The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, September 7, 1960 at 1:00 o'clock p.m. Present
I were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
Assft. City Manager Fryslie, Deputy City Attorney Berg and the Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No,
none.
C.P.A. Examination & Report of Water Department - 1960
The 1960 report of the examination of the records and operations of the City
Water Department prepared by H. H. Kirchhoff, C. P. A., was presented. Upon the
recommendation of the City Manager it was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, that the report be approved with minor corrections and filed
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No,
none.
I Acceptance and Final Payment of S.I.D. No. 408
Having reported that all work was completed, it was recommended by Harold
Hoskins and Associates, consultant engineers, and the City Engineer that work under
the contract of Haggerty-Messmer Company for Specail Improvement ~iatrict No. 408
be approved and accepted, that the provision of the contract for the assessment of
liquidated damages for overrun of the contract time limit be waived except for excess
engineering costs, and that claim in the amount of $1,124.98 be approved as final
payment in fUll to the contractor. The C~ty Manager having concurred in the recom-
mendation, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy,
that the City accept the contract of Special Improvement District No. 408 as completed
and final payment in the amount of $1,124.98 be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Staudaher and Commissioner Sedivy; those voting No, none.
Acceptance and Final Payment of S.r.D. No. 409
Having reported that all work was completed, it was recommended by Harold

Resolution No. 987 - Intention to Create Special Improvement Sprinkling
District No.2
As directed by the City Commission during its regular session held August
31, 1960, the City Attorney has prepared Resolution No. 987 declaring it to be I
the intention of the City to create a special improvement district to be known as
Special Improvement Sprinkling District No.2. Resolution No. 987 was presented,

I Plans and Specifications for S.I.D. No. 418
Bid for S.I.D. No. 418
Plans and specifications covering the proposed improvements in Special
Improvement District No. 418 prepared by Harold Hoskins and Associates, super-
vising engineers, were placed before the City Commission by the City Engineer.
The City ~ngineer stated the engineer's estimate of the cost of construction in
the district is $284,000.00. Subject to minor changes, he approved the plans and
recommended that the City publish a "Call for Bids~. It was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the Clerk of the Commission be
directed to publish a "Call for Bids'" on the proposed improvements for the district
and the motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Swanson, Commissioner ~taudaher and Commissioner sedivy; those voting
No, none.
Bonds for S. I. D. No. 418
Bonds of Special Improvement District No. 418 must be soJdto provide funds
for construction in the district. ~he City Engineer stated that in accordance with
I terms of the contract it is necessary that a portion of the bonds of this district
be sold this fall to provide funds for payment of drainage work performed. he reco.
nnnended that the "Notice of sale of the Bonds" provide for the issue of $75,000.00
of the bonds on or about November 1, 1960 and the remainder of the issue in the
approximate amount of $209,000.00 approximately June 1, 1961. The City Manager
recommended, subject to the concurrence of the Director of Finance and the City
Attorney, the bond sale be conducted in the aforementioned manner. It was moved
by Commissioner Sedivy, seconded by Commissioner Staudaher, that the recommendation

of the City Manager be approved and the Clerk be directed to publish a call for bids
to be held October 13th for the sale of the bonds of Special Improvement District
No. 418 in the approximate amount of $284,000.00 and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner Staudaher; those voting No, none.
Policy of City Facilities I
Edward. Chauner, local businessman, appeared before the Commission to request
information concerning the City's policy of outlying areas connecting into city
faci!i ties. The Commission reaffirmed its policy that no utility will be permitted
to tie onto city facilities unless the area served 1s in the city limits; however,
it looked with favor on the creation of any improvement district and would continue
to cooperate in the development of such properties.
Claims for the Month of August, 1960
Claim No's. 9118 to 9419 inclusive were presented on the various funds as

The Manager stated he audited the claims and found them to be true and law-
ful claims against the City of Bozeman and recommended warrants be issued for their
pa yment. After examination of the claims in detail and checking against the claim
regis ter, it was moved by Commissioner Sedivy, seconded by Commissioner staudaher,
that the claims be approved and warrants issued for their payment and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner sedivy and Commissioner staudaherj those voting No, none.
Reports
The following reports were presented:

The Manager reviewed the reports with the Commission and recommended the
reports be approved and filed. It was moved by Commissioner Staudaher, seconded
by Commissioner Sedivy, that the reports be approved and filed and the motion was

Commissioner ~taudaher and Commissioner Sedivy; those voting No, none. I
Advertise for Bids for one t ton, 4 x 4 Truck
Bid specifications prepared for the purchase of a i ton, 4 x4 truck for use
by the Street Department were placed bef?re the Commission. The City Manager
stated the cost of the unit is estimated to be approximately $3,200.00 and reco-
mmended the city advertise for bids. It was moved by Commissioner Staudaher,
seconded by Commissioner SediVY, that the 6lerk be directed to advertise for bids

fOr an opening date of October 5, 1960 and the motion was carried by the following

Advertise for Bids for Wheeled Front Bnd Loader
I Bid specifications prepared for the purchase of a Wheeled Front End Loader for
use in the Street Department were placed before the Commission. The City lhanager
stated the cost of the unit is estimated to be approximately $l8,OOU.OO and recom-
mended the city advertise for bids on a payment plan extending over a three-year
pe riod . It was moved by Commissioner Staudaher, seconded by Oommissioner Sedivy,
that the Clerk be directed to advertise for bids for an opening date of October 5,
1960 and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting

Rex Duncan - Promoted to Rank of Police Sergeant
Chief of Police Vernon Saunders reported Officer Rex Duncan had been promoted
to the rank of Sergeant.
