January 6, 1960
The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, January 6, 1960 at 1:00 o'clock P.M. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
City Attorney Lovelace and the Clerk. The following proceedings were had: I
Minutes of the last meeting held at lU:OO o'clock A. M., January 4th, 1960 were
read and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the minutes be approved as read and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No, none.
Appointment - Ass't. City Manager
City Manager Cutting announced his appointment effective as of February 15, 1960
of Harold A. Fryslie to the position of Assistant City Manager.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the
appointment be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;
those voting No, none.
Mystic Lake Drainage - Small Landowner Fire Protection
D. W. Beaman of the United States Forest Service appeared before the Commission
and submitted a proposed "Small Landowner Fire Protection Agreement" to been tered
into by the City and his agency, in regard to 5,053.78 acres of city-owned land with- I
in the Mystic Lake Drainage Area.
Action on the matter was tabled to allow further study until the regular meet-
ing of the Commission on January 20th.
Bond - City Manager
The performance and surety bond of Oscar E. Cutting, City Manager of the City of

Bozeman, issued by the Hartford Accident and Indemni ty Company 1n " "the < amount of
$20,000 was presented. This bond was approved as to form by City Attorney Loyelace,
and it was moved by Commissioner Staudaher, seconded by Commissioner Sediyy that the
bond be accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none.
Release of Bond - M. E. Henderson, Retired
City Manager Cutting placed before the Commission a letter addressed to the
Hartford Accident and Indemnity Company requesting the termination of the bond of ..
Maurice E. Henderson, effective December 31st, 1959, due to the retirement of Mr.
Henderson as City Manager. I
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
Mayor Swanson be authorized to sign the letter for the City and the City Manager
forward it to the addressee and the motion was carried by the following Aye and No
vo te : those voting Aye being Mayor Swanson, Commissioner Staudaher and Cormnissioner
Sedivy; those voting No, none.

Quit Claim Deeds - Ordinance No. 820 "Abutting Property Owners"
City Attorney Lovelace placed before the Commission Quit claim deeds transfer-
ing the City's equity to land vacated on South Willson Avenue by Ordinance No. 820
to abutting property owners as follows:

Eugene and Josephine Graf

Verne Shockley Keyes
Roscoe R. Hull
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the Commission approve the above instruments of conveyance and authorize the Mayor
and the Clerk to sign the same for the City and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and
Commissioner Staudaherj those voting No, none.
Registered Warrants - Interest Rate
Director of Finance Shadoan appeared before the Commission in regard to
$30,557.34 of registered warrants issued on the Water Fund of the city. The afore-
said warrants are now held by the Cemetery Permanent Care ~und of the City. Mr.
Shadoan advised the Commission that current business interest rates indicate a 5%
return on a like investment would appear to be in order and recommended he be
authorized to pay a 5% rate when the warrants are redeemed. It was moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that the Director of Finance be
authorized to redeem these registered warrants at 5% interest and the motion was
I carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Investment of Surplus Cash from Various City Funds
Director of Finance Shadoan reported that large cash balances in some of the
Special Improvement District cash funds make it possible and advisable to invest
apprOXimately $295,00U of these balances in U. S. Treasury Bills. Upon the City
Manager's recommendation it was moved by Commissioner Staudaher, seconded by Commis-
sioner Sedivy, that the Director of Finance be authorized to 11l.ake the aforesaid
investment and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting
No, none.

Additional Claims for the Month of December

The Manager stated that he has audited these claims and finds them to be
true and lawful claims against the City of Bozeman and recommends that warrants
be issued for their payment. After examination of the claims in detail and check- ~ I
ing against the claim register, it was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, that the claims be approved and warrants issued for their
payment and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those
voting No, none.
Schedule - - Re-valuation of City Bldgs. and Contents for Insurance
At the regular meetings of the Commission held on December 16th and 23rd, 1959,
a schedule of appraised values of City owned Buildings and contents to be sub-
mitted to the Montana Fire Rating Bureau as a basis for re-establishing an aver-
age rate for insurance coverage was approved as was the deletion of certain build-
ings previously covered. Upon presentation of further information in regard to
contents of these deleted buildings, previous actions were reconsidered.
It was moved by CommissionerStaudaher, seconded by Commissioner Sedivy, that
the following buildings, with contents:

Chlorina ting Plant - 2t Mi. NE, Bozeman I'
Booster Pumping Sta. Lyman Cr. Supply Line
be included in the schedule of appraized values and in the proposed insurance ,',
coverage and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivyj those
voting No, none.
Montana Municipal League - Legislative Committee
City Manager Cutting presented a letter from the Montana Municipal League
stating thatdue to the retirement of M. E. Henderson as City Manager, a vacancy
exists on its Legislative Committee, and to fill this vacancy it is appointing
City Manager Cutting as a member of the committee subject to his acceptance. It
was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that Mr.
Cutting accept this appointment and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and
Commissioner Sedivyj those voting No, none.
