HomeMy WebLinkAbout1960-03-02 207 Bozeman, Montana March 2, 1960 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, March 2, 1960 at 1:00 o'clock P.M. Present were Mayor Swanson, Commissioner Sedivy, Commissioner Staudaher, City Manager Cutting, Ass't. Manager Frys1ie, City Attorn81 Lovelace and the Clerk. "I Minutes of the last regular session were read and it was moved by Commissioner Sedivy, s,conded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Public Hearing - Special Improvement District No. 415 Resolution No. 969 - Creating S.I.D. #415 This was the time and place set in Commission Resolution No. 968 for hearing protests to creation of Special Improvement District No. 415 for constructing and instaLling a pavement projeot on West Main Street from the west line of South Eighth Avenue and said line extended to the westerly city limits of the City of Bozeman. Affidavit of publication of Notice was presented together with the Clerk's Mailing Certificate that all property owners have been notified. No written protests having been filed and no one being present to be heard, Resolution No. 969 creating Special Improvement District No. 415 was presented, entitled: COMMISSION RESOLUTION NO. 969 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE 1 KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 415 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST MAIN STREET FROM THE WEST LINE OF SOUTH EIGHTH AVENUE ANT~ SAID LINE EXTENDED TO THE WESTERLY CITY LIMITS OF THE CITY OF BOZEMAN It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis- sioner Sedivy; those voting No, none. Petition for Paving Streets in Vicinity of Block ttD" Marwyn Addition A petition requesting that a Special Improvement District for paving streets in the vicinity of Block ttD" Marwyn Addition to the City be created was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the City Engineer prepare the necessary data, and based on this data, the City Attorney prepare a Resolution of Intention to create this district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Cemmissioner Staudaher; those voting No, none. I Claims for the Month of February, 1960 Claim No's. 7418 to 7687 inclusive were presented on the various funds as follows: General $l6, 655 .62 Street $ 5,523.54 Water 7,314.94 SDS Revenue 3,322.06 Library 1,898.UO Park 3,269.46 Cemetery 1,110.93 Band 20.0u Garbage 3,605.40 Parking Meter 1,181.68 Police Reserve 528.80 Planning Board 15.00 P.E.R.S. 672.71 SID Revolving 269.93 S.I.D.'s 1,10u.07 Total $46,488.14 208 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail and checking against the claim register, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the claims be approved and warrants issued for their payment and the motion was carried by the following ~ye and No vote: those voting Aye being Mayor I Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Reports The following reports were presented: Director of Public Works (Jan.) Library Disposal Plant Operator Cashier Water Collector Building Inspector Cemetery Fire Chief Police Judge It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the reports be approved and fi~ed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy, and CommiS- sioner Staudaherj those voting No, none. Bonds for S.I.D. No. 406 Bonds of Special Improvement District No. 406 must be sold to provide funds for construction in this district. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the Clerk of' the Commission be directed to advertise for bids for the sale of the bonds in this district in the approximate amount of $11,5UO.UO and the motion was carried by the following Aye and No vote: those voting I Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Bonds for S.I.D. No 410 Bonds of Special Improvement District No. 410 must be sold to provide funds for construction in this district. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the Clerk of the Commission be directed to advertise for bids for the sale of the bonds in this district in the approximate amount of $115,UOO.UO and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Bonds for S.I.D. No. 411 Bonds of' Special Improvement District No. 411 must be sold to prOVide funds for construction in this district. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the Clerk of the Commission be directed to advertise for bids for the sale of the bonds in this district in the approximate amount of $190,UUU.UO and the motion was carried by the following Aye and No vote: those I voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Bonas for S.I.D. No. 412 Bonds of Special Improvement District No. 412 must be sold to prOVide funds for construction in this district. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the Clerk of the Commission be directed to advertise :2(}9 for bids for the sale of the bonds in this district in the approximate amount of $12,800.00 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner _Staudaher; those voting No, none. Bonds for S.I.D. No. 415 I Bonds of Speciai Improvement District No. 415 must be sold to provide 4Unds for --- construction in this district. It was moved by Commissioner Staudaher_, secGmded by Commissioner Sedivy, that the Clerk of the Commission be directed to advertise for bids for the sale of the bonds in this district in the approximate amount of $5,uOO.OO and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Resolution No. 915 - Error In Description It was brought to the attention of the Commission that in Resolution No. 915 an error occurred describing that portion of the Alley intended to be vacated in Block "C", Original Townsite of the City and it is necessary to correct this error. The Commission was advised by City Attorney Lovelace that, it it is agreeable to Security Building, Inc. as owner of the property abutting that portion of the alley in question to pay costs of the proceedings, he would proceed to correct the error. It was then moved by Commissioner Sedivy, that subject to Security Building, Inc's. concurrence to pay the cost of the proceedings, that City Attorney Lovelace proceed 1 to correct the error. The motion was seconded by Commissioner Staudaher and carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Request Denied - MSC Senior Class to Place a Marquee in Downtown Area The request of the Senior class of Montana State College to place a marquee on the island parking at the corner of 8th Avenue and Main Street was again considered by the Commission. After consideration of City ordinances and policies involved, it was found necessary to deny the request and to, also, deny permission for the erection of such a marquee or sign on any City street property. It was moved by Commissioner Staudaher,- seconded by Commissioner Sedivy, that City Manager Cutting notify Mr. Arjay Godston, MSC Senior Class President, of the CommisSion's action on the matter and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and CommisSioner Sedivy; those voting No, none. Poppy Day - American Legion Auxiliary -Letters from Gallatin Unit Number 14, American Legion Auxiliary, requesting per- mission to have Saturday, May 28, 1960 be designated as "Poppy Day" in Bozeman and I to, also, grant the Auxiliary permission to sell poppies on the Bozeman streets on that date were presented. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
