The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, September 213, 1960 at 1:00 o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City
Manager Cutting, Asa't. City Manager Frys1ie, City Attorney Lovelace and the I
Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved
as read and the motion was carried by the foLLowing Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
Purchase of Backhoe
During the previous meeting of the Co~~ission bids for the purchase of a
backhoe were opened and read and bidders were informed, that to allow ample time
for study of the specifications of the various units, final awarding of the con-
tract would be delayed until this meetin~ of the Commission. The City Manager
informed the Commission that after a full tabulation of the bids submitted, the
bids of the Drennan Tractor Co., Bozeman, Manhattan Machinery Co. and the
Western Construction and Equipment Co. of Billings were not considered as the
bids did not meet specifications incorporated in the call for bids as advertised. I
Of the qualified bids, the bid of the Norman Implement Co., Bozeman, Montana in
the amount of $6,290.15 for a John Deere tractor with equipment as specified
was the lowest and best bid. The Manager recommended that the award of the
contract be let to the Norman Implement Co., and it was moved by Commissioner
Sedi vy, seconded by Commissioner Staudaher, tha t the award for the purchase of
the unit in the amount of $6,29U.15 be awarded to the Norman Implement Co. and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those vo ting No,
none. -
Purchase of "Fire Engine - Pumper"
This was the time and place set for opening bids on the purchase of a
"Fire Engine - Pumper" for the Ci ty Fire Department. It was moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that the bids be opened and
read and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none. I

Purchase of Fire Hose
This was the time and place set for opening bids for the purchase of 1400' of
3" fire hose. The affidavit of publication of the Call for Bids was presented. It
I was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the bids
be opened and read and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those
voting No~ none.

Resolu tion No. 991 -- Garbage Assessment for the Year 1960
This was the time and place set for public hearing on levying assessment for
collection and disposal of garbage for the year 1960 in the amount of $57,355.34.
Affidavit of publication of Notice was presented. No one was present to protest and
I no written protests having been filed, Resolution No. 991, as presented and provision-
ally passed at the meeting of September 21st, 1960 was presented for final passage.
It was moved by Commissioner Sedivy, seconded by Commissioner .::ltaudaher, tha t the
resolution be finally passed and adopted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and
Commissioner Staudaher; those voting No, none.
Resolution No. 993 -- Amending Resolution No. 981 "Gas Franchise"

for the purpose of changing the date of the special election from December 6, 1960
to that of December 20, 1960 on the matter of the City's granting a gas franchise

RESOLUTION NO. 981
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
the resolution be passed and adopted and December 20th, 1960 be scheduled as the date
for holding the election, and the motion was carried by the followine Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.

Notifica tion -- Referendum on Ordinance No. 822
The City Manager presented a "Notlfication addressed to Mayor Swanson that
a referendum on Ordinance No. 822 is ready for submission to the electors".
Mayor's Proclamation -- Special Municipal Election on Ordinance No. 822
Pursuant to notification of the Clerk of the City Commission, Mayor Swanson
presented his Proclamation to submit to a vote of the electors of the City, I
Oruinance No. 822, an ordinance pertaining to the control of dogs and other animals
wi thin the Ci ty, on December 20, 196u. The aforementioned proclamation authorized
and directed the Clerk of the Commission to arrange for the holding of the election
in accordance with the laws of the State of Montana on the date set forth.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the Commission action of July 2u, 1960 setting the date for placing Ordinance No.
822 to the vote of the electors be rescinded, and that it be referred to them a t a
special election of the City scheduled to be held December 20th, 1960 and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Request -- Red Heart Tag Sale
A request from the Women of the Moose to stage its "Red Heart Tag Sale" on
Sa turda y, October 8th, was presented. The request stated that proceeds from the
sale are to be given to the children's hospital at Helena, and it was moved by
Commissioner Staudaher, seconded by Commissioner Sedivy, that the request be granted I
and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those vo ting
No, none.
Adjournment --
There being no flJrther business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the
meeting adjourn and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Sedivy, and Commissioner
Staudaher; those voting No, none.
