Resolution 4782, Westside Construction Budget Amendment Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Craig Woolard, Director of Public Works SUBJECT: Westside Street Improvement Project Overview AGENDA ITEM TYPE: Informational MEETING DATE: March 20, 2017 BACKGROUND The City is proposing a Westside Street Improvement Project (Westside Project) that will complete, as a single construction project, complete sections of Oak Street, Ferguson Avenue and Flanders Mill Road. This project is a cooperative approach between the City, Flanders Mill, LLC (the developer of the Flanders Mill Subdivision), and Bozeman School District 7. This memo provides a general overview of the project, outlines the scope of the project, the financial responsibilities of each party and describes the benefits to the citizens of Bozeman. Specific agreements with the parties involved are provided as separate Commission action items. This memorandum is intended to provide an overview of four agenda items included on the March 20th agenda. These include: • Resolution 4782, a budget amendment to fund the City’s portions of the Westside Project; • Resolution 4771, a resolution of intent to create a special improvement district for financing the local share of the north side of Oak Street and the east side of Ferguson Avenue along the south and western perimeter of the Gallatin County Regional Park; • Authorizing the City Manager to sign a payback agreement with Bozeman School District 7; and • Authorizing the City Manager to enter into a payment and payback agreement with Flanders Mill LLC for construction of the Westside Project. 326 PROJECT OVERVIEW The Westside Project consists of the following four elements (shown schematically in the attached figure). 1. Completion of Oak Street from New Holland Avenue to Ferguson Ave. This project completes Oak Street to Ferguson Avenue to its final cross section (i.e., four-lane arterial with separated median), constructs a roundabout at Oak Street and Davis Lane, and constructs a signalized intersection at Oak Street and Ferguson Avenue. 2. Construction of Ferguson Avenue from Oak Street to Baxter Lane to an urban collector standard. 3. Construction of Flanders Mill Road from Sunstone Drive to Oak Street to a local street standard. 4. Construction of Flanders Mill Road from Oak Street to Baxter Lane to a local street standard. All of these improvements were identified in the City’s Transportation Master Plan and Capital Improvement Plan or will be required as development related improvements required as part of the Flanders Mill subdivision, future development of the Bozeman School District property identified as the future high school, existing and future development of the Gallatin County Regional Park and buildout of the City Sports Park. Rather than build each of these elements as a separate capital project or in phases as development progresses, the proposed Westside Project combines these roadway improvements as one project to be constructed and completed in 2017. Advantages to this approach include: • The project results in complete, fully functional roadways ready for service. The City’s normal approach would result in phased roadway construction leaving partially completed roadways. • The project will significantly reduce the time required to place these critical roadways in service relative to the City’s normal phased approach. • By combining the projects, only one contractor will be on site thus simplifying project phase coordination and improving efficiency. • By combining City projects and accelerating the construction required for public and private development in this area, a substantial improvement to the transportation system will completed rapidly and with minimal disruption to the travelling public during a single construction season. PROJECT DETAILS The City has worked with Flanders Mill, LLC and its contractor Sime Construction, to negotiate construction costs for all segments of the Westside Project. Proposed construction costs are reasonable in the view City of Bozeman Engineering staff. A single construction agreement between the City and Flanders Mill, LLC specifies the roles and responsibilities of each party to complete the Westside Project. 327 The Westside Project utilizes funds directly from Flanders Mill, LLC, from the City, street impact fees, arterial and collector district funds, and TOPS funds to fund construction. In addition to the payback requirement contained in the payment and payback agreement (see agenda item), payback districts will be established to recoup the local share costs of roadways required as part of the subdivision (i.e, west side of Ferguson Ave. and east side of Flanders Mill Road between Oak Street and Baxter Lane). A special improvement district (SID) will be established to recoup the costs of improvements to the local shares of Oak Street and Ferguson Avenue that are the responsibility of Gallatin County. The attached figure shows each segment of the Westside Project. Below is a breakdown of the costs of each segment and which entity is responsible for costs associated with a segment. • Oak Street from New Holland Avenue through the Ferguson Avenue intersection has a total construction cost of $3,890,674.00 (this includes $175,000 oversight costs paid directly to the City’s engineer for Oak Street improvements). The roundabout at Oak Street. and Davis Lane ($1,949,782.00) and the signalized intersection at Oak Street. and Ferguson Avenue. ($531,300.00) will be paid for with City impact fees and arterial and collector district funds (80% impact fees/20% arterial and collector funds). The section of Oak Street. between the intersections ($1,409,592.00 total cost) will funded with impact fees and arterial and collector district funds. 