HomeMy WebLinkAbout1959-05-13 70 Bozeman, Montana May 13, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, May 13, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, Commissioner Berg, City Manager Henderson, City Attorney Lovelace and the Clerk. The follow- ing proceedings were had: It was moved by Commissioner Swanson, seconded by Commissioner Berg, that reading of the minutes I of the last regular meeting, held May 6, 1959, and of the special meeting, held May 11, 1959, be dispensed with and that those minutes be approved as they are written in the minute book and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Bids for Front End Bucket Loader This was the time and place set for opening bids on a tractor mounted front end loader. Affidavit of publication of Notice to Bidders was presented. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. The following reports for the month of April, 1959 were presented: Police Judge Sanitary Inspector Cemetery Board It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, COmmissioner Swanson and Commissioner Berg; those voting No, none. 71 Water W:::>rks Project - Claim of Statewide for ~l,BOO.OO Claim of Statewide PllD'llbing & Heating Company, in the amount of $l,SOO.OO, for extra work alleged to have been necessitated by improper testing of water supply lines by the supervising engineers on the Water Improvement Project, was considered. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager inform the Statewide PllD'llbing & Heating Compa~y by letter I that payment of this claim is refused and the motion was carried by the following A,ye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Water \\Orks Project -- Claim of Morr!son-Maierle, Inc. Claim of Morrison-Maierle, Inc., in the amount of $1,206.72 for balance due them for services rendered as consulting and supervising engineers on the City's water Works Improvement Project was presented. After detailed consideration, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that when this claim is submitted on the regularly required form, it be and is hereby approved for payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Parking Restricted on South Church Avenue at Swimming Pool It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the Director of Public Safety be instructed and authorized to issue an order to prohibit parking on the west side of South Church A venue from the north line of Bogert Park to the South line of Bogert Park during the months of June, Ju~y and August and the motion was carried by the following Aye and No vote: those voting A,ye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. - Opening of Highland Drive I Mr. C. V. Henderson, representing Deaconess Hospital Board, was present to discuss with the Commission problems involved in opening Highland Drive across land owned by the Deaconess Hospital Board in the Valley View and Prospect Hill Additions. Mr. Henderson was asked to make a proposal in writing to the City of Bozeman for the opening of this drive as proposed in the Master Plan and to present a petition for closing any streets which would be made necessary because of dedication of the proposed Highland Drive. Peti tions i'or Paving in Area ''Eft Petitions for paving streets in Area "B" as described in the Hoskins report were presented. It was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Engineer prepare the necessary data and, based on this information, the City Attorney be instructed to prepare a resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. - Application for Beer License The application of the Cullen Grocery, 503 South Black Avenue, for a license for sale of beer for off-premises conslD'llption was presented. It was moved by Commissioner Berg, seconded by Commissioner I Swanson, that, subject to required proof being furnished that a Montana State license has been secured and that all state laws pertaining to sale of beer at this location have been complied with, this application is approved and that the license be issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Business Licensp Approved - 520 North Black Application of the M & W Repair for a license to operate a repair shop at 520 North Black Avenue was presented. This location is in a "D" R id Di . .. es ence strict as deflned in the Zonlng Ordlnance of 72 this city. Since that ordinance shows "Small Work Shops" as an allowable use and occupancy in this zone, it was moved by Commissioner Swanson, seconded by Commissioner Berg, that the application be approved and the license issued and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Acceptancp of Montana Flour Mills Offer to Sell Water Rights By letter dated September 5, 1958, Montana Flour Mills Company offered to sell certain ditch rights and water rights from Bozeman (Sourdough) Creek to the City of Bozeman for the sum of $500.00 I' plus the City's accepting all legal expense incident to the sale in an amount up to but not to exceed ' $250.00. Upon further consideration of this matter, it was moved by Commissioner Berg, seconded by Commissioner Swanson, that the City Manager be authorized to submit a counter-proposal to this Company, offering to buy the ditch and water rights described in their letter of September 5, 1958, for the net and total sum of $500.00 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Purchase of Truck for Park Department The Northern Auto Co. has offered for sale a 1955 G.M.C., 1/2 ton, pick-up at a net price of $995.00. It appears that this truck is well suited to fill urgent need in the Park Department for such a vehicle and its purchase will affect much savings over having to purchase a new truck. It was moved by Commissioner Swanson, seconded by Commissioner Berg, that the City Manager be authorized to purchase this truck and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none. Agreement - Easement for Retaining wall - 11 West r.ol1ege An easement agreement, prepared by the City Attorney, pennitting the Sigma Nu Fraternity to place a retaining wall in the alley abutting their property at 11 West College, was presented. It 1 was moved by Commissioner Swanson, seconded by Commissioner Berg, that the agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin, Commissioner Swanson and Commissioner Berg; those voting No, none.
