October 21, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, October 21, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: _I Copies of the minutes of the last regular meeting, held on October 14th, 1959 and adjourned to 8:00 o'clock P. M., October 16th, 1959 and reconvened as of that date and hour, having been furnished to each member of the Commission and read in detail by them, it was moved by Commissioner Swanson, seconded by Mayor Erwin, that they be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Annual r-1eeting of M.i.ddle Creek Water Users' Association Notice has been received of the annual meeting of the Middle Creek Water Users' Association to be held on Wednesday, October 21, 1959. It was moved by Mayor Erwin, seconded by Commissioner Swanson, that Oscar E. Cutting be appointed as the official representative of the City of Bozeman at this meeting and that he be given a proxy to vote the stock of the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Protest to Truck Route R. L. Rampy, a member of the Hawthorne School PTA, met with the COmrrO.ssion regarding the Truck Route along the Hawthorne School. Members of the Commission suggested to Mr. Rampy that he contact Mr. Clayton of the Montana Truckers Association and request him to attend a regular meeting of the I Commission at an early date. The matter was tabled to be further discussed in the near future. Option to Purchase - City Lot on North Rouse M. A. Shanholtzer appeared before the Commission to notify it that he has acquired the option granted May 1, 1959 to the Bozeman Development Company to purchase City-owned property abutting North Rouse Avenue between Main and Mendenhall Streets and that he will exercise said option on or before November 1, 1959. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the assignment of the option be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, node. Reports The following reports were submitted to the Commission for approval: C emet ery Director of Public Works Director of Finance Police Judge Police Chief After examination of these reports, Mayor Erwin moved that the reports be approved and filed and the motion was seconded by Commissioner Swanson. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Sub-Contracts - SID's Numbers 406, 410, 411 and 412 I Copy of a sub-contract between Stanley H. Arkwright, Inc. of Billings, Montana and Haggerty-Messmer Co. of Bozeman, Montana was presented. This contract provides that Haggerty-Messmer Co. will do specified work as a sub-contractor on the contract awarded Stanley H. Arkwright, Inc. for construction in Special Improvement Districts No's 406, 410, 411 and 412 at a total approximate cost of $84,000.00. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that City Ma.nager Henderson be directed to notify the contracting parties of its approval of the above and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. ~._.__..- -- 132 Swimming Pool - Contract for Engineering Services for Reconstruction A letter was presented from R. L. Prussing, Billings, Montana under which he proposes to do all required engineering work for replacement of equipment necessitated by fire which occurred at the Swimming Pool in July, 1959. His fee for such service is 9~% of the total cost, up to the first $50,000.00, and 9~% of cost above $50,000.00. These totals are quoted to include a second swimming pool for Bozeman should the City desire to include one in the scope of its planning. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the proposal of Mr. Prussing be approved and .' accepted subject to the following conditions: 1. The plans and specifications prepared by him shall include plans and specifications for such renovation, reconstruction or replacement of the swimming pool building or part thereof which may be required. 2. Mr. Prussing shall furnish whatever engineering supervision is required during replacement of equipment and repair or replacement of the building to the point where the pool is returned to normal operation. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. VJater Fund - Investment of Reserve Cash Director of Finance L. G. Shadoan reports $50,000.00 of cash reserve in the Water Fund which he recommends to be invested in U. S. Treasury Bills. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the Director of Finance be and is hereby authorized to make this recommended invest- ment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. I Liberty Loan Finance Co. - Sign I Written request was presented from Obie Signs, Bozeman, Montana, for a waiver of the portion of Ordinance No. 786 relative to maximum area of overhanging signs as it would apply to a sign for the Liberty Loan Finance Co. to be hung over-hanging the sidewalk at the northwest corner of the inter- section of Main Street and Black Avenue. It was moved by Mayor Erwin, seconded by Commissioner Swanson, that, subject to the proposed sign being erected to meet all other requirements of Ordinance No. 786, the requested waiver be granted and permission granted to erect the sign 67~' in area and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. ': .. Purchase of Gravel City Manager Henderson advised the Commission that, from a survey of available sources of gravel suitable for use in street repair, the offer of Wilbur Harding to furnish pit-run @ 40~ per yard, l~" crushed @ $1.00 per yard and 3/4" crushed @ $1.25 per yard, loaded on City trucks at the Clark pit which is approximately 6 miles due south from Bozeman appeared to be the most suitable source. To fill bad holes in alleys and streets and for stockpile of material estimated for winter needs in filling paving cuts and other emergency conditions, the City Manager recommended that purchase be 'I authorized of 500 yards of pit-run and 500 yards of l~" crushed gravel at the above quoted prices. It was moved by Mayor Erwin, seconded by Commissioner Swanson, that purchase of gravel as per the foregoing recommendation be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Special Meeting - Zoning Ordinance Mayor Erwin announced that a special meeting of the City Commission will be held at the regular meeting place Monday, October 26th, at 3:00 o'clock P. M. for further consideration of a proposed new Zoning Ordinance for the City. Adjournment 153 There being no further business to come before the Commission at this time, it was moved by Mayor Erwin, seconded by Commissioner Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none.
