The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, November 4, 1959 at 1:00 o'clock P.M.
Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager
Henderson, City Attorney Lovelace and the Clerk. The following proceedings were

Copies of the minutes of the last regular meeting held on October 28, 1959
having been ~lrnished to each member of the Commission and read in detail by them,
it was moved by Commissioner Berg, seconded by Commissioner Swanson, tha t they be
approved and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Berg 9nd Commissioner Swanson; those voting
No, none.
S.I.D. No. 409 - C; arge Order
Change Order No.1 to Plans and Specifications for construction of S.I.D.
No. 40g as prepared by Hoskins and Associates, supervising engineers, was present-
ed. It auttorized additional work for the Contractor in excavatin,.,. for lowering
a water main on Beall Street at Ninth Avenue at an approximate cost of $110.00.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the
change order be approved and the motion was carried by the following Aye and No
vo te : those voting Aye being Mayor ErWin, Commissioner Swanson and Commissioner
Berg; those voting No, none.

Deficiency- in the proposal was polnted out by City Attorney Lov0lace as to payment
to be made for engineering supervision of construction of the project. It was
moved by Commissioner Berg, seconded by Commissioner Swanson, that the Clty Manager
be directed to again take this matter up by letter wi.th John S. Bereman & Co., and
that a letter proposal, corrected as recommended by the C1 ty Att:orr'e:r, and a written
acceptance of it shall constitute B sufficient contract and the motion was carried
by the following Aye and No vote: those voting Aye being ~ayor Erwin, Commissioner
Berg and Co~~issioner Swanson; those voting No, none.
Traffic Control Signal - Intersections of 1':ain Street with 7th and 8th Avenues
Correspondence has been exchanged with the Montana Highway Department for more
than three years on the possibility of securing State and Federal participation in
I the installation of traffic control signals on West Main Street intersections with
7th and 8th Avenues. A letter has now been received from the Montana Highway
Department, with copy of a letter to them from the U.S. Buroau of Public Roads,
disapproving the requested participation in cost.
Report-Sewerage System Hoskins
In accordance with their contract on Housing and Home Finance Agency Project
No. Mont. 24-P-3081, Sanitary Sewer System, Harold Hoskins and Associates presented

their "Preliminary Report on Sewerage System Improvements for the City of Bozeman."
The report covers recommended enlargement of and additions to the present sewerage
system to serve estimated growth of this City until 1980 or to an estimated population
growth to 20,000. The report was referred to the City Engineer and other officials
of the City for study and comment.
Report - Montana Municipal League Meeting I
City Manager Henderson gave a verbal report on the meeting of the Executive
and Legislative Committees of the Montana Municipal League which he and Commissioner
Swanson attended in Helena on October 22, 1959. The meeting was principally con-
cerned with recommendations to be presented at the annual meeting of the League on
possible legislation to secure additional revenue for cities and towns.
Claims for the Month
Claim Nos. 6267 to 6614 inclusive were presented on the various funds as

The Manager stated that he has audited these claims and finds them to be true
and lawful claims against the City of Bozeman and recommends that warrants be issued I
for their payment.
After examination of the claims in detail by the COnlrr'lssionars and check-
ing against the Claim Register, it was moved by Commissioner Swanson, seconded by
Commissioner Berg, that the claims be approved and warrants drawn for the ir pa ymen t
and ~he motion was carried by the following Aye and No vote: those voting Aye be-
ing Mayor Et>win, Commissioner Swanson and Cow~issioner Berg; those voting No, none.
Report of Personell Strength in Operating Departments
When wage and salary increases were ryranted as of July 1, 1959, employees
were informed that it mic,:ht necessitate reduction in number of personell or reduction
in man hours of work for regular employees in operating departments during winter
months. The City Manager was directed to furnish a report on the existing personell
status in these departments.

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that
the reports be accepted and filed and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Erwin, Commissi~ner Swanson and Co~is-
sioner Berg; those voting No, none.

