Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, Ass't. Manager Fryslie, City Attorney Lovelace and the Clerk. Minutes of the last regular session were read and it was moved by Commis- I s10ner SediVY, seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. After an informal discussion of the various aspec..ts of the matter, the Commission directed that an engineering study and cost estimates be made for a drainage dist- rict in this area for submission on March 23rd, if possible, and the action was deferred pending receipt of this information. """iiIi<-~ I \ Plat - Proposed Re-arrangement of Portion of Durston Sub-division A corrected plat of a proposed re-arrangement to be known as the Brunton- Palffy Re-arrangement of a Portion of Durston's Sub-division was again presented. The original platting of this proposed re-arrangement had been previously approved by the Commission on December 23rd, 1959, then found that oorrection of property descriptions and in the platting were required. It was moved by Commissioner Staudaher, seconded by Commissioner SediVY, that the plat be approved and the City Manager acting as Director of Public Service be authorized to sign for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. - Request - W. J. Sullivan, Encroachment of Building On East Cottonwood Street W. J. Sullivan appeared before the Commission to protest the encroachment of a portion of a building situated on East Cottonwood Street. Action was deferred pending an investigation of the location of the building and legal aspects of the case. I Request - Dogs "Leash Law'" Mr. A. R. Mackleberg of 308 N. Black appeared before the Commission and verbally requested that the City pass a Leash Law pertaining to dogs running at large. The Commission informed Mr. Mackleberg that the matter was under the process of study and it was not, at this time, in a pos i tion to report on the '"final results of the study. ')11 ~-- -' Resolu tion No. 971 - Intention to Vaoa te a Portion of an Alley in Block "C", O.T. As directed, the City Attorney has prepared a resolution of intention to vacate a portion of an Alley in Block "C., Original Townsite of the City of Bozeman. . Resolution No. 971 was presented entitled: COMMISSION RESOLUTION NO. 9'11 .1 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF AN ALLEY IN BLOCK "C", ORIGINAL TOWNSITE OF THE CITY OF BOZEMAN, MONTANA It was moved by Commissioner SediVY, seconded by Commissioner Staudaher, that the resolution be adopted and that Maroh 30th, 196u be set as the date for public hearing on the proposal and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; ,those voting No, none. Resolution No. 970 - Intention to Pave Streets in Portion of Marwyn Addition The City Attorney, as instructed, has prepared a resolution of intention to pave a portion of the streets in Marwyn Rearrangement, SID #416. Resolution No. 970 was presented entitled: COMMISSION RESOLUTION NO. 9'10 COMMISSION RESOLUTION NO. 970 OF THE CITY OF BOZEMAN DECLARING THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPRuVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NU. 416." It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that I the resolution be passed and adopted and April 6tn, 196U be set as-the date for public hearing and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. I 'I Bids for Copper Pipe Need for copper pipe for use in the Water Department was reported. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the Clerk of the Commission be authorized to advertise for bids for 5,000 feet of ) from 3/4" to 2" pipe and the motion was carried by the following Aye and No vote~ those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Bid for Purchase of Power Lawn Mower Need is reported for the purchase of a new power lawn mower to replace the present mower used by the Cemetery department. It is estimated the cost of this unit is approximately $1,500.UO, and it was moved by Commissioner Staudaher, seconded by 1 Commissioner Sedivy, the t the Clerk of the Commission be authorized to advertise for bids and the motion was oarried by the follOWing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Steudaher and Commissioner Sedivy; those voting No, none. Reports The following reports were presented: Director of Finance Director of ~ublic Worke The City Manager reviewed the report of the Director of Finance with the 216 Commission and stated that all financial operations of the City appear to be normal for this period of the budget with exceptions as noted. The Commission examined the report of the Director of Public Works, and following the recommendation of the City Manager it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the reports be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner I- Staudaher; those voting No, none. Montana Municipal League - Legislative Committee The City Manager announced that a meeting of the Montana Municipal ~eague's Legislative Committee, of which he is a member, had been scheduled for March 17th, 1960 in Helena and requested authority to attend the meeting at no cost to the City. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the folloWing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner SediVY; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was woved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the meet- ing adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and CommiSSioner Staudaher; those voting No, none.