50% of the cost of this section of Oak Street ($704,796.00) will be assessed to Gallatin County through creation of an SID. Construction administration of Oak Street and the intersections will be completed by the City’s engineering consultant and paid for directly by the City. • Ferguson Avenue from the intersection at Oak Street to the intersection at Baxter Lane has a total construction cost of $1,116,075.00. Construction of this section will be funded using City impact fees and arterial and collector district funds. The agreement requires Flanders Mill, LLC to reimburse the City for its local share of the costs of this construction on a per-plat proportional basis prior to final plat of a phase that is adjacent to this road segment (phases four and five). In addition, a payback district will be established for this road segment to reimburse the City for the share of Ferguson Avenue associated with subdivision development ($401,390.00). The portion of Ferguson Avenue fronting the Regional Park will be assessed to Gallatin County through creation of an SID ($357,342.50). Construction administration of Ferguson Avenue will be completed by the Flanders Mill, LLC’s engineering consultant. • Flanders Mill Road from Sunstone Drive to Oak Street has a total construction cost of $609,542.00. Flanders Mill, LLC will fund $304,771.00 of the construction cost as part of their development related improvements for phase 3 of the subdivision. The remaining 50% ($304,771.00) of the construction costs are ultimately the responsibility of the Bozeman School District. Initially, these costs will be paid by the City using City of Bozeman Revolving Funds. An interlocal agreement specifying terms of repayment by BSD has been developed and is on this evening’s agenda. Construction administration of Flanders Mill Road will be completed by the Flanders Mill, LLC’s engineering consultant. 328 • Flanders Mill Road from Oak St. to Baxter Lane has a total construction cost of $1,072,066.00. TOP Bond funds will be used to construct the entire roadway. The agreement requires Flanders Mill LLC to reimburse the City for its local share of the costs of this construction on a per-plat proportional basis prior to final plat of a phase that is adjacent to this road segment (phases six and seven). In addition, a payback district will be established for this road segment to recoup the share of the roadway associated with the subdivision ($558,726.00). Construction administration of Flanders Mill Road will be completed by the Flanders Mill, LLC’s engineering consultant. ALTERNATIVES: As suggested by the City Commission. UNRESOLVED ISSUES: Staff will return to the Commission with resolutions to create the payback districts described in this memorandum. 329 330 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Anna Rosenberry, Assistant City Manager SUBJECT: Resolution No. 4782 - AMENDING THE CITY’S ANNUAL BUDGET FOR THE STREET IMPACT FEE FUND, ARTERIAL & COLLECTOR DISTRICT FUND, AND THE SPECIAL IMPROVEMENT DISTRICT REVOLVING FUND TO INCREASE APPROPRIATIONS BY A TOTAL OF $5,311,520 FOR THE FISCAL YEAR ENDING JUNE 30, 2017 TO COMPLETE VARIOUS STREET AND INTERSECTION PROJECTS. AGENDA ITEM TYPE: Action MEETING DATE: March 20, 2017 RECOMMENDATION: Approve Resolution No. 4782 SUGGESTED MOTION: I move to approve Resolution No. 4782 - AMENDING THE CITY’S ANNUAL BUDGET FOR THE STREET IMPACT FEE FUND, ARTERIAL & COLLECTOR DISTRICT FUND, AND THE SPECIAL IMPROVEMENT DISTRICT REVOLVING FUND TO INCREASE APPROPRIATIONS BY A TOTAL OF $5,311,520 FOR THE FISCAL YEAR ENDING JUNE 30, 2017 TO COMPLETE VARIOUS STREET AND INTERSECTION PROJECTS. BACKGROUND: **Westside Project Financial Exhibits attached to this memo summarize information relating to total project financing, including this budget amendment.** 331 The city has numerous west-side street and intersection projects listed on the approved Capital Improvement Plan for Street Impact Fees and Arterial & Collector District funds in FY18. We also have carry-over budget for a portion of roads as part of the Sports Park project on the west side of town. Work has been done with Flanders Mill, LLC, School District #7, and Gallatin County to bring about the construction of four different CIP projects, the Flanders Mill Road section of roadway adjacent to the Sports Park, and a portion of Flanders Mill Road adjacent to School District #7 property. Total cost for all of the projects is $6,688,357.00 (see Westside Project Financial Exhibits, page 2) In order to proceed with signing the related agreements, we are bringing forward the full budget amendment necessary to fund the project in FY17. Construction is anticipated to occur in spring, summer, and fall of 2017; spanning FY17 and FY18. Amended amounts not expended until FY18 will be covered by our annual carry-over capital provision of the FY18 Appropriation Resolution. Flanders Mill LLC is responsible for paying these costs directly to the contractor as part of their current project. No budget amendment is necessary for these TOP Bond items. They were previously planned for with the Sports Park project infrastructure, and budgeted in FY15. UNRESOLVED ISSUES: None. ALTERNATIVES: