HomeMy WebLinkAbout1959-09-16 1:10 Bozeman, Montana Sept. 16, 1959 The Commission or the City or Bozeman met in regular session in the Commis- sion Room, City Hall Building, Wednesday, Sept. 16th, 1959 at 1:00 o'cloc P.M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session were read as well as those of the Special Meeting of Sept. 14th and it was moved by Commissioner Berg, seconded by Commission- er Swanson, that the minutes be approved as read and the motion W~B carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Sale or Special Improvement ~istrict Bonds Nos. 408 and 409 This was the time and place set for sale of bonds of Special Improvement Districts numbered 408 and 409. Affidavits of publication of separate notices of sale of the bonds of each of the above numbered districts were presented. 'lhe following bidders were present: BID D E R R E PRE S E N TIN G J. J.) . Each bidder qualified himself by depositing bid security with the Clerk of the I Commission. ~here being no sealed bids filed with the Clerk, Mayor Erwin announc- ed the Commission was ready to hear oral bids for the bonds of Special Improve- ment District No. 408. The lowest bid of each bidder was as follows: - BIDDER INTEREST RATE J. D. Street 4.80% Walter L. Sales 5.20% R. I. Diefenderfer 5.40% Arnold Huppert 4.75% Brooke Hartman 5.75% The bid of Arnold Huppert being the lowest and best bid, it was moved by Oommissioner Swanson, seconded by Commissioner Berg, that it be accepted and the .... bid securities returned to the unsuccessful bidders and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, CommiS- sioner Swanson and Commissioner Berg; those voting No, none. C.P.A. Examination & Report of Water Dept. - 1959 The 1959 report of the examination of the records and operations of the City Water Department prepared by H. H. Kirchhoff, C. P. A., was presented to the Coromis- I slon. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the report be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg, and Commis- sioner Swanson; those voting No, none. New Petitions to Vacate Certain Streets and Avenues, and all Alleys in Central Addition and Adjoining Areas Owned by Bozeman Deaconess Hospital New petitions of the Bozeman Deaconess Hospital Board for certain streets and avenues and all alleys to be vacated in Central, Prospect Hill, Highland and Valley View Additions were placed before the Commission. It was moved by Commis- sioner Swanson, seconded by Commissioner Berg, that the City Attorney be instruct- ed to prepare a Resolution of Intention vacating the foregoing and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Police Commission - Appointment - - Loren p. Hardie The nomination of Loren F. Hardie to be a member of the Police Commission of the City of Bozeman to fill the unexpired term of Henry M. Gay, deceased, I which term expires April 30, 1961, was announced by City Manager Henderson. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the above appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,. Commissioner Swanson and Commissioner Berg; those voting No, none. Resolution No. 959 - Sprinkling Assessment Resolution No. 959, levying the assessment in the amount of $2,532.67 for street sprinkling for the year 1959 was presented, entitled: A RESOLTTTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESS- ING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF. THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1959. It was moved by Commissioner Swanson, seconded by Commissioner Berg, tha t the resolution be provisionally adopted and September 23rd, 1959 be set as the date for hearing protests and the motion was carried by the following Aye and No vote: those votine Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Resolution No. 960 - Lighting Assessment Resolution No. 960, levying the assessment in the amount of $4,209.55 for various lighting districts for the year 1959 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEW,AN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT TO TIm PROVISIONS OF SECTIONS 11-2252 R.C.M. 1947. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the resolution be provisionally adopted and September 23rd, 1959 be set as the date , 1:32 for hearing protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Purchase of Curb Boxes City Manager Henderson stated that W. R. Border, Superintendent of the Water Department, has notified him of need for fifty (5U) curb boxes at an approximate I cost of $428.50. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be authorized to purchase the foregoing for the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Requisition for S. R. DeBoer & Co. A requisition from S. R. DeBoer & Company as basis for it to secure final payment on the contract between that company, the City of Bozeman and the Montana State Planning Board in the amount of $1,066.48, being payment due DeBoer and . Company for services rendered for the period November 1, 1959 to June 1, 1959 was presented. The City Manager stated that this payment will be made by the Montana State Planning Board, the City havi~g fulfilled its part of the contract either by cash payment or in services rendered on the planning project by City employees. It was moved by Commissioner Berg, seconded by Commissioner Swanson, tha t the requisition be approved and that the Mayor and Clerk be authorized to sign the same for the City of Bozeman and the motion was carried by the following Aye and I No vote: those voting Aye being Mayor ErWin, Commissioner Berg and Commissioner Swanson; those voting No, none. Claims - W. D. Howells - Sidewalks Built Adjacent to City Owned Properties Claims of W. D. Howells for constructing sidewalks adjacent to city owned properties were presented as follows: General Fund - City Hall 2,271.91 Park Fund - Lindley Park $675.50 Bogert Park 429.5U 1,105.00 The City Manager stated that the claims are in accordance with the contract price of the 1959 contract with Mr. Howells for construction of miscellaneous walks and curbs and the City Engineer has certified the amounts c~almed as correct. It was moved by Commissioner Serg, seconded by Commissioner Swanson, that the claims be approved and the Clerk directed to issue warrants in payment thereof and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,' Commissioner Berg and Commissioner Swanson; those voting No, none. I Authorization for Travel by City Manager City Manager Henderson requested authority to travel to Provo, Utah, on or about September 23, 1959 to confer with officials of the Pacific States Cast Iron Pipe Company on problems pertaining to pipe purChased by the City from that Company. The travel will be at the expense of that company and without cost to the City. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that this request be granted and the travel authorized and the motion was 1:13 carried by the fOllowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
