The Commission of the City of Bozeman met in regular session in the Commission
Room, City Hall Building, Wednesday, Sept. 2, 1959 at 1:00 o'clock P. M. Present
were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson,
.
City Attorney Lovelace and the Clerk. The following proceedings were had:
I Minutes of the last regular session were read and it was moved by Commissioner
Swanson, seconded by Commissioner Berg, that the minutes be approved as read and
the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
Bids tOF S. I. D. Nos. 406, 408, 409, 410, 411 and 412
This was the time and place set for opening b1ds for construction of Special
Improvement Districts Nos. 406, 408, 409, 410, 411 and 412. Affidavit of public-
action of Notice to Bidders was presented.
Mayor Erwin informed those present that, in order to expedite the reading of
the bids, only the total bid on each district would be read and that a complete
bid tabulation will be made available to all bidders before contracts are awarded.
It was moved by commissioner Swanson, seconded by Commissioner Berg, that the bids
be opened and a tabulation of bids submitted be made.

seconded by Commissioner Berg, that Stanley Arkwright, Billings, Montana, be award-
ed the contract for Special Improvement District Noo 406, his bid in the amount of
$9,975.79 being the low qualified bid received and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting No, none.
Upon the recommendation of Harold Hoskins & Associates, Consulting Engineers
on the Project, and City Engineer Liquin, it was moved by Commissioner Berg,
seconded by Commissioner Swanson, that Stanley Arkwright, Billings, Montana, be
I awarded the contract for Special Improvement District No. 410, his bid in the amount
of $98,933.29 being the low qualified bid received and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; thos voting No, none.
Upon the recommendation of Harold Hoskins & Associates, Consulting Engineers
on the Project, and City Engineer Liquin, it was moved by Commissioner Swanson,
seconded by Commissioner Berg, that Stanley Arkwright, Billings, Montana, be award-
ed the contract for Special Improvement District No. 411, his bid in the amount

of $164,347.50 being the low qualified bid received and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson
and Commissioner Berg; those voting No, none.
Upon the recommendation of Harold Hoskins & Associates, Consulting Engineers
on the Project, and City Engineer Liquin, it was moved by Commissioner Berg, second-
ed by Commissioner Swanson, that Stanley Arkwright, Billings, Montana, be awarded I
the contract for Special Improvement District No. 412, his bid in the amount of
$11,155.50 being the low qualified bid received and the motion was carried by the

Upon the reoommendation of Harold Hoskins & Associates, Consulting Engineers
on the Project, and City Engineer Liquin, it was moved by Commissioner Swanson,
seconded by Commissioner Berg, that Haggerty-Messmer Co., Bozeman, Montana, be
awarded the contract for Special Improvement District No. 408, its bid in the
amount of $59,213.30 being the low qualified bid received and the motion was I
carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Berg and Commissioner Swanson; those voting No, none.
Upon the recommendation of Harold Hoskins & Associates, Consulting Engin-
eers on the Project, and City Engineer Liquin, it was moved by Commissioner
Swanson, seconded by Commissioner Berg, that Haggerty-Messmer Co., Bozeman,
Montana, be awarded the contract for Special Improvement District No. 409, its bid
in the amount of $31,434.60 being the low qualified bid received and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Berg and Commissioner Swanson; those voting No, none.
It was moved by Commissioner Berg, seconded by Commissioner Swanson, that
the bid securities of the unsuccessful bidders be returne~ to them and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Erwin,
Commissioner Berg and Commissioner Swanson; those voting No, none.
Highland Boulevard - Right-of-way
C. V. Henderson, Secretary of the Bozeman Deaconess Hospital Board, was
present and presented a Quit Claim deed to proposed right-or-way for Highland I
Boulevard extending from Hyalite Sub-division north one-hElf milt:! to lJrum Lummon
Addition. On advice of City Attorney Lovelace the deed was returned to Mr. Henderson
with a request that, after a conference between attorneys representing the
Hospital Board and the City, the ~eed be redrawn in different form and again present-
ed for consideration.

