The Commission of the City or Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, April 6, 1960 at 1:00 o'clock p.m. Present
were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager
Cutting, Ass't. Manager Fryslie, City Attorney Lovelace and the Clerk. I
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none.
Bid Awarded -- Restoration of City Swimming Pool Boiler Room and Alternates
Final action on the award of contract for a new boiler, boiler room, and
restoration or the present building at the City Swimming Pool having been delayed
until this da te, the City Commission referred to the recommendation submitted by
R. L. Prussing of Billings, mechanical engineer for the project. Mr. Prussing rec-
ommended that F. L. Dye Company of Bozeman be awarded the contract under the follow-
ing terms:

With the exception of the awarding of Alternate No. One (1), the City I
Manager concurred with the above recommendation. It was then moved by Commis-
sioner Staudaher, seconded by Commissioner Sedivy, that F. L. Dye Company be
awarded the contract as follows:

and, tha t , the "Bid or Proposal Bond" in the amount of five (5) per cent or the

the bidding, and the bid security of the unsuccessful bidders be returned and the
motion was carried by the rollowing Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those vo ting No,

Claims for the Month of March, 1960
Claim No's. 7688 to 7959 inclusive were presented on the various funds as
follows:

The Manager stated that he has audited these claims and finds them to be
true and lawful claims against the City of Bozeman and recommends that warrants
be issued for their payment. After examination of the claims in detail and

checking against the claim register, it was moved by Commissioner Sedivy, seconded
by Commissioner Staudaher, that the claims be approved and warrants issued for
their payment and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;
those voting No, none.
I Sale of Special Improvement District Bonds No's. 406, 410, 411, 412 and 415
This was the time and place set for sale of bonds of Special Improvement
Districts numbered 406, 4l0, 411, 412 and 415. Affidavits of publication of sep-
arate notices of sale of the bonds of each of the above numbered districts were
presented. The following bidders were present:

premium bids.
Mayor Swanson announced the Commission was ready to hear oral bids for the bonds

A sealed bid submitted on this issue with the Clerk of the Commission was
opened and the bid of 5.4% of National Securities represented by Charles McIntyre
was placed on record. The oral bid of Arnold Huppert being the lowest and best I
bid, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that
it be accepted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy;
those voting No, none.
The Mayor announced the Commission was ready to hear oral bids for the bonds
of Special Improvement District No. 4l2. The lowest oral bid of each bidder was

Sale of the bonds of Special Improvement Districts numbered 406, 410, 411,
412 and 415 having been completed, it was moved by Commissioner Sedivy, seconded
by Commissioner Staudaher, that the bid securites of the unsuccessful bidders be
returned and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj
those voting No, none.
Public Hearing -- Special tmprovement District .0. 416 I
Resolution No. 972 creating S.I.D. #416
This was the time and place set in Commission Resolution No. 970 for hear-
ing protests to creation of Special Improvement District No. 416. Affida vi t of -
publication of Notice was presented together with the Clerk's Mailing Certificate
that all property owners have been notified. No written protests having been
filed and no one being present to be heard to protest, Resolution No. 972 creating

It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that
the res'olu tion be passed and adopted and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commis-
sioner Staudaher; those voting No, none.
Engineering for S.I.D. No. 416
Based upon an agreement for a rlContrsct for Engineering Services"; entered into
between the Cit~ and Harold Hoskins & Associates, Engineers, on July loth, 1957, it
was recommended that Harold Hoskins & Associates be directed to proceed with the engi-
neering services required for the preparation of plans and specifications and for the
construction of Special Improvement District No. 416.
It was moved by Commissioner Jedivy, seconded by Commissioner Staudaher, that
Hoskins & Associates be directed to furnish the engineering services as recommended
I for this improvement district and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner
Staudaher; those voting No, none.
Request -- Quit Claim Deed to Parcel of Land on East Babcock Street
Arthur Thompson, Attorney, appeared before the City Commission to place a re-
quest of the Securities Building Corporation that the City prepare a resolution to
Quit Claim a small parcel of land on East Babcock Street to the Corporation for the
purpose of clearing title to the tract. The Commission deferred the matter until the
next regular meeting to allow time for an investigation of the matter by city officials.
Request -- Remove Street Lamp Fost at 24 N. Willson
Mr. Rolfe of Rolfe and Wood appeared before the Commission to request the re-
moval of a street lamp post at 24 North Willson. Mr. Rolfe stated that his firm is
remodeling the present building on the site, and, plans for which include more than
equivalent iilumination, the lamp post as it now stands would be directly in front
of the proposed location of the front door.
It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, tha t the
I request be granted and, tha t , the post would be removed by the City at the expense of
Rolfe and Wood, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none.
Authority to Travel -- Various City Officials
Notice has been received that the joint annual conference of the Montana section
of the America Water Works Assn. and the Montana Sewage and Industrial Wastes Assn. is

scheduled to be held in Billings, Montana, April 28-30, 196U. Upon the recommendation
of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner
Staudaher, that, it being in the public interest, the Ma yor , the Commissioners, the
Superintendent or the Ass't. Superintendent of the Water Department, the City Engi-
neer and the Assistant City Manager be authorized to attend this Conference and that
the expense of the delegates incurred by such attendance be paid out of the Water I
Fund and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those voting
No, none.
Request -- MSC Senior Class to Place a Marquee at the Intersection of 8th and
Main Street
Arjay Godston, ~resident of the senior class at Montana State College, and several
of his fellow sbldents appeared before the Commission to again request that it re-
consider its denial of permission to place a Marquee Sign at the intersection of
South Eighth Avenue and Main Street as a senior class project. The Commission
again discussed the matter at length with the group and, emphasizing that the City
did not object to the project itself, declined to reconsider its action deny-
ing their request to place the marquee in the area of the intersection of Eighth
Avenue and West Main Street.

Adjournment
There being no further business to come before the Commission at this time, it
was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj
those voting No, none.
