HomeMy WebLinkAbout1959-05-20 73 Bozeman, Montana May 20, 1959 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, May 20, 1959 at 1:00 o'clock P. M. Present were Mayor Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the Clerk. The following proceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Swanson, seconded by Mayor Erwin, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Quit Claim Deed - Vacated r.urtiss Street A quit claim deed to Ingolph M. and Clara B. Johnson of vacated portion of Curtiss Street extending east from Thirteenth Avenue, a distance of g3.9 feet, was presented. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the Mayor and the Clerk of the Commission be authorized to sign the deed for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Report of State Board of Health - Re: Water and Sewer S,vstem A report of the State Board of Health covering their annual inspection of the water and sewer system of the City was presented. Encroachment of "Planters" at MSC Dorm! tory Disapproved Martin Whalen of Montana State College was present and discussed the encroachment of three, brick-walled planters in street areas at the dormitory being completed at Eighth Avenue and Cleveland. After full consideration, Mr. Whalen was info~ed that this encroachment of the planters would not I be permitted and that the order from the City Engineer to have them removed should stand. Bozeman Creek Reservoir r.ompa~v - Aid from Soil Conservation District The Bozeman Creek Reservoir Company is making application to the Gallatin Valley Soil Conserva- tion District for engineering assistance in the construction of a new spillway at Mystic Lake. The City Manager is a member of the Board of Directors of the Bozeman Creek Reservoir Company, representing the City of Bozeman on that Board. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that City Manager M. E. Henderson be authorized to sign the application as the city's representative and the motion was carried by the following Aye and No vote: those voting ~ve being Mayor Erwin and Commissioner Swanson; those voting No, none. Petitions to Vacate Street in Proposed HYalite Sub-division Petitions f~om the Deaconess Hospital, owners or over 51% of the property in the proposed Hyalite Sub-division, to v~cate the streets and alleys in Valley View Addition, Highland Addition, Central Addition and Prospect Hill Addition were presented. The City Attorney was instructed to review the law regarding the vacating of streets and alleys as it would affect small tracts of ground in the I additions not owned by the Hospital and action on the petitions was deferred pending receipt of the City Attorney's opinion in the matter. Insurance Rates Within the City of Bozeman G. C. Waite and Chas. Vandenhook, Jr., representing the Bozeman Insurance Association, were present and reported to the Commission that the Board of Fire Underwriters and the Montana Fire Rating Bureau have completed extensive surveys of this city and, as soon as their reports are completed, it is expected that Bozeman will be re-rated for fire insurance purposes. While no official statement has been issued, it is indicated that the classification of the City may be raised from Class 6 to Class 5. 7.\ J.egion POPPy Day - 1959 It was moved by Commissioner Swanson, seconded by Mayor Erwin, that Saturday, May 23, 1959 be designated as American Legion Auxiliary Memorial Poppy Day and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Land Trade for Ground at Ii brary I. A proposal from the Gallatin Hardware whereby they would deed the North 128 feet of Lot 17, Block E, to the City in exchange for the South 22 feet of Lots 12 to 16, Block E, all in the Original Townsite was reported. It was moved by Commissioner Swanson, seconded by Mayor Erwin, that the exchange of property as proposed be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Erwin and Commissioner Swanson; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Swanson, seconded by Mayor Erwin, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting ~ve being Mayor Erwin, Commissioner Swanson; those voting No, none. ~ uC& ~ .
