SUBJECT: Resolution 4785 authorizing Change Order No. 2 to the South University
Area Sewer Main Interceptor Project.

RECOMMENDATION: Approve Resolution 4785 authorizing Change Order No. 2 to the South University Area Sewer Main Interceptor Project.
BACKGROUND: Attached is a copy of resolution 4785 and change order number 2 for the
above referenced project. The majority of this change involves delays and cold weather impacts
associated with a conflict with an AT&T fiber optic line. The line was not located as requested
during the design, but was discovered during the course of construction. The line was 16’ deep and didn’t allow the bore under 19th to be completed in the manner anticipated by the design.
There were delays associated with exposing the line and discussions with AT&T to determine
how to proceed. The conflict required the contractor to completely change the means and
methods for the installation of the bore and the delays pushed the project into very cold weather
which required additional effort on their part. A detailed description of all of the impacts and supporting information is attached to the change order.
The other item was to provide an addition generator for the dewatering system to maintain
accessible access from Marsh Lab to Campus. When construction started impacting the Marsh Lab area, we were made aware that there were a number of users of the building that used wheel chairs. The construction documents did not address providing an accessible route from Marsh
Lab to South 19th. The Contractor’s dewatering plan included above ground pipes that would
interfere with accessible access. A number of options were reviewed as to how to address the
access issue and it was decided that the best method was to eliminate any dewatering pipes in this area by utilizing a separate discharge point which required a separate generator to power the pumps.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order increases the contract amount by $165,757.00 from $1,593,640.00 to $1,759,397.00.

COMMISSION RESOLUTION NO. 4785
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH DLM CONTRACTING,
INC., BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 1st day of August 2016, authorize award of the bid for
the South University Area Sewer Main Interceptor project, to DLM Contracting, Inc., Bozeman, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and DLM Contracting, Inc., as contained in Change Order No. 2, attached hereto, be
and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such
signature.
PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 20th day of March, 2017.