SID No. 414 - Bonds
Bonds in the amount of $320,000.00 must be issued and sold agatnst S.I.D. No.
414 to provide funds for payments for improvements now being constructed in this
dis tric t. Bid for ~lrchase of these bonds was accepted at adjourned meetIng of the
Commission on October 16th, 19 59 . It was moved by Commissioner Berg, seconded by
'I Commissioner Swanson, that the Director of Finance be authorized and directed to have
the above bonds prepared for issue on December 1, 1959 and that he and the Mayor and
the Cl8rk of the Commission be authorized to sign the same for the City of Bozeman
and the motion was carried by the following Aye and No vote: those voting Aye being
Hayor Erwin, Commissioner Berg and Comr1issioner Swanson; thos.:;) voting No, none.
Plan~in~ Services - Resoh!tion
It hqs been ascertained that Federal funds are available from the Housin; and
Ho~e Finance Agenoy, through the Montana State Planning Soard, to continue the
services of a planning consultant cmtiJ January 26, 1961. The amount B\ui.1.abJ.e is
is $1,350.UO which must be matched by the same amount of rands f1)rn:ished by the City
and County. Particular purpose is to continue work on the existing Master Plan and
the implementation of it. The City Manager was instructod to interview Mr. Laurence
Gerckens of the Archi tectual Department, Hont,g,na Sta te College, to work out a pro-
posal under which Mr. Gerckens may be employed to carry out this work on a part time
basis.
North Seventh Avenue - Possible Reconstruction of
I As instr11C ted, City Manager Henderson presented a proposed letter requosting the
Montana lL1.ghnay Departnent to program reconstrtl.ction of North Seventh Avenue to make
it a four lane paved street from the present junction of U.S. Numbers 10 anlt 191 at
Seventh and Main Street north to the interchanr;:e proposed to be built on the new
Interstate Highway. The Commission approved the request as to contents and form and
instructed Mr. Henderson to forward it to Helena.
Sub-Contract - S.I.D. No. 414
Cop:,)! of a sub-con trae t be tween Stanley II. Arkvvr~.,- r;h t, Inc. of Billimgs, ~.!on tana
and Hag~erty-Messmer Co. of Bozeman, Montana was presented. This contract provides
that Haggerty-Messmer Co. will do specified work as a sub-contractor on the contract
awarded Stanley H. Arkwrl~ht, Inc. for construction in Special Improvement District
No. 414 at a total approximate cost of ~60,000.UO.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, tha t C i t Y
Manager IJenderson be directed to notify the contracting parties of its approval of
the above and the motion was carried by the follOWing Aye and No vote: those voting

Qui t Claim Deed - Alleys-Werre Rearranp:ement
A Quit C1Rim deed from the City to Donald A. Corcoran, abutting property owner,
to alleys vacnted by City Ordinance No. 816 was presented. This instru~0nt included
the followin~ described property:
"All existing alleys in Blocks Five ( 5) and Six(6) of WERRE REAn!?ANCE~,TEJ-'-T of
Blocks 3, 4, 5, 6 and West Portion of Blocks 2 and 7 of West Side Addition
to Bozeman, Montana."

Canvass of General Election - 1959
The Clerk of the Commission aided by the City Commission proceeded to canvass
the returns of' the General Election, held November 3, 1959 . The canvass showed the I
following returns:

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that Fred
M. Staudaher and Edmund P. Sedivy be declared elected to the office of City Commis-
sioner for a fo'_:r-year term beginning January 1, 1960, and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Storm Sewer Olltlet North 9th AVenue - Letter
H. A. Bolinger, Jr. has, by letter dated October 24, 1959 , alleged tha t, by
construction of' a storm sewer the outlet of which is in North Ninth Avenue between
Beall and Villard Streets, the City of Bozeman will cause damage to lands owned by him
and his client, the estate of Laura Maxey, which lands are situate directly north
from and abutting on Villard Street. This matter has been investigated by the City
Attorney, City Engineer and the City Manager. A proposed letter from the City I
Manager to Mr. Bolinger, in which the City denies the allegations, was reviewed and
the City Manager was directed to send the letter to Mr. Bolinger.
Zoning Ordinance - Special Meeting
Mayor Erwin notified the members of the Commission that a Special Meeting of
the Co~ission w111 be held November 9th, 1959 at the City Hall at 3:00 o'clock P.M.
for the purpose of further considering the proposed New Zoning Ordinance of the City.

The following resoh,tion was presented to the Commission for approval:
Whereas, The City of Bozeman, Montana accepted an offer from the United
States Government for an advance for preparation of planning documents
pertaining to a public work described as Expansion and Extension of
the City's sewerage sys tem.
Whereas, Harold Hoskins and Associates were engaged to prepare the ,
planning documents for the aforosaid public work, and said architect
and/or ongineer has completed the documents and submitted them for
approval; and
Whereas, the comple ted planning documen ts have been caref"Ll11y studied
and are considered to comprise adequate planning of the public work

Now, Therefore, be it resolved by The City Commission the governing
