HomeMy WebLinkAbout1959-12-23 182 Bozeman, Montana December, 23, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, December 23, 1959 at 1:00 o'clock P.M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, Assistant City Manager Cutting, City Attorney Lovelace and the Clerk. The following I proceedings were had: Copies of minutes of the last regular meeting held on December 16, 1959 having been furnished to each member of the Commission and read in detail by them, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that these minutes be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Commis- sioner Berg; those voting No, none. '-. Report November report of the Police Judge was placed before the Commission and it was ~ ~ - ~ moved by Commissioner Swanson, seconded by Commissioner Berg, that the report be accepted and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. , Ordinance No. 819 - Mmendlng Ordinance 558 As instructed, City Attorney Lovelace had prepared an emergency ordinance No. 819 ~ending section one of Ordinance No. 558. This ~ending Ordinance was placed before the Commission entitled: ORDINANCE NO. 819 AN ORDINANCE AMENDING ORDINANCE NO. 558 OF THE CITY I OF BOZEMAN CHANGING THE LICENSE FEE UPON FEMALE DOGS It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the foregoing be passed and adopted as an emergency ordinance of the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. 183 Hearing - Resolution No. 966 \ This was the time and place set for hearing protests to vacating a portion of the east side of Willson Avenue between Main and Babcock streets as set forth in Resolution No. 966, passed and adopted by the City Commission on November 18, 1959. Affidavit of Publication of Notice was presented together with sheriff1s returns of I service of notices. There was no one present to protest, and no protests having been filed, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Attorney be directed to prepare an ordinance vacating that portion of Willson Avenue described in Resolution No. 966 and that Quit Claim deeds be prepared to trans- fer to the abutting property owners the equity of the City to title in the land so vacated and the motion was carried by the follOWing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those vot1ng'~o, none. - -- Schedule - Re-valuation of City Buildings and Contents for Insurance Purpose.~ -- -- - - '- "-,. A proposed list of estimated values of city owned buildings and contents_ ~hereof to be submitted to the Montana Fire Rating Bureau as a basis on which to re-e~5tablish , an average blanket rate for fire insurance was approved at the last regular meeting of the Commission. Attention was now invited to action of the Commission on February 25, 1959 relative to adding certain buildings to those covered under the blanket rate and excluding certain buildings therefrom. G. C. Waite, representing the Bozeman Insurance association, now appeared to recommend specifically that the control building at the Sewage Treatment Plant be retained on that list. I It was moved by Commissioner Berg, seconded by Commissioner Swanson, that action taken by this City Commission on February 25, 1959 relative to insurance coverage be amended and that deletions from and additions to the list of estimated values be as follows: Delete Chlorina tirg Plan t Bldg. 3 Miles S/E of City Limits Chlorlnating Plant Bldg. 2t Miles N/E of City Limits Add - Storage Building, 40lx601 at new City Yard, Rouse & Tamarack " " 241x301 tI " " " " " " , " " 16 'x24' " " " " " " " , h and that, with ~ese de~etions and additions, the list of values as presented on December 16, 1959 be now submitted to the Montana Fire Rating Bureau and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Easement - Sewer Lines - - Intermountain Homes to City An easement was presented from Intermountain Homes, Inc. granting rights-of-way I to the City for sewer lines and water lines which cross certain lots owned by this Company in Hyalite View Sub-diviSion. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that this easement be accepted by the City and placed of record and the motion was carried by the following Aye and No vote: those voting Aye being Me yor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Plat - Proposed Re-arrangement of Portion of Durston Sub-division A plat of a proposed re-arrangement to be known as the Brunton-Palffy re-arrangement of a portion of Durston's Sub-diVision was presented. It was moved by Commissioner Berg, 18/1 seconded by Commissioner Swanson, that, subject to concurrent approval by the City- County Planning Board, the plat be approved and the City Manager acting as Director of Public Service, be authorized to sign the same for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none.
