The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, October 28, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner
Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. Commissioner Swanson was absent.
the following proceedings were had:
I Copies of the minutes of the last regular meeting held on October 21, 1959 and of the special
nleeting held Monday, October 26, 1959 at 3:00 o'clock P. M. having been furnished to each member of the
Commission and read in detail by them, it was moved by Mayor Erwin, seconded by Commissioner Berg, that
they be approved and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin and Commissioner Berg; those voting No, none.
Hearing - Vacation of Street, Avenues & Alleys - Bozemar Deaconess Hospital Property
Hearing on Resolution No. 961 pertaining to proposed vacating of certain streets and alleys in
area owned by the Bozeman Deaconess Hospital was held on October 14, 1959. Instructions were given to
the City Attorney to prepare an ordinance to vacate these streets and alleys. A letter has now been
received from H. A. Bolinger, Jr., Attorney for Dorothy E. Burke who owns scattered lots in the affected
area. The letter sets forth that notice of the proposed vacating was not received by Mrs. Burke in
time to protest at the regular date of hearing. The letter requests further that, if the vacating
ordinance has not been passed, Mr. Bolinger be given opportunity to enter a protest for these owners.

The matter was referred to City Attorney Lovelace to enable him to confer with Attorney Bolinger and
the attorney for the Deaconess Hospital Board with the view ~f reopening the hearing to hear the
protests to be submitted by Mrs. Burke.
I Building Permit - Kenyon-Noble Lumber Co. "Springbrook AdcUtion"
w. V. Ogle, Vice President and Manager of Kenyon-Noble Lumber Co., appeared before the Commission
relative to proposed construction of residences on properties owned by his company facing on
9th and 10th Avenues between Mendenhall and Lamme Streets. In May, 1959 his company secured information
from the Building Inspector and City Engineer to the effect that the plans they proposed met all building
and zoning requirements. They applied and paid for water services to be extended from the City's
system to their proposed building sites. In June, 1959 Ordinance No. 813 was passed by this City which
amended the zoning regulations and required a minimum lot area for a residence site in a "B" Residence
Zone. Two of the residence sites on which it is now proposed to build residences in this case are
only 5000 ft. in area. In view of the water permits issued and the information furnished by owner in
this case, it was considered that to deny a building permit now on the basis of the inadequacy of the
lot area would be imposing undue hardship. It was moved by Mayor Erwin, seconded by Commissioner Berg,
that the Building Inspector be authorized to issue building permits for the five residences in question
and that the requirement for 6000 square feet of lot area in this case be waived and the motion was
carried by the following Aye and No vote: those voting Aye being Y~yor Erwin and Commissioner Berg;
those voting No, none.
I Building Permit - Ralph's Food Store
Ralph Williams, owner of Ralph's Food Store at North 7th and Durston Road, has made inquiry regard-
ing enlargement of his existing building. The building is in Fire Zone No. 1 as defined by Ordinance
No. 794. The existing building is of frame construction. In view of the large unoccupied ground area
owned by Mr. Williams surrounding-this-build~g, it was moved by Commissioner Berg, seconded by Mayor
Erwin, that conditioned on the existing building being fire protected and any addition to the building
being of required fire protective rating so that the entire structure would meet all requirements of
buildings in Fire Zone No.2 and all requirements of building and zoning ordinances of this City, the

