HomeMy WebLinkAbout1960-01-27 196 Bozeman, Montana Jan. 27, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, January 27, 1960 at 1:00 o'clock P.M. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner .. I Sedi vy, seconded by Co~~issioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Storm Sewer Outlet North 9th Avenue H. A. Bolinger, Jr. again appeared before the Commission to contend that water from the outlet of the recently installed storm sewer drainage on North Ninth AVenue in SID No. 409 will caus e damage to his and his clients property in the Dur~ton Sub- division north of Beall Street, and to request a reconsideration of prior action denying remedy from this situation. Action was deferred pending a review and re- study of the matter. Petition - Two hour Parking on North Side of West College, 8th to 10th A petition was placed before the Commission requesting the City to restrict park- ing to two hours on the North side of West College Street between 8th and 10th avenues. On recommendation of the City Manager, action on the petition was deferred to permit investigation of this parking problem. a Claim - Stanley H. Arkwright, Inc. - SID No. 414 The claim in the amount of $13,473.96 of Stanley H. Arkwright, Inc. for work completed on SID No. 414 as of December 16th, 1959 was presented. This claim was supported by detailed estimates prepared by John S. Bereman Co., supervising engin- eers. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy that the claim be approved and a warrant issued for payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis- sioner Staudaher and Commissioner Sedivy; those voting No, none. , Claim - John S. Bereman & Co. A claim in the amount of $3,166.80, dated Jan. 6, 1960, of John S. Bereman & Co. , Cody, Wyoming for engineering services in connection with the construction of Special Improvement District No. 414 was presented. It was moved by Commissioner Staudaher, seconded by Commis,s ioner Sedivy, that the claim be approved and a warrant issued for payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedi vy; those voting No, none. Agreement - Assignment of Construction Guarantee of Water System in the New Hyalite View Subdivision As requested by the Commission at its meeting on December 30, 1959, a three- party agreement was presented whereby the guarantee against faulty material and work- manship, etc. for a period of one year following completion anfr acceptance of the work, as contained in the contract between the Haggerty-Messmer Company and the B & E Co., Inc. for the construction of a water distribution sy~tem in the New Hyalite 1!}7 View Subdivision, is assigned to the City. Following the concurrent recommendation of the City Attorney and the City Manager, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the Commission approve this agreement and the Mayor and the Clerk be authorized to sign the document for the City and the motion was carried by the following Aye and No vote: I :I those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Claim - B & E Co., Inc. - Water Mains in New Hyalite View Subdivision A claim in the amount of $7,384.74 of B & E Co., Inc. representing the City's obligated share of the cost of water mains installed in the New Hyalite View Sub- division was again presented. The City Manager also presented correspondence and other documents from the B & E Company on the basis of which he recommended that it be con- sidered the B & E Company has complied with stipulations made by the Commission at its meeting on December 30, 1959 and that issuance of warrant for payment of this claim be 8.uthorized, with 10% to be retained until subject water mains are completed and accepted by the City. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher that the Director of Finance be directed to issue warrant in payment of this claim in the manner recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Authority to Travel - FBI Meeting, Helena, Montana, Feb. 2, 1960 I A letter from the Chief of Police was presented requesting that Captain Davis and four other officers of the Police Department be authorized to attend a meeting of law enforcement officers to be conduc t.ed by the Federal Bureau of Inves tiga tion in Helena on February 2, 1960 in regard to transportation of stolen vehicles, and further re- questing that a City owned vehicle be provided for this trip. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that this request be granted, with necessary expenses to be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Report The report of the Police Judge was presented and it was moved by Commissioner Sedi vy, seconded by Commissioner Staudaher, that the report be approved and filed and the motion was carried by the following rlye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Ad j ournmen t There being no further business to come before the Commission at this time, it I was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the meet- ing adjourn and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