Trao1.M.ndln~.11 Parking Lot - Paving
A proposal was presented from Haggerty-Messmer Co. to place hot plant mix
asphalt paving on the parking lot which the City has under lease at the corner
of Tracy and Mendenhall for the sum of $1,157.00. Consideration has been given
to doing the work with City personel and equipment but, since Haggerty-Messmer
I has a hot mix paving plant in operation, it is considered that it would be more
economical to have them do this work. It was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the City Manager be authorized to instruct
Haggerty-Messmer Co. to perform the work under specifications supplied by the
City Engineer, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson;
those voting No, none.
Parking Meters-Purchase and Installation at Tracy-Mendenahll Parking Lot
The City Manager recommended that the City make, outright purchase of 18,
Model GS-4-A dual parking meters to start a replacement program of Model E
Dual meters purchased in 1946. ~his would be a cash purchase at $58.UO per
meter less allowance of $6.UO per meter per Model E meter to be turned in. He,
also, recommended purchase of 14 Model GS-4-A dual meters for installation on
the parking lot being paved at the corner of Tracy and Mendenhall. These meters
would be added to the existing contract under which the City is purchasing meters
I for parking lots and paying for them by remitting one-half of the proceeds from
such meters to the Dual Parking Meter Co. It was moved by Commissioner Swanson,
seconded by Commissioner Berg, that the City Manager be authorized to purchase
said meters and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Bergj those
voting No, none.
Examination of Depository Bonds
The Commission proceeded to examine the Custodian's Receipts of Depository
Bonas held by the Director of Finance as security for City funds deposited in the
various banks. It was moved by Commissioner Berg, seconded by Commissioner
Swanson, that the securities be approved and set forth in full in the minutes of
this meeting and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swansonj
those voting No, none.

Proposed Vacation of Alley in Blocks 5 and 6, Werre's Ite-arrangement
Blocks 5 and 6
A petition was presented from Donald Corcoran and others for the alley/in Werre's
Re-arrangement to be vacated. ~he petitioners represent all properties abutting
this alley. Mr. Corcoran represented that he desires to re-plat the above
described Werre's Re-arrangement and the alley serves no useful purpose now or
will it when the new plat is completed. All expense in connection with vacating
this alley and re-platting the area is to be born by Mr. Corcoran. It was moved-
ed by Commissioner Berg, seconded by Commissioner Swanson, that the City Attorney
be instructed to prepare a resolution of intention to vacate this alley in accord-
ance with the above and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Erwin, Commissioner Berg and Commissioner Swanson; I
those voting No, none.
Purchase of Supplies for Water Department
W. R. Border, Water Superintendent, states need in his department for pipe
fittings and valve boxes at the approximate cost of $750.UU. It was moved by
Commissioner Berg, Seconded by Commissioner Swanson, that the City Manager be
authorized to purchase the supplies and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Berg and
Commissioner Swanson; those voting no, none.

Graveling - Portion of Cypress Ave. and Curtiss Street
A letter was presented from the Bridger Development Company requesting that
the City share in the cost of graveling a portion of Cypress Avenue and Curtiss
Street which are abutted on one side by property owned by that Company and on
the other side by City owned property. This Company has, also, petitioned for a
special improvement district to be established to prOVide for paving these and
other streets in the same general area. Their letter proposes that the gravel
to be installed wouLd serve as proper base for the paving which would be install- I
ed at a later date. It was moved by Commissioner Berg, seconded by Commisslmner
Swanson, that the City Manager be instructed to inform the Bridger Development
Company as follows:
(l) Graveling of the streets as requested in their letter would be done at
their expense and under direction of the City Engineer.
(2) If a special improvement district is established, and gravel which has
been installed by the Bridger Development Co. is usable as a base for
paving, the Bridger Development Co. will be reimbursed on a prorate
share for the graveling it has done.

(3) ~he Bridger Development Company must take immediate action to remove
dangerous conditions which they have created by excavating in Cypress
Avenue and Curtiss Street, and to make these streets safe and usable
until such time as permanent improvements are made.
The motion was carried by the following Aye and No vote: those voting Aye being

Aylsworth Ave - Quit Claim Deed for ~ortion
.1 A Quit Claim deed from the City of Bozeman to Winifred King Hunt for that
portion of Aylsworth Avenue from Fort Ellis Street to East College Street in
, Drum Lummon Addition was presented. This portion of the street was previously
vacated by Ordinance and Mrs. Hunt had deeded an equal amount of land to the
City. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that
the City Approve the deed and that the Mayor and Clerk of the Commission be
authorized to sign the deed for the City and the motion was carried by the
#ollowing Aye and No vote: those voting Aye being Mayor Erwin, Commissioner
Swanson and Commissioner Berg; those voting no, none.
Adjournment
There being no further business to come before the Commission at this time, it
was moved by Commissioner Swanson, Seconded by Commissioner Berg, that the meet-
ing adjourn and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg;
