The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Thursday, November 12, 1959 at 1:00 o'clock P.M. Present
were Mayor Erwin, Commissioner Swanson, COMmissioner Berg, City Manager Henderson,
City Attorney Lovelace and the Clerk. The folloWing proceedings were had:
'I' Copies of the minutes of the last regular meeting held on November 4, 1959 and
of the Special Meeting held November 9th, 1959 having been ~~rnished to each member
of the Commission and read in detail by ther1, it was moved by Commissioner Berg,
seconded by Commissioner Swanson, that they be approved and the motion was carried
by the following Aye and No vote: those votinc Aye being Mayor Erwin, Commissioner
Berg and Commissioner Swanson; those voting No, none.
Ready-Mix Plant - Complaint on Conditions in lO~ Block on ~outh Wallace
Josef Zinner appeared before the Commission to register a complaint that the
concrete mixing plant operated by Kenyon-Noble Lumber Company in the 100 block on
South Wallace Avenue is creating undesirable conditions because of its method of'
opera tim:: . Mr. Zinner was informed that Mr. Ogle, Vice-President and Manager of

Kenyon-Noble Lumber Co., has/notified of these undesirable condit:lons. Action in
t~e matter was deferred pending receipt of a letter from Mr. Ogle which he has
agreed to present to state in detail what his firm proposes to do to remedy this
dis tua tion.
I retition - Vaca te Strip of Land on ~ou th Nillson Betwe;m Main and Babcock Streets
A petition, signed by owners of all properties abutting the east side of South
I Willson Avenue between ~1ain and Babcock Streets, was presented by G. C. Waite. The
petition was for the C1 ty to vaca te a s trip of Willson .r~venue along said block,
starting at zero width at Main Street, reaching a maximum width of 1.6 feet at the
alley line and continuing at a width of 1.6 feet to Babcoak Street. Because of
errors in building locations in this block, the City had given Quit Claim deeds
man~T years ago to the gr01;nd in ques tion but owners now find it D8cessary to ha ve
the area regularly vacated to clear titles to their properties. Mr. viai te informed
the City that :tt would be reimbursed for all expenses incurred to complete the
proceedings. It was moved by Commissioner Berg, seconded by Commissioner Swanson,
that the City Attorney be requested to prepare a resolution of intention to vacate
that portion of the street in question and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor ErWin, Commissioner Berg and Commis-
sioner Swanson; those voting No, none.
Gallatin Alrport - Reconstrl1ction of Field Facilities
I Gardner Waite and Howard Nelson, representatives of the Gallatin Airport
Committee, discussed the matter of the Gallatin Airport with the Commission and
requested that a member of the Commission accompany them to Helena to meet with State
and Federal Officials on Tuesday, November 17th. The Commission informed M~.'--~mi te

and Mr. Nelson that Commissioner Berg will make the trip and assist tb:~m-1:n anyway
possible.
Reports
The follOWing reports were presented for approval by the Commission:

It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the
reports be approved and filed and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.

Agreement - Engineering Services on Hyalite Subdivision by John Bereman.
As directed, City Manager Henderson had secured and presented a corrected
Proposal prepared by John Bereman and Co., Cody, Wyoming to cover agreement on that
Company's engineering services on Special Improvement District No. 414. It was
moved by Commissioner Berg, seconded by Commissioner Swanson, that the Proposal
constitute a contract between the City and John Bereman & Co., and that the Mayor
and the Clerk be directed to sign the instrument for the City and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Berg and Commissioner Swanson; those voting No, none.
FBI School - Report of Sgt. Cutting
Sergeant Ron Cutting reported to the Commission on the most interesting phases
of his schooling at the FBI School which he recently attended. The Commission
suggested that he and the Chief of Police now form classes of instruction to be
attended by members of the City Police Force that the City might further benefit
from their training.
Ordinances - Recodification
City Attorney Lovelace further Discussed the recodification of City Ordinances. I
Mr. Lovelace was informed by the Commission that it would rely on his recommendation
as to the final selection of a concern to complete the work. Mr. Lovelace stated
that he wished to give the matter further study before a selection is made.

There being no further business to come before the Commission at this time, it
was moved by Commissioner Swanson, seconded by Mayor Erwin, that the meeting adjourn
and the motion was carried by the following Aye and No vote: those voting Aye being
