be accepted and the bid security of the unsuccessful bidders be
returned and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
Resolution No. 980 -- Occupancy to a Portion of Lincoln Street Third to Fifth Ave.
Commission Resolution No. 980, provisionally passed by the Commission during
its regular session, July 2Uth, 196U, was again placed before the Commission,

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, GRANTING CERTAIN PROPERTY OWNERS
THE RIGHT TO OCCUPY AND USE ALL OF THE DEDICATED
AREA OF LINCOLN STREET BETWEEN THE WEST PROPERTY LINE
OF SOUTH THIRD AVENUE AND THE WEST PROPERTY LINE OF
THE ALLEY BETWEEN FIFTH AND SIXTH AVENUES IN THE CITY
OF BOZEMAN, MONTANA
It was moved by Commissioner Staudaher, seoonded by. Mayor Swanson, that
I Resolution No. 980 be tinally passed and adopted and the motion was carried by
majority vote as follows: those voting "Are" beIng Mayor Swanson and Commis-
sioner Staudaher; Commissioner Sedivy voting "No".
Garbage Assessment -- ~ase Charge tor 1960
The Ci ty Manager recommended that the base charge for garbage assessment be
set at the same rate as assessed tor the year 1959. It was moved by Commissioner
Sed! vy , seconded by Commissioner Staudaher, that the basic assessment for the
year 1960 be set at $17.UO tor a four-room house and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Swanson, Commis-
sioner Sedivy and Commissioner Staudaher; those voting No, none.
Request -- Investment of Portion of Police Reserve FUnd
Director of Finance Shadoan having reported that $2,000 ot Police Reserve
Fundsare available for investment in U.S. Government securities, authority was
requested for such an investment. It was moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the Director ot Finance be authorized to
invest the amount as aforementioned and the motion was carried by the following

and Commissioner Sedivy; those voting No, none. ~
Continuation Certificate of Mannix Electric Co. -

A Continuation Certificate for the Electrical Contractor's bond ot Mannix
Electric Co. was presented. The certifioate was approved as to form by the
Deputy City Attorney and recommended for acceptance by the City Manager. It was
moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the

certificate be approved and accepted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and
Commissioner Staudaher; those voting No, none.
Electrical Bond -- Jerry Ramerman
TheELeetrlcal Contractor's Bond of Jerry Ramerman, Manhattan, Montana, wae
presented. The bond was approved as to form by the Deputy City Attorney, and rec- ."
ommended for acceptance by the City Manager. It was moved by Commissioner
Staudaher, seconded by commissioner Sedivy, that the bond be accepted and approved
and the motion was carried by the fo~lowing Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none.
Request -- Authority to Travel
It was reported that Fire Chief Pentilla has requested authority to travel
to Helena and Great Falls, August 2, 196u, for the purpose of viewing and study-
ing new fire apparatus and fire hose in connection with the preparation of speci-
fications for the purchase of such equipment for the City of Bozeman. The Ci ty
Manager recommended that the request be granted, transportation be provided by
the use of a City conveyance, and, that it being in the public interest, other
necessary expenses of the travel be paid out of the General-Fire Fund. It was
moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the reque s t
for travel be granted as recommended and the motion was carried by the following
Aye and No vo te : those voting Aye being Mayor Swanson, Commissioner Sedivy and I
Commissioner Staudaher; those voting No, none.
Police Judge -- Appointment of Arthur F. Thompson
Mayor Swanson recommended that Arthur F. Thompson be appointed Police Judge
to fill the vacancy created in that office by the resignation of Robert M. Holter.
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
Mr. Thompson be appointed to fill the vacancy effective August 1, 196u, to serve
at the will of the Commission and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher, and
Commissioner sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
the meeting adjourn and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
