HomeMy WebLinkAbout1959-09-09 12fJ Bozeman, Montana Sept. 9, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, Sept. 9, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following pro- ceeding were had: I Minutes of the last regular session were read and it was moved by Com- mmissioner Swanson, seconded by Commissioner Berg, that the minutes be approv- ed as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Termination - Resolution of Intention No. 956, Vacation of Streets & Alleys in Central Addition and Adjoining Areas Owned by Bozeman Deac. Hosp. At regular session of the City Commission, held August 16, 1959, the City Commission deferred action on Resolution No. 956, relating to the vacation of streets and alleys in Central Addition and Adjoining Areas Owned by the Bozeman Deaconess Hospital. Because of a diversity of opinion on legal points and proceedings, and pending contemplated changes by the petitioners in the dlscrip-- tion of streets and alleys desired to be vacated, Commissioner Swanson moved that further action on Resolution No. 956 and all proceedings in connection therewith cease. Commissioner Berg seconded the motion and the motion was carried by the fallowing Aye and No vote: those voting Aye being Mayor ErWin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Plans and Specification for S. I. D. No. 414 - Hyalite View Subdivision Plans and specifications covering proposed improvements in Special Improve- ment District No. 414 (Hyalite View Subdivision) were presented by John S. Bereman and Co., Cod~, Wyoming, Consulting Engineers representing the City of Bozeman. ~he Commission and City Engineer Liquin reviewed the plans in detail and discussed various phases of the proposed improvements. Subject to changes in the plans directed by him City ~gineer Liquin approved the same as to be in proper form for the purpose to publish a "Call for Bids" on the proposed improvements. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, subject to concurrent approval by the State Board of Health on the plans and specifications, the Clerk of the Commission be directed to publish a "Call for Bids" and the motion was carried by the followying Aye and No vote; those voting Aye being Mayor ErWin, Commissioner Berg and Commissioner ~ Swanson; those voting No, none. Bonds for S. I. D. No. 414 - Hyalite View Subdivision I Bonds of Special Improvement District No. 414 must be sold to prOVide funds for construction in this district. It was moved by Commissioner ~anson, seconded by Commissioner Berg, that the Clerk of the Commission be directed to advertise for bids for the sale of the bonds in this district in the approx- imate amount of $330,000.00 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, CO~1s8ion.r Swanson and Commiss- ioner Berg; those voting No, none. ...i"'lI ,,,,;' 127 Claims for the Month Claims Nos. 5684 to 5983 inolusive were presented on the various funds as follows: General $16,964.89 Garbage 4,719.98 Street 10,286.50 Police Res. 558.53 Water 7,402.16 Cem. Suspense 280.00 S.D.S. 3,534.39 Planning 271.40 Library 1,831.62 C.P. Care 301.58 I Park 6,748.93 P. L. Fund 2,000.00 Cemetery 3,272.67 R.E.R.S. 840.11 Band 2,676.84 S.I.D. 65.73 Tots 1 $62,832.51 The Manager stated that he has audited these claims and finds them to be true and lawful claims against the City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail by the Commissioners and checking against the Claim Register, it was moved by Commiss- ioner Berg, seconded by Commissioner Swanson, that the claims be approved and warrants drawn for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Reports The following reports for the month of August, 1959 were presented: Fire Chief Sewage Plant Uperator Cashier Water Collector Police Judge Chief of Police Librarian I It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: Those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Proposed Temporary Housing for Fire Fighting Equipment Fire Chief Pentilla was present and discussed possibility of storing at least one piece of present fire equipment at some location other than the Oity Hall. His point was that another earthquake might shake down the walls of the City Hall and prevent getting fire equipment out. The matter was discussed at length, it was recognized that the point raised by the Chief had merit, but it was not considered to be of such critical nature as to require action at this time. Swimming Pool Fire - City Manager Henderson to Act as Agent of City The City Manager presented recommendation from the General Adjustment - Bureau, Inc. that an agent of the City be officially appointed with power to sign "Proofs of Loss" and other documents pertaining to losses at the Swimming I Poll Fire which occurred July 14, 1959. He, also, presented proposed "Proofs of Loss" to be submitted to insurers of the City in an aggregate amount of $13,758.19. He presented the fOlloWing resolution: "RESOLVED that M. E. Henderson, City Manager, be, and he hereby ls, appointed and constituted the lawful a~ent of the City of Bozeman, a municipal corporation, with ful power to act for said City in all matters pertaining to the adjustment, compromise and settlement of all claims for losses sustained, or to be sustained by said City by reason of the fire which occurred on or about the 13th day of July A. D. 1959, including all claims against the Fire Insurance Companies interested in said losses, and to execute for said City in its name or otherwise, all documents, appraisal and 128 - other agreements, proofs of loss, receipts and releases as may in his judgment be necessary or desirable in the premises." It was moved by Commissioner Berg, seconded by Commissioner Swanson that, this the foregoing resolution be passed and adopted and the motion was carried by the fOllowing Aye and No vote. Those voting Aye being Mayor Erwin, Commiss- ioner Berg and Commissioner Swanson; those voting No, none. Polution - Polution of Bozeman Creek and Rocky Creek I A letter was presented from the State Board of Health relative to a study and Rocky Creek made by Bruce Hanes of that Department of stream polution of Bozeman Creekf The City Manager was instructed to carry out the recommendation in that letter so far as is practicable. It was pointed out that most of the conditions on which the report made comment should be corrected by the Board of Health rather than the Oi ty of Bozeman. Establishment of School Crossing at 11th and Dickerson Based on a study conducted by his Department, acting Chief of Police Davis has recommended that a "School Crossing~ be esta~lished at 11th and Dickerson Street. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be authorized and instructed to publish an order for chang- ing the required schedule in Ordinance No. 768 to carry out the recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Request of D. F. DeLap for Auction House on East Main - Rejected I A letter was presented from Mr. D. F. DeLap stating that he was consider- ing leasing his property on East Main Street for use as an auction yard and requesting permission to move a 14' x 20' frame building onto the property for temporary use in connection with such auction yard. The undesirability of such an operation was discussed by the Commission and, because of past experience with such operations, it was moved by Commissioner Swanson, seconded by Commiss- ioner i'erg, that Mr. DeLap's request be denied and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Special Meeting for Consideration of Zoning Ordinance Revisions City Attorney Lovelace is preparing a draft of a proposed new zoning ordinance which will be ready for review September 14th. In view of the extensive time expect- ed to be required for consideration of this ordinance, Mayor Erwin announced that a Special Meeting of the City Commission will be held at the regular meeting place Monday, September 14th, at 3:30 o'clock P. M. for the purpose of considering this I proposed ordinance.