Do not build this project at this time. Build the city-only portions of the projects one-by-one after the FY18 budget is approved. FISCAL EFFECTS: The budget amendment will increase the authorized expenditures (appropriations) in the Street Impact Fee, Arterial & Collector District, and the Special Improvement District Revolving Funds. Increased Arterial & Collector District assessments (according to the Capital Improvement Plan) will be necessary in FY18. Street Impact Fee Fund: The Street Impact Fee fund appropriations will increase by $3,047,004 in FY17. We are not proposing adding more projects to the list, just moving ahead with these projects a few months earlier than expected. There is cash available in the Street Impact Fee fund for all of these appropriations. Arterial & Collector District Fund: This fund’s appropriations will increase by $1,959,744.50 as a result of this budget amendment. All of the projects that are being amended to FY17 were listed on the FY18 Capital Improvement Plan. We are not proposing adding more projects to the list, just moving ahead with these projects a few months earlier than expected. There is currently $742,000 in cash available in this fund. As described in the Capital Improvements Plan, in order to fund these additional expenditures (and the other items on the capital improvement plan) assessments will need to increase by 90% in the coming year. Due to the timing of project expenditures, we anticipate the FY18 increased assessments will closely match the spend-down of cash in the fund. Payback: The first three segments referenced above will be paid back to the Arterial & Collector District. Flanders Mill LLC will reimburse $401,390, plus interest, within 3 years of this project completion. Gallatin County will reimburse $1,062,138.50, plus interest, under the terms of the special improvement district (SID) assessments. Special Improvement District (SID) Revolving Fund: The City’s SID Revolving Fund has excess cash on hand ($2.66 Million in excess of state requirements). We have used this money in the past to help fund the SID’s created for reconstruction of local streets. Under an Interlocal agreement with School District #7, we are proposing using this funding, if necessary, to help facilitate the full construction of Flanders Mill Road this summer. This money will be deposited back to the Revolving Fund within 3 years. Because this is a local street in front of non-city property, we did not have this project in our Capital Improvement Plan. TOP Bond Fund: Informational. Not a part of the budget amendment. As a part of the infrastructure planning for the Sports Park property, $1,788,000 of Trails, Open Space, and Parks Bond Fund money had been budgeted for the water, sewer, and street infrastructure surrounding the park. Through capital improvement planning processes in FY16, $962,250 had been dedicated to street improvements on Flanders Mill Road. Approving this construction project will require $1,072,066 for the Flanders Mill Road improvements, with $558,726 being paid-back with interest from Flanders Mill, LLC within 3 years of this project completion. As a result, once completely paid back, the TOP Bond fund will have less-than-expected net costs for Flanders Mill Road improvements (estimated savings of approximately $400,000.) We are not proposing a budget amendment to the TOP Bond Fund because the total amount fits within the infrastructure amounts already budgeted. WHEREAS, the City Commission did, on the 20th day of June, 2016, after due and proper legal notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2016-2017 (Fiscal Year 2017); and WHEREAS, the City Commission did, on the 3rd day of October, 2016, and on the 23rd day of January, 2017, after due and proper legal notice, conduct public hearings and amend the municipal budget for Fiscal Year 2016-2017 (Fiscal Year 2017) Street Impact Fee Appropriations; and WHEREAS, the City Commission did, on December 5, 2016 approve the Street Impact Fee and Arterial & Collector District Capital Improvement Plans for Fiscal Years 2018-2022; and WHEREAS, such Capital Improvement Plans contained projects to consider for funding in the Fiscal Year 2018 budget for the construction of SIF046 - Oak Street (New Holland to Ferguson), SIF080 - Ferguson Avenue (Baxter to Oak), SIF074 - Intersection of Davis & Oak Street, and SIF061 - Intersection of Ferguson & Oak Street; and WHEREAS, the City’s Trails, Open Space, and Parks fund has previously budgeted to construct Flanders Mill Road (Oak to Baxter); and 336 Resolution 4782, Westside Street Improvement Project (Flanders Mill) Budget Amendment Page 2 of 4 WHEREAS, portions of these project costs will be recouped by the City through payback agreements and the creation of a Special Improvement District, and WHEREAS, finding that excess dollars exist in the City’s Special Improvement District Revolving Fund, it is in the best interest of the City to utilize a portion of available Special Improvement District Revolving Fund excess dollars to complete the construction of Flanders Mill Road (Sunshine Street to Oak.) Such construction will be reimbursed to the Special Improvement District Revolving Fund by an inter local agreement for payback from School District #7; and WHEREAS, the need has arisen to begin construction of the above described projects in Fiscal year 2017. Section 3 Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full force and effect on July 1, 2016.