Building Inspector be, and is hereby, authorized to grant a permit to Mr. Williams for improvement of
an addition to his building in accordance with preliminary plans which he has presented and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and
Commissioner Berg; those voting No, none.
Traffic Hazards - North 7th Avenue
New sidewalks have been constructed this year on both sides of North Seventh Avenue between Beall I
Street and Durston Road. Since there are no curbs on the street side of these sidewalks special
hazards have been created along some of the properties from cars driving at randum over the sidewalk.
The City Manager was directed to take such action as is necessary to insure that vehicles entering and
leaving properties along this section of street will be required to do so in designated driveway areas.
North Seventh Avenue -- Possible Reconstruction of
Unofficial information indicates that, when the Interstate Highway is built in the Bozeman area,
there will be an interchange on it connecting to North Seventh Avenue. The City Manager was directed
to write a letter to the Montana Highway Department to request that, on or before the time when this
interchange is constructed, the Montana Highway Department program the reconstruction of North Seventh
Avenue to make it a four lane paved street from the present junction of U. S. Numbers 10 and 191 at
Seventh and Main Street to the new interchange.
City Dump -- Building to House Equipment at
City Manager Henderson reported that investigation has been made of various types of buildings
to house the equipment used for operating the sanitary landfill at the City Dump. From this investiga-
tion he recommends that a "Butler", prefabricated building, 16' X 24' & 12' high, appears to be the
best and most economical for existing needs. The cost of material of such a building, without founda- I
tion, doors or windows, is approximately $975.00. It was moved by Commissioner Berg, seconded by Mayor
Erwin, that the City Manager be authorized to purchase such a building and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Berg; those voting No,
none.
S. 1. D. 1/41h - Change Order
Change Order No. 1 to Plans and Specifications for construction of S. I. D. No. 414 was presented.
It authorized the use of unglazed, vitrified clay tile as substitute for glazed, vitrified clay tile
as shown in the original specifications. It was moved by Commissioner Berg, seconded by Mayor Erwin,
that the Change Order be approved and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin and Commissioner Berg; those voting No, none.
Request to Park Trailer House at Hyalite Subdivision
Written request was presented from Intermountain Homes Inc. for permission to park one trailer
house within the limits of the new Hyalite Subdivision. Request sets forth that no space is available
at any authorized trailer court in Bozeman for an additional trailer. The trailer proposed to be
located is to be used as an office and housing for a watchman during course of present construction
of homes by this company in this subdivision. It was moved by Commissioner Berg, seconded by Mayor I
Erwin, that the request be granted on a temporary basis subject to cancellation at any time by the
City Commission and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin and Commissioner Berg; those voting No, none.
Plat -- Kirk Subdivision No. 2
A preliminary plat of proposed Kirk Subdivision No.2, an area abutting the lines of Main Street
extended and 15th Avenue North extended, approximately eight acres, Was presented to the Commission
for information only. The plat had been given conditional approval by the City-County Planning Board.
City Manager was instructed to inform a representative of the developer that the City will look with 157
favor upon the completed plat as per the preliminary plan presented, subject to the conditions stated
by the City-County Planning Board and subject to further condition that the developer would, at the
request of the City, join with the owners of intervening land between this tract and the existing city
limits in a petition to have such tract and intervening land joined to the City.
Storm Sewer Outlet North 9th Avenue -- Alleged Damage From
I A letter was presented from H. A. Bolinger, Jr., for himself and as attorney for Mrs. Martha
Palffy and Mrs. Laura M. Brunton, alleging that a storm sewer now being installed on North 9th Avenue,
discharge point of which will be in North 9th Avenue between Beall and Villard Streets, will cause
damage to land between Villard Street and Durston Road owned by him and his clients. A review of the
situation indicates that there is no base for the allegation. The letter was referred to the City
Attorney for preparation of a reply to it.
Equipment - Purchase of Notor for Dodge 4 X 4
...
A Dodge, 3/4 Ton, 4-wheel Weapons Carrier which is a part of the equipment of the Park Department
requires a new motor to continue it in operation. A new motor is quoted at $405.00 plus transportation
and plus installation cost. This is a war surplus vehicle which has been in the City's service ~ore
than thirteen years but it is of design and tJ~ethat is particularly well adapted for the use~being
made of it and it is considered much more economical to purchase this new motor than to purchase a
replacement for the vehicle. It was moved by Commissioner Berg, seconded by Mayor Erwin, that the City
Manager be authorized to purchase the motor as described above and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Berg; those voting'
No, none.
I Hequest - Hontana Pmver Co. - Gas Line
\iritten request was presented from the Montana Power Company to lay a gas line in South Fourth
Avenue from Grand to Lincoln Street. The proposal is to lay the gas line in the parking strip between
the curb and the sidewalk and it will involve cutting paving only at the intersection of Fourth and
Grand. It was moved by Comnissioner Berg, seconded by Mayor Erwin, that the request be granted
conditioned on the backfill of the trench being made to meet the specifications and under the direct
supervision of the City Engineer and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin and Commissioner Berg; those voting No, none.
Proposed Agreement - Engineering Services on Hyalite Subdivision by John Bereman
Engineering services have been and are being rendered by John S. Bereman and Co., Cody, Wyoming
under a verbal agreement between Mr. Bereman and the City Commission on improvements being constructed
as part of Special Improvement District 414. A proposed agreement was presented to set forth in
official form the details of this informal agreement. The proposal was referred to the City Attorney

for review and recommendation.
Request -- "Muscular DystrophJTIl Drive
I Verbal request has been received from Mrs. Harry Duntsch for~he Order of Rainbow Girls, assisted
by members of the Order of DeMolay, to conduct a fund raising drive for the "Muscular Dystrophy" fund
on November 3, 1959. It was moved by Mayor Erwin, seconded by Commissioner Berg, that the request be
granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Erwin and Commissioner Berg; those voting No, none.
Heport - CPA's Audit of Gallatin Field Records
Annual audit report of the accounts of Gallatin County Airport Board and Gallatjn Field maintenance
funds for the fiscal year ending June 30, 1959, as presented by Alfred M. Stiff, C. P. A. of the

accounting firm of Clark, Stiff and Kirchhoff, was reviewed. It was moved by Commissioner Berg,
seconded by Mayor Erwin, that the report be approved and ordered filed and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Erwin and Corrunissioner Berg; those
voting No, none.
Adjournment
There being no further business to come before the Corrunission at this time, it was moved by I
