The Com~ission of the Clty of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, February 10, 1960 at 1:00 o'clock P.K. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
City Attorney Lovelace and the Clerk. The following proceedings were had:
Minutes of the last regulAr session were road and it was moved by Commissioner I
Stauda!':er, seconded by Con~issioner Sedivy, that the minutes be approved as read end
the motion was carried by the following Aye and No vote: those voting Aye being

Paving l'ro,ject - U.S. Highway No. 191 - West Mail) Street
Correspondence from the State Highway Commission was presented R.dvising that
agency hRS tentatively scheduled for bid opening on April 20, 1960 a federal-aid
project to consist of plant mix surfacing on U.S. Highway No. 191 from Bozeman west
and to include an urban section of 0.175 miles within the City of Bozeman on West
Main Street from the WEist line of Southc':ighth Avenue to the west city limits at
Eleventh Avenue. The improvement proposed for this urban section would consist of
the construction of curbs, gutters and full width pavement on tbat portion of West
Main Street at a toh'll cost eat:lmated by the IUghway Commission to be $19,843.78.
Under HiGhway COrrL>";;j.ss ion regula tions, the City of Bozeman would be required to part-
icipate in this cost to the extent of 25% or $4,960.95.
The City Manager informed the City Ccrn~ission that upon receipt of this in-

It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the City Engineer and the City Attorney prepare a resolution of intention to create
a Special Improvement District for the purpose of creating SID #415 to complete the
project and the motion was carried by the following Aye and No vote: those voting
Aye being 1,~a yor Swans OD, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.
Resolution No. 968 - Intention to Pave West Main from 8th to Westerly City Limits
The City Attorney, as instructed, prepared a resolution of intention to pave
West Main Street from 8th to the Westerly City Limits. Resolution No. 968 was
prosented entitled:

It was moved by Commissioner Gtaudaher, seconded by Commissioner Sedivy, that
the resolution be passed and adopted and March 2, 1960 be set as the date for public

Montana Law Enforcement Academy, 3/31 to 4/13/60
The application of Sergeant Raymond Earl Lavender for admission to the Second
I Annual Montana Law Enforcement Academy to be held at Montana State College from
March 31 to April 13, 1960 was presented bearing the favorable endorsement of Chief
of Police Charles V. Saunders and further recommended by the City Manager.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the
application of Sergeant Lavender be approved and in the event he is selected for this
Academy term, his attendance be authorized and the necessary expenses be paid from the
General Fund and the motion was carried by the following Aye and No vote: those voting
Aye, being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting
No, none.

Chief of Police Cemetery
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, tha t the
reports be approved and filed and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedi vy; those voting No, none.
I Fire Chief Officer Training Meeting - Feb. 11th, Helena, Montana
A letter was presented which stated the Fire Chief Officers Tratning Committee
has scheduled a meeting at Helena on Feb~lary 11, 1960 to discuss and review its train-
ing program.
It was moved by Commissioner Staudaher, seconded by Corn~issioner Sedivy, tha t the
meeting being in the public interest the Commission authorize Pire Chief Pentilla to
attend the meeting using a ci ty owned vehicle and his necessary expcnses be paid out
of the General ~lnd and th0 motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and CotmJ1issioner Sedivy;
those voting No, none.
Determ:~nation of Street Width of 11th Avenue at West Main Street
The Commission discussed the matter of establis! ing the width of 11th Avem.1e at
its intersection with Main Street. It was moved by Commissioner Staudaher, seconded

by Commissioner Sedivy, that the width be established at 90' and the motion was car-
ried by the following Aye and No vote: those vot1ng Aye being Mayor Swansor, Commis-
sioner StalJdaher and Commissioner Sedivy; those voting No, none.
I Sewers - hlrchase of Rod for Sewer Rodder
City Manager Cutting reported that there exists a need for sewer rods for the
rodder and reCOMmended the purchase of 235 lengths at the approximate cost of $700.00.
It was moved by Commissioner Sedivy, seconded by ComMissioner Staudaher, that the Man-

Petitions - Dogs - "Leash Law"
The Comrr:ission reviewed a petition and letters filed with the City requesting that
the Com.miS8ion pass R. leash law on dogs wlt1:in the City. The Matter was tabled to allow'
further study and to Ascertain if possible the sentiment of the public in general.
Agreement - City & County, Rock Point on Sourdough Road
The Board of County Commissioners of Gallatin County met with the City Commission I
and discussion was hold relative to a cooperative project between the City of Bozeman
and Gallatin County for elimination of a rock point now existing on the Sourdough Road
in Block 24 of the Electrlc Heights Addition to the City of Bozeman. The County de-
sires to use the material obtained for cnrstruction of a county road betweoD Sourdough
Road and South Third Avenc:e extended and the removal of the rock point, being wlthin
the city lirits, will eliminate a definite traffic hazard to the citizens of Bozeman.
The proposed project would otherwise accrue to the benefit of the City in the diversion
of traffic fror.l Ci ty Streets. The City Managor reported tha t a1 though ten ta ti ve agree-
mont had been made by the City to furnish the powder man and the powder for required
blasting as the City's participation in tho proposed project, no basis had been found
for estimating the ultimate cost of such participation, nor had right of entry upon the
private property involved been or.tirely cleared.
It was moved by Commissioner Staudaber, seconded by Commissioner Sedivy, that the
City's participation in tho proposed project, being in the public interest, "be author-
ized and approved, the City to furnish the powder man and necessary blasting powder at
an expendi.ture of not to exceed $1,000.00 and with the understanding the County will I
exercise gonerql supervision of the project and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and -
Commissioner Sedivy; those voting No, none.
