The Commission of the City of Bozeman met in regular session in the Commis.
sion Room, City Hall Building, Wednesday, October 7th, 1959 at 1:00 o'clock P.M.
Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager
Henderson, City Attorney Lovelace and the Clerk. The following proceedings were I
had:
Copies of the minutes of the last regular meeting, held on September 30, 1959
having been furnished to each member of the Commission and read in detail by them,
it was moved by Commissioner Swanson, seconded by Commissioner Berg, that those
minutes be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergj
those voting No, none.
Claims for the Month
Claim Nos. 5986 to 6262 inclusive were presented on the various funds as
follows:

The Manager stated that he has audited these claims and finds them to be
true and lawful claims against the City of Bozeman and recommends that warrants
be issued for their payment. After examination of the claims in detail by the
Commissioners and checking against the Claim Register, it was moved by Commis-
sioner Swanson, seconded by Commissioner Berg, that the claims be approved and
warrants drawn for their payment and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commis.

Alpha Gamma Rho - Agreement for Off-Street Parking
James Paugh, President of Alpha Gamma Rho Alumni Association, appeared before
the Commission and presented a proposed agreement between that Association and the
City. That Association proposes to build a fraternity house upon the following
described property:
North 10 feet of Lot Nineteen (19), all of Lots Twenty (20) and
Twenty-one (21) and the south 15 feet of Lot Twenty-two (22) in
Block Two (2) of Park Addition to the City of Bozeman, Montana.
This property is not of sufficient area to provide required off-street I
parking to go with the proposed building. The fraternity has a-three (3) year
lease on property owned by Chi Omega Sorority on the north side of Garfield Street
between 4th and 5th Avenues which will provide the required amount of parking dur-

ing that period and the agreement, now proposed is to the effect that, on or
before the expiration of that lease, the fraternity will secure that or other
area within not to exceed 800 ft. from the fraternity building which will provide

off-street parking for their fraternity on a permanent basis to meet the require-
ments of the zoning ordinance.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, tha t the
Mayor and Clerk be authorized to sign this agreement for the City of Bozeman and
that the agreement be accepted as meeting requirements for off-street parking for
I this proposed fraternity building and the motion was carried by the fo~lowing Aye

sioner Berg; those voting No, none.

The following Reports were presented to the Commission for acceptance and

It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the
reports be approved and ordered fi~ed and the motion was carried by the fo~lowing

Reso111tion No. 963 - Assessing W & C 1959
This was the time and place set for public hearing on levying assessment for
cos t of repe ir, replacement or construction of new sidewalk for the year 1959.
Affidavit of publication of Notice was presented. No one was present to protest and
I no written protests having been filed, Resolution No. 963, as presented and pro-
visionally passed at the meeting of September 30th, 1959 was presented for final
passage. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that
the resolution be fina~ly passed and adopted and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg
and Commissioner Swanson; those voting No, none.
Resolution No. 965 - Garbage Assessment
This was the time and place set for public hearing on levying assessment for
cost of collection and disposal of garbage for the year 1959. Affidavit of Publi-

I "White Canes" - Request to Sell, "J!-H" Club
"'Snappy Snippers 4-H" Club have requested permission to sell "Whi te Canes" on
Bozeman streets, October lOth, the proceeds of the sale to be for the purpose of
aiding the blind. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that the request be granted and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor ErWin, Commissioner Berg and Commis-
sioner Swanson; those voting No, none.

ftTwo-way" Radio Equipment - Opening of Bids
This was the time and place set for opening bids on "Two-way" radio equipment
to provide a communications system between the City Hall, City Yards and vehicles of
department heads of the City's operating departments.
Affidavit of publication of "Notice of Bids" was presented. Two bids having
been filed, it was moved by Commissioner Swanson, seconded b~t Connnissioner Berg, I"
that the bids be opened and the motion was carried
The following bids were read:

