Bozeman, Montana September 21, 1960 The Commission of the City of Bozeman met in regular session in the Commission I Room, City Hall Building, Wednesday, September 21, 1960 at 1:00 o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, Assistant City Manager Fryslie, Deputy City Attorney Berg and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaherj those voting No, none. Purchase of Backhoe This was the time and place set for opening bids on the purchase of a backhoe for the Water Department. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaherj those vo ting No, none. The following bids were opened and read: I Name Amount of Base Bid - Owenhouse Hdw. Co. $6,752.00 Norman Implement Co. 6,290.15 Mountain Machinery Co. 7,425.00 Brennan Tractor Co. 6,961.62 Manhattan Machinery Co. 6,290.00 Western Construction & Equipment Co. 6,895.00 Bidders were informed, that to allow ample time for study of the Speci- fications of the various units, final awarding of the contract would be delayed until the next regular meeting of the Commission, September 28th. Resolution No. 990 -- Assessing W & C 1960 This was the time and place set for public hearing on levying assessment for cost of repair, replacement or construction of new sidewalk for the year 1960. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 990, as presented and provisionally passed at the meeting of September 14th, 1960 was presented for final passage. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, ,.,. that the resolution be finally passed and adopted and the motion was carried by . Resolution No. 991 -- Garbage Assessment 1960 Resolution No. 991 levying assessment for collection and disposal of garbage for the year 1960 in the amount of $57,355.34 was presented, enti tIed: COMMISSION RESOLUTION NO. 991 - A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANAp LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES U ON ALL Ri:;~AL PROPERTY IN THE CITY OF BOZEMAN, :110 COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1960, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEY~N. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the resolution be provisionally passed and adopted and that september 28th, 1960 I be set as the date for hearing and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Request -- High School Homecoming Parade A request from the students of the Bozeman High School to stage its home- coming parade on Main Street, September 24th at 1:00 p.m., was presented. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Reports The following reports were presented: Cemetery Director of Finance Director of Public Works The Manager reviewed the reports with the Commission and advised it that all operations of the City appeared to be normal for the portion of the budget year. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the reports be approved and ordered filed and the motion was carried by the following Aye and t No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Claim -- Engineering Services on S.I.D. No. 414 A claim filed by John S. Bereman & Co., Supervising Engineers on S.l.D. No. 414, in the amount of $1,828.50 was placed before the Commission. The City Manager stated that the total amount of engineering services on the district amounted to $9,778.05 and that the en~ineer had previously received $7,746.39 which left a balance due of $2,031.66, and that all engineering services on the project had been completed with the exception of turning in to the City the engineering records. He recommended that the claim in the amount of $1,828.50, which represented $2,031.66 less a 10% retainer, be approved and a warrant issued in payment. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the claim be approved and a warrant issued in payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Commissioner Sedivy appeared and noted present at 1:55 p.m. . Discussion -- Possibility of Construction of a Trunk Line Sewer West of City Limits H. A. Bolinger, Jr. and Frank Hoey appeared at the meeting to request that the City extend a trunk line sewer further west to provide city sewerage facil- i ties to residents of a 750 acre area outside of the city limits. The City Manager stated it is beyond the city's present financial ability to construct a project of such a nature, and the Commissioner again reafirmed its policy that no :jl1 utility well be permitted to tie onto city racilities unless the area served is in the city limits. Extend City Limits The City Manager inrormed the Commission that owners or lands in the areas generally known as the High School Tract, Cleveland Subdivision (Canrield Tract), , "I Buttrey Shopping Center, and 10 acres owned by School District No.7 have requested - that the City Annex their land in order that it can be included within the City limits. He stated that the total area would be approximately 51 acres and recom- mended that the request be granted. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the City Attorney be instructed to prepare a resolution or intention to annex the arorementioned areas and the motion was carried by the rollowing Aye and No vote: those voting Aye being Mayor Swanson, CommJssioner Sedivy and Commissioner Staudaher; those voting No, none. Advertise for Bids -- Garbage Disposal Unit (Truck) Bid specifications prepared ror the purchase or a garbage disposal unit (truck) for the collection of garbage in the City were presented.
