City Manager Fryslie, City Attorney I Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by CommiS- sioner Sedivy, Seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Resolution No. 983 -- Final Passage -- Assessing S. K. D. No. 408 This was the time and place set for hearing protests to levying assess- ments for Special Improvement District No. 408. Affidavit of publication of the Notice was presented. No one was present to protest and, no protests having been filed, Resolution No. 983, provisionally adopted at the regular meeting held August 17th, 1960, was presented for final passage. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, tha t the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis- I sioner Staudaher and Commissioner Sedivy; those voting No, none. Resolution No. 984 -- Final Passage -- Assessing S. K. D. No. 409 Thia was the time and place set for hearing protesta to levying assess- ments for Special Improvement District No. 409. Resolution No. 985 -- Sprinkling Assessment This was the time and place set for public hearing on levying assess- ment for street sprinkling for the year 196U. Affidavit of publication of Notice was presented. No one was present to protest and no written protests I having been filed, Resolution No. 985, as presented and provisionally passed at the meeting of August 17th, 1960 was presented for final passage. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 986, as presented and provisionally passed I at the meeting of August 17th, 1960 was presented for final passage. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the resolution be finally passed and adopted and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Claim -- F. L. Dye Co. -- Construction of Swimming Pool & Boiler Room A claim (estimate No.4) in the amount of $2,357.10 of F. L. Dye Co. for work completed on the construction of the Swimming Pool & Boiler Room as of August 17th, 1960 was presented. This claim was supported by engineer's certifica te No.4. The City Manager recommended that the Commission approve the Claim. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the claim be approved and a warrant issued in payment and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; tho s e vo ting No, none. Liabi1i ty Insurance Policy -- Contination in Force to August 30, 1960 I D. H. Myrick of Valley Insurance Realty Company, agents for General Insurance Company of America, appeared before the Commission to discuss contination of blanket liability Policy No. 132548. Anniversary premium date of this policy is August 30, 1960 and the net estimated 1960-61 pre- mium to continue the policy is $2,369.16, plus $126.30 representing the adjustment of premium for the year 1959-6u. The City Manager therefore recom- mended that the Commission approve claim in the total amount of $2,485.46 for . the contination of the blanket policy and direct the Director of Finance to ,., issue a warrant in payment of the aforementioned claim. It was moved by Comrrissioner Sedivy, seconded by Commissioner staudaher, that the Commission approve the recommendation of the City Manager and the motion was carried by " the following Aye and No vote: those voting Aye being Mayor Swanson, Commis- sioner Sedivy and Commissioner Staudaher; those voting No, none. Purchase of Water Meters The City Manager reported that the Water Department has need for an additional supply of water meters and requested authority to purchase 30 (3/41t) I meters at an estimated cost of $26.00 each, or an approximate total amount of $780.UO. It was moved by Commissioner Staudaher, seconded by Connniss1oner Sedi vy , that the City Manager be authorized to purchase the meters and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. 296 Garbage Collection in New Hyalite Subdivision The City Manager reported that tbe~~ are now several residents residing in the New Hyalite Subdivision, and because of the distance required to travel to provide garbage collection for so few residents of the area, the Ci ty has, for its convenience, not provided this service. The Manager recommended tha t temporarily the residents of the area make arrangements for collection service I by a means other than the regular servioe provided by the City, and that gar- bage assessments in the area be waived until colleotion service is established by the City. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the recommendation of the City Manager be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Electrical Bond -- Jack Thunnna, Jr. The Electrical Contractor's Bond of Jack Thunnna, Jr., Dillon, Montana, was presen ted. The bond was approved as to form by the City Attorney, and recommended for acceptance by the City Manager. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the bond be accepted and approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. I Ordinance No. 827 -- Building Code The City Attorney has prepared Ordinance No. 827 to be known as the "Building Code." Ordinance No. 827 was presented, entitled: ORDINANCE NO. 827 AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDINGS OR STRUC- nJRES IN THE CITY OF BOZEMAN, MONTANA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THERE- FOR; DECLARING AND ESTABLISHING FIRE DISTRICT; PRO- VIDING PENALTIES FOR THE VIOLATION THEREOF, AND RE- PEALING ORDINANCE NO. 784 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH The City Manager discussed the ordinanoe with the Commission and recom- mended its passage and adoption. Ordinance No. 828 -- Fire Code The City Attorney has prepared Ordinance No. 828 to be known as the "Fire Code." Ordinance No. 828 was presented, entitled: I ORDINANCE NO. 828 AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION AND REPEALING ORDINANCE NO. 663 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH The Fire) db-Ie.t' and the Ci ty Attorney recommended tha t the ordinance be passed and adopted, and the City Manager concurred in the recommendations. Lease -- Parking Lot A lease between the City of Bozeman and Gallatin Publishing Co. for -I property described as follows: th~ North 58' of Lots 23 to 28, inclusive, of Block A, Rouses First Addition to the City of Bozeman, Montana to prOvide parking space for the public was presented. The lease was approved as to fo~ by the City Attorney. It was recommended by the City Manager that the lease be approved and the Mayor and the Clerk of the Commission be authorized to sign the lease for the City of Bozeman. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the recommendation of the City Manager be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Ambulance -- Discussion Mrs. Fred E. Skoog of the City Taxi Service appeared before the Commis- of slon and requested the Commission to make a study/the possible Changes in the procedure of operating the local ambuLance. Authority to Travel -- City Manager to San Franciso, Calif. I Notice has been received the International City Managers' Association annuaL conference is SCheduled to be held in San F7ancisco, Vctober 16th to 20th. It was moved by Commissioner Staudaher, seconded by Commissioner SediVY, that, it being in the pubLic interest, City Manager Cutting be authorized to attend this Conference and his necessary expenses incurred by such attendance be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Request -- Republican Party A request received from the Republican Party of Gallatin County to place a banner across Main Street in front of the Republican headquarters at the Baxter Hotel was presented.
