The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, December 9, 1959 at 1:00 o'clock P.M. Present
were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson,
Assistant City Manager Cutting, City Attorney Lovelace and the Clerk. The follow- I
ing proceedings were had:
Copies of the minutes of the last regular meeting held on December 2, 1959 having
been furnished to each member of the Commission and read in detail by them, it was
moved by Commissioner Swanson, seconded by Commissioner Berg, that the minutes be
approved and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
No, none.
Hearing Resolution of Intention No. 961
As requested Dec. 2, 1959 during the regular meeting of the Commission, the
Bozeman Deaconess Hospital Board has prepared a tfWaiver & Release" which holds the
City free and harmless from loss or damage to any lots in the area involved which
would be caused by vacating streets and alleys as proposed in Resolution No. 961.
The waiver & release was approved as to form by the City Attorney. With the except-
ion of the written protest f':11ed'by Dorothy E. Burke no other person or persons have
protested, verbally or otherwise, the action as proposed in Resolution No. 961. I
Therefore, the City Commission instructed the City Attorney to prepare an ordin-
ance vacating the streets and alleys described in Resolution No. 961.
Ordinance No. 817 - Vacating
The City Attorney, as instructed, has prepared an ordinance vacating certain
streets, avenues and alleys in Prospect Hill Addition, Valley Veiw Addition, High-
land Addition and Central Addition to the City of Bozeman. Ordinance No. 817 was
presented, entitled:

PORTIONS OF EAST COLLEGE STREET, EAST CLEVELAND STREET,
EAST ARTHUR STREET, BUTTONWOOD AVENUE, HIGHLAND AVENUE,
CYPRESS AVENUE SOUTH, McADOW AVENUE SOUTH, AND PROSPECT
PLACE AND ALL ALLEYS AS ORIGINALLY PLATTED, ALL IN PRO-
SPECT HILL ADDITION TO THE CITY OF BOZEMAN, PORTIONS OF
BUTTONWOOD AVENUE, CYPRESS AVENUE SOUTH, McADOW AVENUE
SOUTH, EAST LINCOLN STREET, EAST GARFIELD STREET, EAST
HAYES STREET, EAST GRANT STREET, JOHNSON PLACE AN ALL
ALLEYS AS ORIGINALLY PLATTED, ALL IN VALLEY VIEW ADDITION
TO THE CITY OF BOZEMAN, PORTIONS OF EAST GARFIELD STREET,
ORIGINALLY PLATTED, ALL IN HIGHLAND ADDITION TO THE CITY
OF BOZEMAN, AND PORTIONS OF EAST HARRISON STREET, EAST
CLEVELAND STREET, EAST ARTHUR STREET, EAST GARFIELD STREET,
EAST HAYES STREET, EAST GRANT STREET, JOHNSON PLACE, EAST I
LINCOLN STREET, AYLSWORTH AVENUE, SWITZLER AVENUE, ELECTRIC
AVENUE, AND ALL ALLEYS AS ORIGINALLY PLATTED, ALL IN CENTRAL
ADDITION TO THE CITY OF BOZEMAN.
It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the
ordinance be passed and adopted and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none. .-

Deed - Right-or-way For Street
A warranty deed from the Bozeman Deaconess Hospital to the City to transfer title
to land for right-of-way for a proposed street extending northerly from the northwest
corner of Hyalite View Subdivision to a point which is the northwest corner of Central
Addition and the northeast corner of Prospect Hill Addition was presented. It was
moved by Commissioner Swanson, seconded by Commissioner Berg, that the deed be accepted
I and placed of record and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those
voting No, none.
Reports
The following reports were presented:
The October report of the Director of Finance and the November reports of
the Chief of Police, Building Inspector, Cemetery, and the Cashier and Water
Collector.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, tha t the
reports be approved and filed and the motion was carried by the,f()llowing Aye and No
vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commis5ioner Swanson;
those voting No, none. -.
Claims - Stanley H. Arkwright, Inc. - SID No. 414
Claims of Stanley H. Arkwright, Inc. for work completed on contract for constr-
uction in SID No. 414 in the amount of $81,774.87 were presented. These claims were
I supported by detailed estimates prepared by John S. Bereman Co., supervising engineers.
City Manager Henderson pointed out that bid for purchase of bonds of this district,
with required bid security, has been accepted but that actual delivery of these bonds
will not be made until January 2, 1960, therefor there are not funds in the account of
SID No. 414 to pay these claims. It was moved by Commissioner Swanson, seconded by
Commissioner Berg, that these claims be approved and warrants be issued for their pay-
ment and that the Director of Finance be and is hereby authorized to register these
warrants to thereby defer actual payment of them until receipt of the proceeds from the
sale of the herein described bonds. The motion was carried by the following Aye and
No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner
Berg; those voting No, none.
Claim - B & E Co. Water Main in New Hylite View Subdivision
A claim in the amount of $7,384.75, filed by the B & E Co., Inc., for the City's
share for installation of water mains in New Hyalite Subdivision was presented. The
City Manager recommended that payment of this claim be deferred until the Water distri-
bution system in Hyalite View subdivision is completed and given final inspection and
I until necessary right-of-way easements for proper conveyance of title to this distri-
bution system are delivered to this City. These recommendations were accepted and
further action in this matter deferred in accordance wherewith.
Doge - Employment of Dog Marshall
Recause of the recent series df dog poisonings and the resultant increase in
problems pertaining to dogs in the City, the Commission instructed the City Manager
to immediately employ a Dog Marshall for such length of time as the present situation
requires and to extend all possible effort to impound and dispose of all unlicensed

dogs found in the City.
Appointment - Oscar E. Cutting to Succeed M. E. Henderson as City Manager, Jan. 1, 1960
Mayor Erwin made announcement at this time of the appointment by the Commission of
Oscar E. Cutting to be the City Manager of Bozeman such appointment to be effective
from January 1, 1960. Appointment of Mr. Cutting is to fill the vacancy in that office
which will be created by the retirement of City Manager M. E. Henderson which will I
become effective December 31, 1959.

it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting
