HomeMy WebLinkAbout1960-04-13 227 Bozeman, Montana April I), 1960 The Commission of the City of Bozeman met in regular session in the Commis- sion Room, City Hall Building, Wednesday, April l), 1960 at l:OO o'clock p.m. Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City I Manager Cutting, Ass't. Manager Fryslie, City Attorney Lovelace and the Clerk. Minutes of the last regular session were read and it was moved by Commis- sioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Bond & Contract -- Restoration of City Swimming Pool Boiler Room and Alternates Bond and contract of F. L. Dye Company for construction of the Restoration of the City Swimming Pool Boiler Room and Alternates was presented. The bond and con- tract were approved as to form by the City Attorney and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Contract on Swimming Pool Boiler & Alternates -- Change Order #1 I Change Order No. 1 to plans and specifications incorporated in the contract awarded F. L. Dye Co. for the restoration of the Swimming Pool Boiler Room and Alter- nates was presented providing for a substitution of boiler equipment at a reduction of cost of $1,800.00. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the Change Order be approved and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Airport -- Purchase of Permanent Easement from State of Montana Howard Nelson, city appointee and secretary of the Gallatin Field Board, appear- ed before the Commission to present a report on the Board's program for the improve- ment and expansion of the City-County airport. Mr. Nelson stated that the Board still proposes the securing of a permanent easement to 80 acres of state-owned land to pro- vide a roll-over area at the north end of the main runway. It was moved by Commis- sioner Sedivy, seconded by Commissioner Staudaher, that the Commission reafirm the action of the City Commission of March 4, 1959, and the Director of Finance be author- ized to issue a warrant in payment for the City'S share of the purchase of this I easement on the date the transaction is completed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Dogs -- Proposed Ordinance to Control Dogs and Animals The Commission again discussed with interested parties who appeared at the meet- ing the matter of the control of dogs and other animals within the City. Several of the group present spoke in opposition to a "leash law." Other than a general dis- cussion, no action was taken. 228 Bids for Copper Pipe This was the time and place set for opening bids on copper pipe for the Water Department. Crane & Ordway 2,123.86 Northwest Pipe 2,219..56 Waterworks Supply 2,114.40 After tabulation and checking by the City Engineer, it was moved by Commis- sioner Staudaher, seconded by Commissioner Sedivy, that the bid of the Co-op Lead & Chemical Company be accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis- sioner Sedivy; those voting No, none. Resolution No. 973 -- Quit Claim a Triangular Strip of Land on East Babcock Street . For the purpose of. clearing title to a small parcel of land on East Babcock Street, Resolution No. 973 to provide that the Mayor and the Clerk of ' the City Commis- sion be authorized to execute a Quit Claim Deed to Security Building, Inc. was pre- sented, entitled: 1 COMMISSION RESOLUTION NO. m A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE MAYOR AND THE CLERK OF THE CITY COMMISSION TO EXECUTE A QUIT CLAIM DEED TO A CERTAIN STRIP OF LAND ALONG THE NORTH BOUNDARY OF EAST BABCOCK " STREET, IMMEDIATELY ADJACENT THERETO, APPHOXIMA'l'ELY 2L~o FEET LONG, EAST AND WEST, CO~~ENCING AT THE EAST LINE OF SOUTH BOZEMAN AVENUE AT WHICH POINT SAID STRIP IS APPROXI- MATELY 12.7 FEET WIDE, AND SAID STRIP BEING APPROXIMATELY 2.33 FEET WIDE AT THE EAST END THEREOF, TO SECURITY BUILDING, INC., A CORPORATION, THE PRESENT RECORD OWNER OF ADJOINING LANDS. .' The City Manager advised the Commission that the Q.uit Claim deed and resolution had been approved as to form by the City Attorney and the action, as requested, appeared to be in order. It was then moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be passed and adopted and the Mayor and the Clerk be authorized to sign the Quit Claim deed for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Authority to Travel -- Montana State Library Convention I Notice has been received that the Montana State Library convention is scheduled to ije held in Great Falls, Montana, May 6-8, 1960. Upon the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that, it being in the public interest, Margaret Hileman, Librarian, and Katherine Fisher, Ass't. Librarian, be authorized to attend this Convention J and the expense of the delegates incurred by such attendance be paid out of the Library Fund and the motion was carried by the following Aye and No vote: those j ')')9 ~"..d~ '- voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Request -- Advertise Jaycee Rodeo, April 19-20 The Commission considered a letter received from RichardE. Wahl, Jaycee rodeo chairman, requesting that his organization be granted permission to sponsor the .1 appearance of Jed Smith, tourist guide and outfitter, at 29 East Main, during the afternoons and a portion of the evenings on April 19th and 20th, for the purpose of advertising the annual Jaycee rodeo. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Warranty Deed -- Extending Brady Street North A Warranty Deed to transfer property from Margaret Jones to the City to extend Brady Street north 118.5 feet to the North line of Lot two (2), Block seven (7), Babcock & Davis Addition to the City of Bozeman, Montana was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the City accept the deed contingent upon the accuracy of the property description and that no street improvement work, beyond the establishing of the grade and location of the gutters be performed by the City, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. I Bond of Director of Finance -- Shadoan Bond of L. G. Shadoan as Director of Finance, in the amount of $60,000.00 was presented. The bond was approved as to form by the City Attorney. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Examination" of Depository Bonds The Commission proceeded to examine the Custodian's Receipts for Depository Bonds held by the Director of Finance as security for City funds deposited in Bozeman banks. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the securities be approved and a list thereof be set forth in full in the minutes of this meeting and the motion was carried by the fOllowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Sedi vy Commissioner storm Sewer Outlet North Ninth Avenue -- Letter The City Attorney, as instructed by the Commission at the request of Hal Bolinger, Jr., has reviewed all of the minute entries of the City Council meet- I ings from November 7, 1907 to December 5, 1907 and also the Agreement entered into by J. H. Durston and the City under date of September 15, 1908, as they concern drainage water on Eleventh Avenue, and is of the opinion there is nothing in these documents which concerns the drainage water now being released from Special Improvement District No. 409 at North Ninth Avenue and West Villard Street. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the City Manager be, and is hereby instructed to inform Mr. Bolinger by letter that based on these findings of the City Attorney, and because preliminary engineering studies had indicated a suggested plan for a continuation of this storm drainage system by means other than placing the entire flow underground to be not feaseable or desirable, the City Commission is standing on the position of the Commission taken at its meeting on November 4, 1959 stating there has been no increased burden placed on the property of either Mr. Bolinger or his clients as a result of storm drainage water being released at North Ninth Avenue I and West Villard Street, and that the City, therefore, cannot and will not pay the cost of extending this storm drainage system across to property owned or represented by Mr. Bolinger or any part thereof. The motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Co~~issioner Sedivy and Commissioner Staudaher; those voting No, none. 2:]1 Petition -- Close Portion of Lincoln Street A petition filed by adjoining property owners in the area requesting the City to close Lincoln Street between Grand Avenue and Fifth Avenue was presented, and action was deferred 1mtil a later date. I Special Meeting -- Proposed New Zoning Ordinance _ Mayor Swanson announced that a Special Meeting of the City Commission will be held at the regular meeting place Tuesday, April 19th, at 7:00 o'clock p.m. for the purpose of reviewing the proposed new Zoning Ordinance.
