The Commission of the 01ty of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, March 30, 1960 at 1:00 o'clock p.m. .t'resent
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting,
I Ass't. Manager Fryslie, City Attorney Lovelace and the Clerk.
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Bids for Restoration of City Swimming Pool Boiler Room
The award for the contract for the restoration of the City ~imming Pool was
deferred until April 6th pending a clarification of proposed substitutions for the
various types of equipment.
Ordinance No. 821 ~- Vacating
The City Attorney, as instructed, has prepared an ordinance vacating a portion
of an Alley in Block "C", Original Townsite of the City of Bozeman. Ordinance
No. 821 was presented, entitled:

AND REPEALING ORDINANCE NO. 808 OF SAID CITY
OF BOZEMAN
I It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
the ordinance be passed and adopted and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sioner Sedivy; those voting No, none.
Preliminary Draft of Proposed Ordinance Establishing a Dog and Animal Control Law
A preliminary draft of a proposed ordinance to further establish a dog and animal
control law for the City was read. The Commission informally disoussed the draft
with interested parties on the matter who were present at the meeting, then placed
the draft in the hands of the City Attorney with the request that the ordinanoe be
revised to incorporate suggested changes and for the further consideration of the
Commission.
Request -- Change in Procedure of Operation of Ambulance
Lyman H. Bennett and Earl Dawes, representing the Bozeman Chamber of Commerce,
appeared before the Commission to again present the Chamber of Commerce's request for
a change in the procedure of operation of the local ambulance, and suggested that the
I operation of the ambulanoe be turned over to the city fire department and operated
as a city-county venture. The matter was discussed at length. The Commission re-
quested more information concerning the contract between the Gallatin Ambulance
Service and the City Taxi Service, pr~ce schedules, records of calls (both as to City
and County calls), and Mr. Bennett and Mr. Dawes replied that the information as re-
quested would be furnished and the matter would be given further attention with the
Ci ty Manager.

Request -- MSC Senior Class to Place a Marquee at the Intersection of 8th and Main St.
Arjay Godston, president of the senior class at Montana ~tate College, accom-
panied by several persons representing various organizations and departments of the
college appeared before the Commission to request that it reconsider its denial of
their request for permission to place a Marquee Sign at the intersection of South
Eighth Avenue and Main Street. The Commission was informed that the plans of the I
Marquee had been redesigned and could be moved on notice by the City to another
loca tion. The Commission requested an additional week to further study the matter.
Request -- Building Permit -- E. C. McAtee
Mr. E. C. McAtee appeared before the City Commission and stated that because
his property at 611 E. Lamme Street being only 50ft. x 60ft., and located within a
"c" Zone did not meet the minimum lot area requirement of 5,000 square feet for that
zone, he would be denied a permit for the construction of a dwelling on that site.
He con tended tha t this zoning requirement crea ted a "hardship on the land" .and
therefore requested an exception to urdinance No. 813 be granted in order that the
construction of a dwelling at the site could be permitted. It was moved by Commls~
sioner Staudaher, seconded by Commissioner Sedivy, that, upon submission of an
application in proper form, an exception to Ordinance No. 813 be granted as to
mininmm lot area requirement and the ~ilding Inspector be authorized to issue a
building permit for the construction of a residence on this property contingent
upon any authorized construction on the site meeting full side yard requirements and
the motion was carried by the following Aye and No vote: those voting Aye being I
Mayor Swanson, Commissioner Staudaher and Commissioner Sed1vy; those votin No, none.
Reinvestment of Water Funds
There was presented a report of the Director of Finance that $70,000.00 of
Water Funds invested in U.S. Treasury BilLS would mature on April 16, 1960, and
would be available for reinvestment in like securities. Upon the recommendation
by the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner
Staudaher, that the reinvestment of these funds in the apprOXimate amount shown be
authorized and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those
voting No, none.
Authority to Travel -- Recreation Director White to Sun Valley
Notice has been received that the Northwest Recreational Conference will be
held at Sun Valley, Idaho, April 10-12, 196U. 'l'he City Manager recommended that
Recreational Director Glen White be authorized to attend the Conference. It was
moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that, it being in
the public interest, Mr. White be authorized to attend this Conference at Sun Valley I.
and that his expense incurred by such attendance be paid from the Park Recreational
Fund and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, ttone.
Cancellation of Plumbers & Gas Fitters Bonds -- Anderton Electric, Belgrade
A written request from Mac T. Anderson, Agent, that the Plumbers and Gas Fitters

Bonds of Anderton Electric, Belgrade, be cancelled was presented. It was moved by
Commissioner Sedivy, seconded by Commissioner Staudaher, that the bonds be cancelled
as of April 1, 1960, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;
those voting No, none.
I Continuation Certificate for Frank J. Trunk & Son
Continuation Certificates for a Plumber's License Bond and Gas Fitters License
Bond for Frank J. Trunk & Son were presented. The certificates were approved as to
form by the City Attorney. It was moved by Commissioner Staudaher, seconded by
Commissioner Sedivy, that the certificates be approved and accepted and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
Resume Work -- S.I.D.'s No's. 408 and 409
Construction work on storm drainage Special Improvement Districts No's. 408 and
409 having been suspended during the winter months at the direction of the Commission,
a letter from Wayne W. Dean, Project Engineer for Harold Hoskins and Associates,
Engineers, was read stating that conditions would now permit work on the two pro-
jects to be resumed and recommended that the -City notify Haggerty-Messmer Co., con-
tractor on the projects, to resume construction operations on or before April 6th.
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the
contractors be notified as recommended and the motion was carried by the folloWing

Commissioner Staudaher; those voting No, none.
Assignment -- J. W. Flynn & Co. on Contract Purchase of Butler Steel Building
As assignment whereby J. W. Flynn & Co. assigns all money due from the City of
Bozeman on a contract purchase of a Butler Steel building, contract dated November
9, 1959 , to Union Bank and Trust Co., Helena, Montana was presented to the Commis-
sion for approval. It was moved by Commissioner Staudaher, seconded by Commissioner
Sedivy, that this assignment be accepted by the City and the Mayor and the Clerk be
authorized to sign the acceptance for the City and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Staudaher and Commissioner Sedivy; those voting No, none.
Adjournment
There being no further business to comebef'ore the Commission at this time, it
was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those vot-
ing Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
I voting No, none.