The bids were referred to City Manager Henderson and, upon his recommendation,
it was moved by Commissioner Berg, seconded by Commissioner Swanson, that MOTOROLA
be awarded the contract, and the motion was carried by the following Aye a nd No vote:
those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson;
those voting No, none.
Marwyn Re-arran~:emen t - Peti tion for Sewer Facilities Block" C"
A petition was presented from the Bridger Development Company for the City to
establish a Special Improvement District to provide for cost of operation and main-
tenance of sewer lift station as part of a sewer system for properties in Block "e"
of Marwyn Re-arrangement of a portion of Northern Pacific Addition. 'l'he petition
set forth that the installation of the lift station and of a sewer to connect it
to existing sewers in Marwyn Addition will be made wholly at the expense of the pet- I
itioner. The City Engineer was instructed to prepare the necessary data and, based
on such d.ata, the City Attorney was instructed to prepare a resolution of intention
to create the proposed district.
Retirement - City Manager llenderson
City Manager M.,E. Henderson having, at the last regular meeting of the Commis~ '..
sion, made public annmlDcement of his intention to retire from the position of City
Manager on December 31, 1 D 59 , the followin~ letter was presented to Mr. Henderson
and it was directed that it be made a matter of permanent record by being entered
in full as a part of the minutes of this meeting.

Dear Mr. Henderson:
It 1s with sincere regret that we, as the City COllID'ission of the City
of Bozernan, acknowledge receipt of your letter of September 30 advis-
ing of your intention to retire as City Manager on December 31, 1959.
While Done of us has been an incumbent commis;;;ioner dtLring the er:tire
twenty-two years of your service as City Manager, we are all, perforce,
well acquainted with your conduct of the office by simply being cit-
izens of this communi ty. During your tenure many ImproverYJen ts and
advancements have been made in the community, such as the sewage disposal
plant, a Widespread street improvement program, a garbage collection and

sanitary landfill program, the new southslde water system, street light-
ing, expansion of the park system and institution of an organized recre-
ation program, to mention but a few. We are fully aware, as we believe
the citizens of Bozeman should be, that you have had a major part in the
institution of all these improuements and many other too numerous to
mention.
Your conduct of the very important office of City Manager has been
characterized, we believe, by an unswerving loyalty to the City, and
yo-ur actions have always been motivated by what you thought was the very
I best for the City as a whole. Your devotion to your job, your inuus try,
your courtesy and fairness in dealing with the Commission and the citizens
of the City of Bozeman, and, above all, your unquestioned integrity have
made your tenure outstanding.
We feel that the citizens of Bozeman should be grateful for the job you
ha ve done and we would like you to accept this let ter as an expres sian
from the elected representatives of the citizens of this City of their
collective regret in seeing you retire from this important position.
May you and Mrs. Henderson have many years in which to enjoy ;vour well
earned retirement, and may the future reward you well!

Municipal League Meeting - Authority to Travel
The Montana Municipal League has announced a meeting of its Executive and
Legislative Committees and Mayors to be held in Helena on October 22, 1959 .
It was moved by Commissioner Berg, seconded by Commissioner Swanson, tha t Ma yor
I Erwin and members of the City Commission and City Manager Henderson be authorized to
attend the meeting and that, it being in the public interest, their expenses for such
attendance be paid from the General Fund and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commis-
sioner Swanson; those voting No, none.
"Traxca va tor" - Contract for Purchase
Based on the bid of Nash.Davis Machinery Company, received on May 13, 1959
on a Model 977, Caterpillar "'Iraxcavator" and on action taken by the City Commission
on September 30, 1959 in accepting this bid, proposed condItional sales contract
between the above named company and the City to cover the unpaid balance of
$19,5UO.00 on this machine was presented. The agreement provides for pa yrnen t of
this balance as follows:
$5,500.00 on October 1, 1960
6,50u.UU on October 1, 1961
7,50u.U0 on Octocer 1, 1962
~hese balances to bear interest at the rate of 4i% per annum. It was moved by

and that the Mayor be and is hereby authorized to sign the same for the City and the

There being no further business to come before the Commission at this time, it
was moved by Commissioner Swanson, seconded by Commissioner Berg, that the meeting
