HomeMy WebLinkAbout1959-12-30 185 Bozeman, Montana Dec. 30, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, ,City Hall Building, Wednesday, December 30, 1959 at 1:00 o'clock P.M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, I Assistant City Manager Cutting, City Attorney Lovelace and the Clerk. The following proceedings were had: Copies of minutes of the last regular meeting held on December 23, 1959 having been furnished to each member of the Commission and read in detail by them, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that these minutes be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Water System - Hyalite Subdivision John Bereman, Supervising Engineer, and Warren Cowgill, Sam Kaisler and T. G. Haggerty representing the B & E Co., Inc. appeared before the Commission to discuss the status of the water distribution system which is being installed in Hyalite Subdivision by Haggerty-Messmer Company under oontraot with the B & E Co., Ino. By agreement bet- ween the City of Bozeman and the B & E Co., Ino. the City is to pay that excess cost for trunk lines, which may serve other areas than Hya1ite SUbdivision, Over and above the cost of such lines if they were of sufficient capacity to serve Hyalite Subdivision only. a & E Co., Inc. has filed a claim for $7,384.75 to cover such cost. I Mr. Bereman informed the Commission that the water system installation is near completion but that it can not be certified as complete until frost is out of the ground and adequate tests of it made in the spring of 1960. He recommends that a 10% reserve be held from the claim of the B & E Co., Inc. and that the balance of the claim be paid. After extended discussion, it was moved by Commissioner Berg, seconded by Commis- sioner Swanson, that the above referenced claim, less 10% reserve, be paid SUbject to the fOllowing conditions: 1. A supervising engineer furnish & written statement as to the status of completion of the work and sta- tus of payment made to-date to the contractor. 2. The B & E Co., Inc. will furnish an acceptable agree- ment to turn this water distribution system over to this City upon its oomp1etion. ). The B & E Co., Inc. will furhish an acceptable agree- ment, with concurrent approval by Haggerty-Messmer Company and their bondsmen, which will give the City full benefit of the guarantee of one year on this system after the installation is completed and accepted. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin" Commissioner Berg and Commissioner Swanson; those voting No, none. I Ordinance No. 820 - Vacating The City Attorney, as instructed, has prepared an ordinance vacating a portion of the east side of South Willson Avenue between Main and Babcock streets as described in Commission Resolution No. 966. Ordinance No. 820 was presented entitled: ORDINANCE NO. 820 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA VACATING A PORTION OF SOUTH WILLSON AVENUE' IN THE CITY OF BOZEMAN. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the 186 ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Examination of Depository Bonds The Commission proceeded to examine the Custodian's Receipts for Depository Bonds held by the Director of Finance as security for City funds deposited in Bozeman banks. I It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the secur- ities be approved and a list thereof be set forth in full in the minutes of this meet- ing and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Wilson It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the above signatures be approved for the purposes set forth and the Mayor be authorized to sign a letter to the above named bank in acc~rdance with such approval and the mo- tion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. I Authority to Travel - Building Inspector Roy Smart Notice has been received of a five-day Seminar to be held at Idaho State COllege, Pocatello, Idaho, January 18-22, 1960 for building inspection officials. City Man- ager Henderson recommended that Building Inspector Smart be authorized to attend this Seminar. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that, it being in the public interest, Mr. Smart be authorized to attend this Seminar at Idaho State College and that his expense incurred by such attendance be paid from the General Fund and the motion was carried by the following Aye and No vote: those vot- ing Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; those voting No, none.
